RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY
ROAD 2.5 - DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road Petition from the Department of
Public Works, 1111 H Street, P.O. Box 758, Greeley, Colorado 80632, a copy of said petition and
a list of the adjoining property owners marked Exhibit A, being attached hereto and included by
reference, requesting vacation of a portion of right-of-way for County Road 2.5, being more fully
described as follows:
Located in the East 1/2 of Section 31, Township 1
North, Range 66 West of the 6th P.M., Weld County,
Colorado, as further described in Exhibit B.
WHEREAS, the Department of Public Works and the Union Pacific Railroad Company
(UPRR) believe that it is appropriate to close the UPRR crossing on County Road 2.5 since that
portion of right-of-way is not needed for the safety and welfare of the traveling public, and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public, and
WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is
described above will not leave any land adjoining the roadway without an established public road
or private access easement connecting the land with another established public road, and
WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion
of road right-of-way, with said vacation to become effective upon recording as required below.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Road Petition from the Department of Public Works, be, and hereby
is, accepted.
BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is
described above, be, and hereby is, vacated.
BE IT FURTHER RESOLVED by the Board that any persons owning dedicated and
recorded easements and rights -of -way for the use of the vacated right-of-way, if any, shall not be
affected by the right-of-way vacation authorized herein.

BE IT FURTHER RESOLVED by the Board that there be, and hereby is, reserved for
existing utilities within said vacated roadway, an easement for the continued placement,
maintenance, repair, and replacement of such utilities.
BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral
interests it may possess in the area of the vacated right-of-way and that the vacation authorized
herein shall in no away affect such mineral interests.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution and the attached Exhibits A and B in the records of the Weld
County Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of September, A.D., 2018.

PETITION TO VACATE COUNTY ROAD RIGHTS -OF -WAY
Weld County Public Works hereby petitions the Weld County Board of County Commissioners to vacate
certain county road rights -of -way described herein.
PURPOSE
Weld County Public Works has been coordinating with the Colorado Department of Transportation
(CDOT), and Union Pacific Railroad (UP), related to the negotiated closure of eleven county road
crossings of UP's railroad, of which this application specifically applies to five railroad crossings located
east of U.S. 85, except for WCR 104, which is west of U.S. 85. CDOT, on behalf of Weld County, has
submitted five petitions to the Public Utilities Commission (PUC) requesting authority for the railroad to
close each public crossing. On May 2, 2018, the Weld County Board of County Commissioners
unanimously approved submitting the five applications to the PUC. While the process for closing a
railroad crossing is done through the PUC, the process for Weld County to close a road is done in
accordance with the requirements of C.R.S. Section 43-2-303(2)(b). Therefore, the purpose of this
request is to vacate portions of Weld County Roads 2.5, 29, 46, 72, and 104 as part of this application
with the advice and assistance from the County Attorney's Office.
BACKGROUND
The history of the US 85 Corridor is lengthy, and involves Union Pacific Railroad Company (UPRR), Weld
County and CDOT. In 1923, UPRR entered into a 50 -year lease with Weld County for the Highway 85 right-
of-way. In 1931, UPRR and Weld County entered into a new year-to-year lease of Highway 85 and
terminated the prior 50 -year lease. In 1957, UPRR and CDOT entered into a 50 -year lease of the Highway
85 right-of-way allowing CDOT to have highway facilities within the right-of-way. That lease terminated
December 31, 2006. Since the termination, and for the past twelve years, both CDOT and UPRR have been
negotiating the resolution of the matter which culminated in a Purchase and Sale Agreement. UPRR, Weld
County and CDOT have worked together strategically, to enable the closure of crossings that would allow
trains to park or pass within railroad sidings that presently have at -grade highway -rail crossings, thus
improving rail operations, and removing random crossing occupation by trains within the county to
provide better vehicular circulation and more reliable access routes for emergency services.
CDOT entered into the Purchase and Sale Agreement with UPRR in order for CDOT to obtain full fee
ownership for those portions of the highway located within railroad right-of-way, while still providing
UPRR rail capacity as a result of the purchase to ensure the functional integrity of both the CDOT and
UPRR transportation systems and to improve the safety of the corridor by reducing potential vehicle/train
conflicts. To mitigate capacity impairment from the land sale, the Purchase and Sale Agreement includes
the closure of several roads intersecting the railroad and US 85, most of which are under the jurisdiction
of Weld County. CDOT does not have authority to close county roads and has therefore coordinated with

