RESOLUTION RE: GRANT, IN PART, THE APPEAL OF DECISION BY THE FAIR BOARD - CLINT AND CASEY SIDWELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an appeal from Clint and Casey Sidwell, concerning the decision by the Fair Board to: ban their child from participating in the 2019 Weld County Fair as a result of violation of Section E of the Combined Market Livestock Form; to withhold half the sales price of the Grand Champion Lamb, $4,000; and to withhold $1,000.00 for the premier exhibitor program, and WHEREAS, pursuant to Weld County Code Section 2-4-10, such appeal to the Board is considered to be "de novo", and WHEREAS, the Board found that there was a violation of Rule P in the Weld County Fair Book, specifically the failure to note a medication that was administered to the market animal prior to its exhibition, that the medication was given pursuant to a prescription from a veterinarian for purpose of providing care to the animal and not improving its performance in the show, that had the form been filled out properly the issue would have been resolved, and that, therefore, the penalty imposed to ban the competitor from exhibiting sheep in the 2019 fair and to return the $1,000.00 Premier Exhibitor prize was excessive, but that the withholding half of the sale price of the animal, in the amount of $4,000.00, is appropriate, and WHEREAS, upon consideration of the all the evidence presented, including a review of all information submitted by Clint and Casey Sidwell, and the Fair Board, the Board deems it advisable to grant the appeal, in part, and approve participation in the 2019 Fair and to allow the child to retain the $1,000.00 Premier Exhibitor prize, and WHEREAS, upon consideration of all the evidence presented, including a review of all information submitted by Clint and Casey Sidwell, and the Fair Board, the Board deems it advisable to uphold the decision of the Fair Board to withhold half the proceeds of the sale of the Grand Champion Lamb, $4,000.000, which shall be retained by the Junior Livestock Show. On September 10, 2018, the Junior Livestock Sale Committee advised the Weld County Fair Board that the 2018 Grand Champion Market Sheep had a positive drug residue test for dexamethasone. This positive drug residue test is in violation of Section E of the Combined Market Livestock Form, the relevant portion of which states as follows: SECTION E - Swine/Ruminant Packer Affidavit • ...We certify that all animals presented for slaughter have been handled in a manner to prevent a pharmaceutical or agricultural chemical residue violation. Label dosages, route of administration, and withdrawal times have been followed, and only approved FDA pharmaceutical compounds have been used for treatment.... In addition, the Combined Market Livestock Form, which was included with the Livestock Entry Form for market, showmanship and breeding classes, did not list any medications given to the market lamb under Section B of the Individual or Pen Animal Treatment Records. Weld County Fair General Rules, Disciplinary Action, Rule P, states as follows: Rule Violations: All Exhibitors agree to abide by The IAFE National Show Ring Code of Ethics. A requirement of acceptance of entries is The IAFE National Code of Show Ring Code of Ethics Form that has been signed by the Parents/Guardians and Exhibitors and are kept on file in the Fair Office. Disciplinary Action — All rules pertaining to the Weld County Fair and its activities are subject to interpretation and enforcement by the Weld County Fair Board, or its designated representatives. Violation of any rule, knowingly or unknowingly, may result in penalties up to, and including, exclusion of the exhibitor from competition and forfeiture of awards or expulsion from the show grounds for the person and/or exhibitor, or disqualification from participation in the Weld County Fair activities for such time as is determined by the Fair Board or its designated representatives.... (emphasis added.) 2018-3465 c)(31 E.x©o©3 Based upon the above -referenced rules, the Junior Livestock Sale Committee made the following recommendations and, after a lengthy discussion, the Fair Board voted to approve the following (1) The exhibitor must forfeit one-half of the sale price of $8,000 ($4,000) received for the purchase of the Grand Champion Market Lamb, and (2) The exhibitor is ineligible to exhibit sheep at the 2019 Weld County Fair In a letter dated September 24, 2018, the Sidwells were advised of the Junior Livestock Sale Committee's recommendation and the Weld County Fair Board's decision regaidmg the drug residue test violation In addition, the Sidwells were advised that they had the right to appeal this decision and could do so at the next regularly scheduled Weld County Fair Boaid meeting on Monday, October 1, 2018, at 7 00 p m , and they should contact Janet Konkel to secure a time slot on the Agenda On October 1, 2018, the Weld County Fair Boaid held its regular monthly meeting and again revisited its decision of Septembei 10, 2018, in an effort to afford the Sidwells the opportunity to be present for a discussion regarding drug residue test violation, however, the Sidwells did not attend After much consideration and discussion, the Weld County Fair Board voted to include this additional punishment The exhibitor must return the winning $1,000 Premier Exhibitor Contest cash award The Weld County Fair Board believes that this punishment is within its discretion based upon Weld County Fair General Rides, Disciplinary Action, Rule P, which states in relevant part as follows Disciplinary Action — All rules pertaining to the Weld County Fair and its activities are subject to interpretation and enforcement by the Weld County Fair Board, of its designated representatives Violation of any rule, knowingly or unknowingly, may iesult in penalties up to, and including, exclusion of the exhibitor from competition and forfeiture of awards or expulsion from the show grounds for the person and/or exhibitor, or disqualification from participation in the Weld County Fair activities for such time as is determined by the Fair Board or its designated representatives (emphasis added ) In a letter dated October 5, 2018, the Sidwells were advised of the Weld County Fair Board's decision of the additional penalty and again advised of their right to appeal within 10 calendar days of receiving the Weld County Fair Board's decision The Weld County Fair Board discussed this mattei at length and feels it administered a punishment fitting the violation It is imperative that the exhibitors of market animals understand how the use and timing of medications given to market animals might affect a carcass and be cognizant of how such an error would create a significant problem should the meat enter the food chain In addition, an issue such as this has the potential of causing slaughter houses to refuse to slaughter animals coming from the Weld County Fair because of the fear of drug residue test issues This is a significant error and not one to be treated lightly, and the Weld County Fair Board must act accordingly cerely, Kimberly Tr hang, Secreta Weld County Fair Board October 23, 2018 There are two sets of minutes in these documents. The September 10, 2018 minutes were approved at the October 1, 2018 Fair Board meeting. The October 1, 2018 minutes are on the agenda to be approved at the November 5, 2018 meeting. 10-19-18 RECEIVED OCT 192018 COMMISSIONERS Notice of appeal of a decision of the Weld County Fair Board, to the Board of County Commissioners. This letter is to provide notice of our appeal of the decisions made by the fair board at its September 10 and October 1 meetings. A small medication residue was found in the blood test that was taken the day of the show after Cal's lamb was named champion. The medication was from a treatment we provided him in accordance with a veterinarian prescription. (a copy was provided to the Fair Board) We failed to report the administration of the medication on the disclosure form, due to the chaos of preparing to participate in many fair competitions for the kids and volunteer fair activities on the part of mom and dad. However, it should be noted that the medication given was as prescribed, and did allow enough withdrawal time before the lamb would have potentially been harvested. We should have included the medication on the list due to the slight potential that it would show up as a trace amount on a show day blood test, but not because the lamb needed additional withdrawal time. We are sorry for the difficulties our inattention has caused. Our family is passionate about the value of 4H and youth livestock activities and hate that we had any part in making things run less than perfectly. We were told that it was determined we violated the third bullet of Section E of the Combined Market Livestock form. The "punishments" outlined to us, prevent Cal's participation in the 2019 sheep show at the Weld County Fair, the forfeiture of a portion of his sale proceeds ($4000) and prize money from the premier exhibitor contest ($1000). The issue of primary concern to us is Cal's being able to participate in the 2019 sheep show at the county fair. Cal is passionate about exhibiting livestock and participating in 4H activities. This component of the Fair Board's decision is the one we would most like to have re -considered. This is a direct punishment of a kid for an issue that is really more of a parent one. As well, we do not know what specific rule was violated within the premier exhibitor contest to cause forfeiture of that prize. The premier exhibitor contest is structured such that it awards the majority of its points to activities that the child competes in that are separate of the animal, with the direct intention of shifting the focus to the child rather than the animal. Cal's success in that contest had little, if nothing, to do with one particular lamb. Attached are copies of the two certified letters we received outlining the Fair Board's actions and our rights, and the date we signed for them from the post office. As you can see, we had little time to respond to the first letter and that letter did not indicate that our issue would be on the October, 1 agenda whether we were