Weld County to satisfy this portion of the agreement. To this end, Weld County and CDOT hosted public
meetings regarding the closures in Fort Lupton and Eaton on January 22 and 23, 2018, respectively.
The Purchase and Sale Agreement identified the closure of twelve county roads. Weld County has been
working with CDOT and UPRR on the locations for these road closures that will work best for meeting the
goals of all the agencies involved. The agencies' goals are as follows:
• CDOT Goal: Obtain full fee ownership from UPRR for the US 85 ROW.
• UPRR Goal: Mitigate capacity impairments and close the Purchase and Sale Agreement.
• Weld County Goal: Ensure the long-term stability of the US 85 corridor through partnering with
CDOT and UPRR that improves the safety of the highway/rail corridor, improves the operational
efficiencies to enhance economic development opportunities, and reduces conflicts for
communities, while also ensuring reliable emergency response time.
This vacation application only reflects five of those eleven locations. The other closures will be brought
before the Commissioners on a case by case basis.
RIGHTS -OF -WAY REQUESTED TO BE VACATED
1) County Road 2.5
Weld County Public Works petitions to vacate all of that county road right-of-way (ROW) of County Road
2.5 described and depicted in Exhibit A, attached hereto ("CR 2.5 ROW"). The CR 2.5 ROW is
approximately 412 feet in length and 60 feet in width and is located approximately 1,200 feet east of
U.S. 85. The CR 2.5 ROW is located entirely or primarily within the railroad right-of-way owned by the
Union Pacific Railroad. This area is located east of the City of Brighton within the Brighton 27J School
District, Platte Valley Ambulance Service, and the Greater Brighton Fire District.
2) County Road 29
Weld County Public Works petitions to vacate all of that county road right-of-way (ROW) of County Road
29 described and depicted in Exhibit B, attached hereto ("CR 29 ROW"). The CR 29 ROW is
approximately 785 feet in length and 60 feet in width and is located east of and adjacent to U.S. 85. The
CR 29 ROW is located entirely or primarily within the railroad right-of-way owned by the Union Pacific
Railroad. This area is located just south of the Town of Gilcrest within the Valley RE1 School District,
Banner Health Ambulance Services, and the Platteville-Gilcrest Fire Protection District.
3) County Road 46 and 35
Weld County Public Works petitions to vacate all of that county road right-of-way (ROW) of County
Roads 46 and 35 described and depicted in Exhibit C, attached hereto ("CR 46/35 ROW"). The CR 46/35
ROW is approximately 850 feet in length and 60 feet in width and is located east of and adjacent to U.S.
85. The CR 46/35 ROW is located entirely or primarily within the railroad right-of-way owned by the
Union Pacific Railroad. This area is located north of Peckham and southeast of the Town of LaSalle within
the Valley RE1 School District, Banner Health Ambulance Services, and the LaSalle Fire Protection
District.
4) County Road 72
Weld County Public Works petitions to vacate all of that county road right-of-way (ROW) of County Road
72 described and depicted in Exhibit D, attached hereto ("CR 72 ROW"). The CR 72 ROW is
approximately 406 feet in length and 60 feet in width and is located east of and adjacent to U.S. 85. The
CR 72 ROW is located entirely or primarily within the railroad right-of-way owned by the Union Pacific
Railroad. This area is located south of the Town of Eaton within the Eaton RE2 School District, Banner
Health Ambulance Services, and the Eaton Fire Protection District.
5) County Road 104
Weld County Public Works petitions to vacate all of that county road right-of-way (ROW) of County Road
104 described and depicted in Exhibit E, attached hereto ("CR 104 ROW"). The CR 104 ROW is
approximately 419 feet in length and 60 feet in width and is located west of and adjacent to U.S. 85. The
CR 104 ROW is located entirely or primarily within the railroad right-of-way owned by the Union Pacific
Railroad. This area is located northwest of the Town of Nunn within the Ault -Highland RE9 School
District, Banner Health Ambulance Services, and the Nunn Fire Protection District.
UTILITIES; MUNICIPALITIES
No portion of any of the County Road Rights -of -Ways described herein are located within the limits of
any incorporated town or city, or on the boundary of any other county. Any utilities or other structures
currently located within these rights -of -way are not intended to be affected by these vacations, as
contemplated by C.R.S. §43-2-303(3).