in attendance or not. We are fair and 4H volunteers ourselves and have respect for the time provided by the fair board. However, we feel we must help our child to participate in an activity he loves. All entries, including junior and open divisions, will require pre -entry on appropriate forms and are to be in the Extension Office no later than the published date Any entry submitted after the published late entry deadline MUST be accompanied by a check for $100 00 per entry - $500 00 maximum per exhibitor NO EXCEPTIONS B 1 Responsibility - The Fair Board will use due diligence to insure the safety of exhibits after their arrival and placement, but in no case will they be responsible for any loss or damage done to or arising from an animal or article on exhibition, and the exhibitors shall indemnify the fair management against all legal or other proceedings in regard thereto Every animal or exhibit shall be entered and exhibited in the name of the bonafide owner C Accidents - The Weld County Fair Board and Colorado State University Extension are not responsible for accidents D Eligibility - Exhibitors in the 4-H/FFA Divisions of this fair must be bonafide members of a Weld County 4-H Club or Weld County Agriculture Education program Members who are eight (8) years of age and have not reached their 19th birthday and 4-H Cloverbuds who are five (5) years of age and have not reached their 8th birthday prior to January 1 of the current calendar year will be eligible to compete Members must be enrolled in a project to be eligible to exhibit that project E Alcoholic Beverages, Marijuana and Other Controlled Substances and Vaping - Under no circumstances will alcoholic beverages, marijuana or other controlled substances or vaping be allowed on the Fairgrounds Please look at the fairgrounds map in the book Anyone failing to adhere to this rule will be subject to official action and puts at risk their eligibility to continue to participate in the Show F Parking - The Board reserves the right to enact and enforce such parking restrictions as may be required to provide access and egress for exhibitors and emergency equipment Vehicle owners and operators are advised if towing of any vehicle becomes necessary, all costs associated with towing, storage, or damage will be the responsibility of the owner/operator G Protests — Any protest in any division must be made in writing, be signed and presented to the superintendent in charge of the respective division The protest must be presented within 24 hours after the event occurred A $50 00 cash deposit must accompany all protests before the Board can initiate any action The $50 00 deposit is NON REFUNDABLE , ALL LIVESTOCK/HORSE PROTESTS MUST BE IN WRITING, SIGNED AND PRESENTED TO THE EXTENSION AGENT OR EXTENSION OFFICE IN ORDER TO BE CONSIDERED BY THE FAIR BOARD ALL PROTEST MUST BE ACCOMPANIED BY A NON-REFUNDABLE $50 00 FEE Protests cannot be submitted anonymously Livestock/Horse related protests — County Fair protests can occur from the time of animal nomination until September 30, 2018 Livestock/Horse protests during county fair - The division superintendent reserves the right to move any exhibit for special display I Cash Premiums - Cash premiums are paid on Sunday, July 30th from 1:00 pm to 6:00 pm at the Premium Window at the Fair Office. 1. All 4-H projects, excluding Cloverbuds, that are interview judged and which receive a blue or red ribbon. 2. All 4-H and FFA Livestock projects, if placing is warranted, will receive cash premiums. 3. Open Class exhibits as defined in departmental information. 4. Premiums may be claimed at the pay booth during published hours. Allow one day following departmental judging for processing. 5. Premiums, and/or cash awards, not claimed during the fair can be picked up in the Extension Office, during normal business hours of 8:00 am to 5:00 pm for 10 working days after the end of fair. 6. Premiums, and/or cash awards unclaimed as of 10 working days after the end of fair will be forfeited. 7. Premiums for exhibits removed before release will be forfeited. Awards will be presented as they are won, with the exception of Special Awards. These awards are presented during special awards ceremonies as listed in the fair schedule. J. Curfew - There will be no overnight sleeping in the barns. A barn curfew of 9:00 p.m. will be enforced. K. Additional Classes - Superintendents will be allowed to add or combine classes as needed at their discretion. L. Pets - Competitors and service animals only. No pets are allowed in the Fair buildings, except service animals. M. Sportsmanship/Conduct - Any flagrant display of poor sportsmanship or affront to a show official, by or on behalf of the exhibitor, may result in exclusion of the exhibitor from competition and forfeiture of awards or expulsion from the show grounds for the person and/or exhibitor. N. Miscellaneous - The use of scooters, skateboards, ro ex blades, bicyc es and other sim ar devices is proh.b.ted on the grounds during the Fair. The purpose of this rule is safety of participants and attendees of the Fair at the recommendation of the County Attorney. O. Re -issued Checks - A processing fee of $25.00 needs to be paid prior to re -issuing a check or will be deducted from the check before it will be reissued. The notice of appeal must specifically state what part of the decision the party seeks to have modified and the reasons therefore. The notice shall not exceed five (5) pages in length. Within five (5) calendar days of receiving the notice of appeal the Fair Board may submit a memorandum brief. Any such memorandum brief shall not exceed five (5) pages in length. WELD COUNTY FAIR BOARD MONTHLY MEETING MINU 1'ES October 1, 2018 Meeting called to order by President Aaron Helus at 7 04 p m Invocation, Pledge of Allegiance Members present Aaron Helus, Andy Raff, Bridget Holcomb, Christie Gabel, Jane Miller, Jennifer Seltzer, Jo Temmer, John Scanga, Kim Tregoning, Marlin Kunau, Mike Mitchell, Robby Adams, Pat Day, Tracy Axton, Ten Segelke Members absent Debbie Carpio, Gus Sidwell, Larry Wagner, Neil Temmer Weld County Commissioner(s) present Julie Cozad Extension Staff present Janet Konkel, Kin Sterkel, Larry Hooker, Jenn Eastwood Agenda No changes made Attendance Please be certain to check the monthly meeting minutes as you need to be certain that you are given credit for attending the Fair Board meetings Julie Cozad explained in detail the Commissioners' attendance policy for their boards and commission members A board member phoning into a meeting is not something that should be done as that attendance cannot be counted toward a quorum Julie Cozad will discuss Skype as a method of attendance and get back to Janet If you encounter difficulties in attending meetings and think that you will miss multiple meetings, please let the Commissioners and the Fair Office know so that your situation is understood and, if necessary, arrangements can be made An attendance record for all Fair Board Members listing all absences through September 10, 2018, was disseminated to all Fair Board Members and Julie Cozad Previous Meeting Minutes Motion to accept the September 10, 2018 meeting minutes with changes as indicated, was made by Mike Mitchell, seconded by Robby Adams A vote was held, all approved, and the motion carried Treasurer's Report Treasurer Tracy Axton reported the following bank balances Fair Board $ 80,560 78 100th Year Celebration $ 6,69918 Total $ 87,259 96 A Profit & Loss Statement was prepared for September 2018 Mike Mitchell asked that next month a Balance Sheet be included for the Fair Board's review - Royalty Report 2018 Princess Molly Koslosky appeared and gave the Royalty report The Royalty did not appear at any functions this month The Royalty will attend Recognition Night on November 2, 2018 There are no new sponsors to report Special Guests Dakota Kos, Alan Halley and Cody LeBlanc applicants who have been appointed to the Weld County Fair Board Fair Board Applications Cody Leblanc appeared and introduced himself to the Fair Board Cody has already had his interview with the Weld County Commissioners, Julie Cozad advised that she has known Cody for many years, he is a hard worker and Cody was appointed Cody has an interest in participating in the following committees Grounds Entertainment, Promotions, Sponsorship, Vendors, Car Show and Garden Tractor Pull, Premier Exhibitor, Royalty, All-around Showmanship, and several others Alan Haley appeared and introduced himself to the Fair Board Alan also had his interview with the Weld County Commissioners and was appointed to the Fair Board For the past four years, Alan has been involved as a part of the Sale Committee and is interested in being more involved in 4-H A motion to accept Cody LeBlanc and Alan Halley as member of the Weld County Fair Board was made by Teri Segelke, seconded by Andy Ruff A vote was held, all approved and the motion carried All Fair Board Members whose appointments are up and are eligible for an additional three years have been re -appointed to the Weld County Fair Board by the Commissioners Julie Cozad advised that when a board member resigns, the Commissioner will send a letter and certificate of service thanking them for their participation and hard work Weld County Fair Board Meeting Minutes October 10, 2018 Page 2 Junior Livestock Sale Committee Issue A certified letter, return receipt requested, as well as an email, was sent to the 4-H participant and his parents advising that the Fair Board was going to revisit the September 10, 2018 decision at the October 1, 2018 Fair Board meeting The County Attorney advised the Fair Board that the 4-H participant and his parents should to be invited to the October 1, 2018 meeting in order to give them the opportunity to explain the situation regarding the test results for the market lamb The Fair Board has the option of upholding the September 10, 2018 vote, amending the vote, or rescinding the vote Since the September meeting, John Scanga formulated additional questions which he would like discuss and they are as follows (1) Since the Weld County Fair is a member of the IAFE does this incident need to be reported to that organization? (2) Should the 4-H participant's Premier Exhibitor