RE: WCR 2.5 Closure at UPRR Tracks
To Whom It May Concern:
The Fire District is submitting this letter in opposition of the closing of County Road 2.5 unless
conditions are met.
The closing of CR 2.5 would affect emergency responses as well as the fire insurance costs for
the adjacent properties. Even with a planned fire station on New Energy Drive (CR 4) just north
of this proposed road closure, responding crews would have an extended response time and
travel distance in order to serve this area.
However, if a frontage road were provided on the east side of the UPRR Tracks and between
New Energy Drive (CR 4) and CR 2, the Fire District would be in support of the requested
closure.

The City of Brighton understand the need to close this crossing. We remain
committed to supporting no closures at Rd. 4. For Rd. 2.5 to be closed, local
Brighton businesses and Weld County residents to the east will be detrimentally
effected. We would like to continue working with Weld County to create
adequate alternative access from Rd 2 north to these existing businesses and
residents. We would like to explore the option of converting the existing unpaved
frontage access that runs along the eastern edge of the railroad property into a
recognized public access easement that is paved. As a more viable, long term
access to these properties, we would like to work with Weld Co on a north/south
frontage road from Rd 2 to Rd. 4, east of 9th Ave.

Complaint, Objection, and Request for Addition to Agenda
Dear Ms. Gesick:
Please accept this as Monaghan Farms, Inc.'s complaint and objection with respect
to the above captioned matter. Please add this document to the Board's official record.
Also, if possible, Mr. Thomas Deline would like to present to the Board at the September
17 hearing on behalf of Monaghan Farms and answer any questions. We anticipate this
presentation would take about twenty minutes.
Introduction
On November 21, 2017, CDOT entered into a purchase agreement to buy the US 85
right of way in fee simple that CDOT historically leased from the Union Pacific Railroad
Company. As a part of this agreement, UPRR made numerous demands on CDOT and
imposed conditions in the purchase agreement designed to increase UPRR's railroad
capacity and increase its profits. This included seeking to close five UPPR railroad
crossings, including County Road 2.5 near Monaghan Farms' property. CDOT will pay
approximately $35 million to UPRR to purchase the right of way. CDOT also seeks to use
federal funds to close the crossings.

Unfortunately, these proposed closings will cause a significant hardship to local
landowners in the area, including Monaghan Farms, including creating circuitous access
on rural unimproved roads and significantly impaired access by emergency vehicles.
Monaghan Farms respectfully asks that the Weld County Commissioners request CDOT
and UPRR fund a local County project to improve local roadways and ameliorate some of
the negative effects to local residents from the proposed railroad crossing closings.
Complaint and Objection
Pursuant to Section 2-1-160 of the Weld County Code, Monaghan Farms
respectfully files this complaint and objection with the County. Monaghan Farms, as
owner of real property which abuts Weld County Road 2.5, opposes the Petition and
requests opportunity to be heard at the public hearing scheduled for September 17, 2018
concerning the proposed vacation of the County's right of way near the railroad crossing
along County Road 2.5 in Weld County, Colorado.
C.R.S. § 43-2-303(2)(a) states No platted or deeded roadway or part thereof ...shall
be vacated so as to leave any land adjoining said roadway without an established public
road or private -access easement connecting said land with another established public road."
This subsection requires a party seeking to establish vacation of a roadway to demonstrate
that vacation will not create parcels without access. Board of County Commissioners of
Morgan County v. Kobobel, 74 P.3d 401 (Colo. App. 2002). Under these authorities, the
applicant must demonstrate that Monaghan Farms will have reasonable access to its
property before vacating the County road crossing. Monaghan Farms respectfully asserts
that local residents will have inadequate access after the proposed vacation of right of way
and RR closing for the following reasons.
I. Granting the Petition would remove current primary access to and from
Monaghan Farms ' property.
Vacating portions of Weld County Road 2' /z and closing the railroad crossing would
substantially affect Monaghan Farms' pecuniary and tangible interests because it would
remove Monaghan Farms' primary access to the property and the status of any secondary
access is unestablished. Monaghan Farms' primary access from the highway to its property
is by crossing the railroad heading east and turning south into a driveway on the property
near the residence. Monaghan Farms' property has been and continues to be utilized for
agricultural uses. Monaghan Farms acquired the property in 1956 and has had quiet and
peaceful public access for the property along County Road 2.5 since that time. The
residence is currently occupied by a family with four children, all of whom participate in
Brighton and Fort Lupton community and school activities that require frequent driving to
and from their home. There is currently no other road on the property for ingress or egress
that connects to any other public road.

Should the Board approve the Petition, Monaghan Farms could not easily build
another road for ingress and egress on the property due to an existing conservation
easement held by the Colorado Open Lands Land Trust, which prohibits development of
new roads or other alterations to the property without their approval and consent.
Therefore, the current driveway, which connects to County Road 2.5 is the only viable
access point.
The next closest railroad crossings are located along County Road 4 or East 168`"
Avenue, both of which are about .7 miles from County Road 2 '/z, and neither of which
provides direct access to Monaghan Farms' property. Should the crossing at County Road
2.5 be closed, emergency vehicles, Monaghan Farms, and the occupants of the residence
would be forced to drive, at a minimum, an additional approximately three (3) miles.
Please see attached demonstrative exhibit. While an alternative route may be available
along East 168`x' Avenue heading east, and then north along County Road 29, and then west
on County Road 2.5, this assumes that CDOT or Weld County would improve and maintain
these roads after closure of the railroad crossing. Monaghan Farms may also incur
damages from having to construct or improve a road to wherever CDOT or Weld County
may locate any new access to the property.
Lack of direct access not only creates an unnecessary burden on Monaghan Farms
and the current occupants of the residence, but also creates a fire and health hazard due to
slower emergency response times to the property. By adding at least three (3) miles to the
drive to access the property, emergency vehicles will take that much longer to respond to
any emergency on the property. Therefore, closing the railroad crossing poses a risk to the
health and safety of those who live on the east side of the railroad along County Road 2.5.
II. Granting the Petition would reduce Monaghan Farms ' property value and
increase operational costs.
Currently, the assessed value of Monaghan Farms' property is three hundred and
sixty-two thousand and three hundred and six dollars ($362,306) (Land, Buildings, and
Residence). The actual fair market value of the property may exceed this amount. The
residence alone is valued by the Assessor at three hundred thirty-nine thousand four
hundred and four dollars ($339,404). Monaghan Farms relied upon the current access
being available and based its decision to purchase the property upon this current ease of
access. Without access to the residence, not only will the residence value be diminished
but the overall value of the property will be diminished without the ability to fully enjoy
the residence.
Monaghan Farms' property is currently zoned for agricultural use. Monaghan Farms
intends to continue agricultural operations, however, without direct access to the highway,
agricultural operating costs will increase for transportation of materials and product. The
roundabout access and lower quality roads that will have to be utilized if the crossings at