Award be taken from him? (3) Does the Fair Board need to provide this information to other shows, then let those shows make their decisions as to how to proceed? Extension Agent Larry Hooker stated that he thought this was a county fair decision, as the participant is in good standing with 4-H at this time There was a lengthy discussion on whether or not this incident should be reported under the IAFE's National Show Ring Code of Ethics Janet Konkel explained that the IAFE's Code of Ethics as published in the 2018 Weld County Fair Book is a guideline and not a requirement If this incident is reported to IAFE, the 4-H participant would be prohibited from showing in any 2019 IAFE sanctioned events John Scanga advised that he has received numerous calls from individuals stating that the Fair Board did not do enough to punish the 4-H participant John Scanga made a motion to amend the Weld County Fair Board's September 10, 2018 decision accepting the recommendation of the Junior Livestock Sale Committee by withholding 50% of the sale price, which is $4,000, from the sale of the 4-H participant's market lamb (which will stay in the coffers of the Junior Livestock Sale Committee) and the 4-H participant will not be allowed to show market lambs at the 2019 Fair but will be allowed to show other animals As an addition to its September 10, 2018 decision, the Weld County Fair Board intends to notify IAFE of its findings and punishment, and rescind the 4-H participant's 2018 Premier Exhibitor Award winnings, seconded by Andy Raff A vote was held and the motion passes with 10 "yes" votes, 5 "no" votes A letter to the 4-H participant and his parents advising of the Fair Board's amendment of the September 10, 2018 decision will be sent by the Fair Board's President, Aaron Helus The letter will advise the 4-H participant and his parents of their right to appeal the decision to the Weld County Commissioners For additional information as to the process, they should contact Janet Konkel, Fair Board Coordinator Pat Day asked if the Weld County Food Bank, the buyers, or the plant had been notified of the carcass issue The vet in this instance did not have the authority to release the carcass The authorization to release should have come from the Fair Board Janet Konkel advised that members of the Fair Board should not make any statements to anyone regarding this issue Any information to be released should come from the Weld County Communications Coordinator There was a lengthy discussion on issues regarding circumvention of the Weld County Fair's vet check piocedures Several members of the Fail Board would like to see contracts executed between veterinarians working at the Fair and for the Fair Board John Scanga made a motion to revoke certain veterinarian privileges for the Weld County Fair, seconded by Pat Day Upon further discussion, John Scanga rescinded the motion, Pat Day seconded No action to revoke privileges will be taken, and a private conversation with the veterinarian will take place John Scanga made a motion to formalize relationships by contract with any veterinarian and/or veterinarian practice that has been given privileges by the Weld County Fair Board to conduct vet checks and drug tests during the Fair, with the contract including a scope of services, seconded by Christie Gable A vote was held and the motion passes The Weld County Attorney will be asked to draft a contract The Weld County Fair Board Bylaws will be changed to reflect those of Weld County Charter All Fair Board Members who were up for re -appointment of their terms re -applied and were re -appointed by the Weld County Commissioners Weld County Fair Board Meeting Minutes October 10, 2018 Page 3 Jody Corhss submitted her letter of consideration for re -appointment of the Royalty Committee The Fair Board accepted Mrs Corhss' letter A motion to re -appoint Jodi Corhss to the Weld County Royalty Committee was made by Christie Gabel, seconded by Jennifer Seltzer A vote was held and all approved The motion passed 4-H Participant Record Books Larry Hooker reported that the record books were due back from the judges on September 28, 2018 Of the participants that showed at Fair, 14 of them did not turn in their record books or the FFA record book form Of those 14 members, three aged out which leaves 11 participant, and Janet Konkel will send letters to those participants Of the record books that were graded, five participants scored below 70% and of those five, one aged out The four participants will be required to take Larry Hooker's record book training which will take place in November One of those participants is an FFA participant who also scored below 70% last year Election of Fair Board Officers President Jane Miller, John Scanga and Tracy Axton were nominated, and the floor was opened for other nominations At that time, John Scanga declined the nomination and no others were nominated A motion to close the nominations was made by John Scanga, seconded by Christi Gabel All voted to close the nominations Paper ballots were distributed to the Fair Board members and votes were cast Tracy Axton was voted as President for 2019 Vice President Andrew Raff, Jane Miller, and Neil Temmer were nominated, and the floor was opened for other nominations Tracy Axton were distributed to all Fair Board members and votes were cast Vote 1 tally did not have a majority vote, therefore, candidates were asked to voluntarily withdraw and Jane Miller, Neil Temmer, and Ten Segelke withdrew their names from consideration Paper ballots were distributed to the Fair Board members and a second vote was cast Andrew Raff was voted as Vice -President for 2019 Secretary Christie Facebook accounts and how Weld County views them In order for it to become a sanctioned Weld County Facebook account it must go through the Public Information Officer Weld County Facebook accounts only allow for Jennifer Finch to post on it — no one else The Weld County Fair Facebook account is not a sanctioned Weld County account If the Fair is going to continue to use its Facebook account it needs to have certain disclosures on its homepage There should be a more detailed discussion on this COORDINATOR'S UPDATE Daisy Boulter, Quilt Co -Superintendent, donated the 100 -year quilt she designed to the Fair Board for display Please sign the thank you card The quilt is beautiful and the Fair Board is quite thankful to have it given to it by Mrs Boulter Ten Sidwell's brother died several donations from the oil and gas industry each year Members of the Fair Board have been invited to a lunch meeting held by the oil companies to address Proposition 112, which will be on the support, please see Janet Konkel for details Janet Konkel was invited and attended the Weld County Livestock Association ("WCLA") meeting The WCLA was upset that it was required to do its $500 scholarship presentation prior the Junior Livestock Sale, as sale attendees had not yet made their way to their seats and they felt the presentation did not get the recognition it deserved Janet thought it might be a better idea for WCLA to make its presentation at the Awards Dinner at the Weld County Fair instead and will take this idea to the sale committee for their input A meeting has been scheduled with Ron's Equipment to discuss utili>ing some of its equipment during Fair Marlin Kunau was asked if he'd like to join the meeting on October 3, 2018 Janet Konkel advised the Fair Board that she would be retiring as Weld County Fair Coordinator effective January 21, 2019 Although she will miss working on the Fair and with the Fair Board, she is excited about spending more time with her grandkids and family Janet has informed the Commissioners and a new coordinator hiring search will begin shortly The Fair Board will greatly miss her guidance and hard work on behalf of the participated in the Keenesburg Southeast Fair Parade, the Platteville Harvest Days Parade, and the Windsor Days Harvest Parade In September the Royalty members will participate in the Evans Days Parade and help at CSU's Ag Day There are no new sponsors to report Special Guests Dakota Kos and Mary Ann Cothren, applicants for the Weld County Fair Board Fair Board Applications The Fair Board has four seats to fill on the Weld County Fair Board There were two resignations and there are two Board Members whose terms are expiring To date, three Board of Director Applications have been received to fill those vacant seats The applications that were received are from Dakota Kos, Mary Ann Cothren, and Alan Halley Dakota Kos has an interest in working with the Royalty Committee, as well as other committees of the Fair Board, and has participated as a 4-H member in the past Alan Halley is a current member of the Jr Livestock Sale Committee and has an interest in helping with the Junior Livestock and Animal Health Committee, the Junior Livestock Sale Committee, and All -Around Showmanship Mr Halley has also participated in 4-H and FFA programs in the past and currently has kids in 4-H Mary Ann Cothren is interested m helping with the Catch -It Contest and Project Inspection Ms Cothren has been a past member of the Weld County Fair Board, as well as an instructor with the dog project Ms Cothren is presently an active donor of lambs for the Catch -It Contest Ms Cothren also advised that if she were chosen to participate with the Weld County Fair Board that her husband would also be available to help A motion to send two of the three Board of Directors Applications to the Weld County Commissioners for interviews and possible appointment was made by Andy Raff, seconded by Robby Adams A vote was held, all approved and the motion carried Weld County Fair Board Meeting Minutes September 10, 2018 Page 2 Bylaws —Absences Guidelines/Board Member Terms The requirements and the language of the Weld County Fair Board Applicant Guidelines need to be modified to comply with the language found in the Home Rule Charter for the County of Weld, Colorado as follows Sec 2-1-100 — Board and commission appointments 6 No member of an appointive board, agency or commission shall be absent for more than one-third ('/3) of the meetings of the board, agency or commission during any consecutive three (3) month period The Fair Board has been