County Road 2.5 are closed will mean increased costs for any pick-up, delivery, or service
vehicles required for continued agricultural operation.
The conservation easement that encumbers Monaghan Farms' property also
prohibits alterations to the property without the easement holder's consent, which may be
withheld if the proposed alteration (i.e. a new road) significantly alters the current
landscape. Therefore, should a new road or driveway be required for Monaghan Farms to
access the property upon closure of the railroad crossings and vacation of portions of
County Road 2.5, Monaghan Farms would bear additional costs and damages associated
not only with construction but also with approval from the easement holder and likely the
County as well.
III. Granting the Petition would constitute a taking or damaging without just
compensation.
Colorado's Constitution provides that "private property shall not be taken or
damaged, for public or private use, without just compensation." Colo. Const. art. II, § 15.
In Colorado, if a piece of property is damaged by the government's taking of an adjoining
property (not the landowner's property), compensation may be claimed if the landowner
can establish "special damages," that is, damages that differ in kind from the damages
suffered by the general public. See City of Northglenn v. Grynberg, 846 P.2d 175, 179 n.4
(Colo. 1993).
The closure of the railroad crossing and vacating portions of County Road 2.5 would
take or damage the private property held by Monaghan Farms. Monaghan Farms reserves
the right to bring an inverse condemnation claim against the Weld County Department of
Public Works or other governmental entities for damages related to said closure. Although
the government is apparently not taking Monaghan Farms' land as part of the project but
instead closing access to private property, Monaghan Farms may still establish damages
resulting from such closure.
In City of Northglenn v. Grynberg, the Colorado Supreme Court stated that "in no
case has mere depreciation in value been grounds to award just compensation for a
damaging of property." Patrick B. Augustine, Regulatory Takings Involving Property
Rights, Colo. Law., Mat 1994, at 1065, 1067, citing City of Northglenn v. Grynberg, 846
P.2d 175, 179 n.4 (Colo. 1993). Here, Monaghan Farms can establish both depreciation in
value and damages that would result from the closure of the railroad crossing and vacating
of portions of County Road 2.5, making this a compensable taking. Id. at 1067-68.
The government must provide Monaghan Farms with "reasonable access to the
general street system." See C.R.S. § 43-2-147(1)(c) (access to public highways); Colorado
State Highway Access Code, Department of Highways v. Davis, 626 P.2d 661 (Colo. 1981)
(damages for lost access to the property are recognized as a compensable injury).

Compensation is required when the remainder is damaged by a ``substantial impairment"
or loss of access. See Davis, 626 P.2d at 664. Closing the railroad crossing will
substantially impair access to Monaghan Farms' property which creates a unique burden
and damages that will not be shared by the public at large.
IV. The County Should Request that CDOT and UPRR Fund a Local County Project to
Mitigate the Effects of the Closings to Benefit the County and Local Residents
While CDOT and UPRR both benefit from the multimillion dollar purchase deal,
local County residents will suffer significant injury. CDOT is asking the County to vacate
the County's historic right of way as well as serve as an applicant in a series of proceedings
before the Colorado Public Utilities Commission to approve closing the railroad crossings.
In other words, CDOT is making the application to the PUC on the County's behalf It
would appear that the County is receiving literally nothing in return.
Monaghan Farms accordingly requests that the Board condition vacating the
County's right of way and participating as an applicant in the PUC closing proceedings
upon CDOT and UPRR's funding a local Weld County project to improve local roadways
near the RR closings to address these significant injuries and other impacts.
For the above stated reasons Monaghan Farms objects to the proposed vacation of
County Road 2.5 and asks to be heard by the Board at the public hearing on September 17,
2018 at 9:00am.

► UPRR , Weld County, and CDOT have worked together to strategically identify
closures with the greatest public benefit , which typically involved roads with
lower traffic volumes ( gravel roads ) , locations that would allow trains to park or
pass within existing or future railroad sidings , and mitigate the parking of trains
with municipalities to provide better vehicular circulation and more reliable
access routes for emergency services within cities/towns .
► CDOT Goal : Obtain full fee ownership from UPRR for the US 85 right- of-way.
► UPRR Goal : Mitigate capacity impairments and close the Purchase and Sale Agreement .
► Weld County Goal : Ensure the long -term stability of the US 85 Corridor through partnering
with CDOT and UPRR to improve the safety of the highway/ rail corridor, improve the
operational efficiencies to enhance economic development opportunities , and reduce
conflict for communities while also ensuring reliable emergency response time .