operating under an excused/unexcused method of tracking absences, with three unexcused absences in one calendar year causing replacement of a board member This is contrary to what Weld County Commissioners require of its boards and commission members There was much discussion on this issue and the Board formalized questions that required clarification from the Weld County Attorney prior to voting on a change A Motion to table the vote until the Weld County Attorney answers the Fan Board's questions was made by Mike Mitchell, seconded by John Scanga A vote was held, all approved, and the motion carried The Fair Board also determined that a paragraph needs to be included in the applicant guidelines stating that each member can serve two consecutive terms At the end of the second consecutive term, the member must take a year off the Fair Board but may re -apply after that year A Motion to change the Weld County Fair Board Applicant Guidelines was made by Mike Mitchell stating that each member may serve two consecutive terms At the end of that Fair Board Member's second consecutive term, the Board Member must take a year off the Fair Board but may re -apply after that year if interested The motion was seconded by Tracy Axton, a vote was held, all approved and the motion carried Weld County Royalty Committee There have been some issues regarding the Royalty Committee (the Committee) not following or complying with the Fair Board's purchasing processes On April 6, 2018, a meeting was held between the Committee, Janet Konkel, Kim Tregoning, Tracy Axton and Ten Segelke asking that the Committee obtain approval prior to purchasing any items for the Royalty members In addition, the Committee was advised that it needed to have those purchased items delivered to the Fair Office and that Janet would call to let them know when the items arrived and were ready for pickup Due to the Fair Board allocating $3,500 in operating funds to the Committee, it is appropriate that the Fair Board receives a detailed listing of items to be purchased by the Committee, as well as the Committee obtaining prior permission from the Fair Office to spend those funds Repayment of funds for items purchase by the Committee is done in a timely manner by the Fair Office and Weld County The Committee wanted to know if the Fair Board would provide a credit card for its use The Fair Board had a lengthy discussion on how best handle the various issues that had been reported Each year committee members are chosen or re -appointed from interested individuals who have submitted letters of consideration From those letters, the Fair Board is able to appoint those it would like to see on its committees If there are not enough interested parties to appoint from the letters of consideration, members of the Fair Board can step up to help keep the programs moving forward Should members of a current committee wish to be re -appointed for the next year, they must submit a letter of consideration or they will not be considered for re -appointment The Fair Board is not required to appoint current members of a committee if it feels it is not m the best interest of the program The Fair Board is adamant that its committees comply with its approval and purchasing procedures, and there will be no credit cards given to any committee or its members A Motion was made by Neil Temmer to remove current committee members, continue the Royalty program, and appoint additional volunteers to run the program, seconded by John Scanga A vote was held, motion does not pass The matter will be handled by the normal appointment of committee members for 2019 Junior Livestock Sale Committee Issue (Gus Sidwell recused himself from this discussion and vote ) The 2018 Grand Champion Market Lamb tested positive for dexamethasone after the Junior Livestock Sale (Dexamethasone is a glucocorticosteroid commonly used to treat respiratory issues ) The 4-H participant did not hesitate to admit to the use of the substance and stated that he did have a prescription for the medication for the lamb, however, the use of that medication was not declared on the Combined Market Livestock Form prior to showing the lamb at Fair Reportedly, his vet stated there was a five-day withdrawal period and the meds were given on the Sunday prior to the start of Fair Blood specimens were drawn and sent for testing, the lamb was butchered, and the carcass was held for three weeks awaiting test results The lab was slow in returning test results, and due to the length of time the carcass had been held the superintendent went ahead and released the carcass When the test results were returned they revealed a small amount of dexamethasone in the blood sample Weld County Fair Board Meeting Minutes September 10, 2018 Page 3 The Junior Livestock Sale Committee's recommendation in handling this issue is to withhold 50% of the sale price, which is $4,000, from the 4-H participant, and the 4-H participant will be ineligible to show market lambs at the 2019 Fair, however, he will be allowed to show other animals The Junior Livestock Sale Committee is seeking approval from the Fair Board on its recommendation After a lengthy discussion by the Fair Board, a Motion was made by Mike Mitchell to accept the recommendation of LIVESTOCK SALE 1. Selling in the Junior Livestock Sale is a privilege. Any violations of these rules will eliminate the exhibitor from the sale for a minimum of one (1) year. 2. All animals must be shown in a market class at the Weld County Fair. 3. The Junior Livestock Sale will be composed of 245 lots. Species will be represented as a percentage of the animals nominated by species as a percentage of the 245 lots. 4. The sale order, within a species, will be determined by percentile ranking in each class. The sale committee reserves the right to make any changes in the sale order. 5. Sale nomination cards must be submitted to the Weld County Junior Livestock Sale Committee nomination table (located outside of the fair office) within 1 -hour following the selection of the Grand Champion market animal of the species. • Only one sale nomination card may be turned in per exhibitor, including multi -species exhibitors. • Multi -species exhibitors will be permitted to exchange their previously submitted sale animal nomination card with a different species animal during 1 -hour nomination period for the species they are substituting with. - The replacement nomination card must be marked "substitution" at time of submission. - The originally submitted sale nomination card will be removed. • No sale nomination cards will be accepted following the 1 -hour nomination period for that species. 6. Each nominated sale animal must be sound, healthy and market ready as determined by the superintendents and/or Fair Veterinarian. All required health forms must be submitted as stated in the entry rules. 7. Buyers' photos will be taken of the exhibitor and animal during or after the show or sale. 8. Buyer pictures will be available to pick up at the Extension Office two weeks after the sale. 9. Junior Livestock Sale participants must complete the following no later than the Friday after Labor Day: • Deliver or mail thank you letter and sale picture to their buyer. • Deliver or mail add-on thank you letters. • Deliver copies of all thank you letters (buyer and add-ons) to the Extension Office. Sellers who do not complete the above by the Friday after Labor Day will be considered ineligible to sell in the next year's Junior Livestock Sale as indicated in Rule #1 above. If a seller finds themselves in this situation they can bring their thank you letters and a check in the amount of $100.00 made out to the Junior Livestock Sale Committee to the Extension Office by September 30th. The payment of this fine will release their sale check and preserve eligibility for the next year's Junior Livestock Sale. 10. Sale checks will be mailed to sellers from the Weld County Fair Junior Livestock Sale when sufficient funds have been collected • A processing fee of $25.00 needs to be paid prior to re -issuing a check or will be deducted from the check before it will be reissued. 11, All Grand and Reserve Grand Champion's must sell unless the exhibitor is ineligible due to rules violation. 12. Consignors will be charged 3 percent of the gross selling price including add on monies, the cost of one buyer's picture and related postage and any specie specific expenses. A portion of the commission will be designated for awards programs to be determined. Examples include but are not limited to: carcass contest, record books and/or scholarship programs. If a Catch -it animal is sold through the Junior Livestock Sale, the consigner will be charged an additional 10% of gross selling price including add on monies to promote the Catch -it program. 13. Any non -sale animals being shipped by the Junior Livestock Sale Committee will be charged 3% of the gross and any specie specific expenses. 14. The Sale Committee reserves the right to randomly test for anti-inflammatory, diuretics, antibiotics, steroids, tranquilizers, and any other foreign or banned substances via urine/blood/tissue testing, immediately following the Champion selection in each of the species. The payment for any animals selected for residue testing will be delayed until the residue test results are received. Residue tests must be negative for payment to be made. Further testing will be at the expense of the exhibitor. 15. Any carcass loss due to condemnation will be seller's expense. 16. Exhibitors must be present for the sale and have animals clean and groomed to sell. 17. Consignors are responsible for feeding and watering their animals until they are loaded for shipment. 18. Beef exhibitors are responsible for loading their animals on the morning following the sale. Time to be announced. 19. When an animal is sold through the sale, it shall change ownership at that time, with shipping provided, or approved by the Junior Livestock Sale Committee. 20. All animals selling in the Junior Livestock Sale are terminal and must be harvested immediately after the sale. Purchasers will sign an agreement to harvest the animals at the time of purchase. 21. There will be no resale of animals other than to the packer. 22.
