WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
Health and Safety Education and Consultation for Child Care Provider Homes between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Department of Human Services, and the Department of Public Health
and Environment, commencing April 1, 2018, and ending March 31, 2021, with further terms and
conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for Health and Safety Education and
Consultation for Child Care Provider Homes between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Human Services, and the Department of Public Health and Environment, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.

Please review and indicate if you would like a work session prior to placing this item on the Board's agenda.
Request Board Approval of the Department's Memorandum of Understanding for Health and Safety
Education and Consultation. The Department is requesting a Memorandum of Understanding with the Weld
County Department of Public Health and Environment to provide health and safety education and consultation
to in -home child care providers. The goal is to enhance recruitment initiatives and strategies resulting in an
increase in the number and quality of child care providers in the County. This service will support in -home
child care providers, implement quality measures, regardless of licensure status, and increase the number of
quality in -home child care providers who will accept CCCAP. The agreement is for a three-year period,
renewable automatically unless terminated by notice of one of the parties. The first annual term will
commence on April 1, 2018, and end on June 30, 2019. The maximum dollar amount for these services is
$155,370.00 for the first year.
This agreement was discussed with the BOCC during a work session on February 13, 2018 where initial
approval was received.
I do not recommend a Work Session. I recommend approval of this Memorandum of Understanding.

MEMORANDUM OF UNDERSTANDING
BETWEEN
WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND
ENVIRONMENT
AND
WELD COUNTY DEPARTMENT OF HUMAN SERVICES
This Agreement is made and entered into between Weld County Department of Public Health
and Environment, hereinafter referred to as "WCDPHE and Weld County Department of Human
Services, hereinafter referred to as "WCDHS".
Whereas, WCDHS desires to obtain the services set forth in this memorandum and
incorporated exhibits, and
Whereas, WCDPHE has the ability, qualifications and time available to timely perform
these services,
NOW THEREFORE, in consideration of the mutual promises set forth herein, the parties hereto
agree as follows:
I. Introduction. The terms of this Agreement are contained in the terms recited in this document and in
Exhibits A, B and C which form an integral part of this Agreement. Exhibits A, B and C are specifically
incorporated herein by this reference.
2. Service or Work. WCDPHE agrees to procure the materials. equipment and, or products necessary for the
Project and agrees to diligently provide all services, labor, personnel and materials necessary to perform and
complete the Project described in Exhibits A. B and C.
3. Term. The initial term of this Agreement shall be effective on \pril 1, 2018 and shall expire on March 31,
2021. This agreement shall be automatically renewed annually by the parties, unless one of the parties notifies
the other in writing prior to thirty days before the end of the contract year. It may not be renewed beyond March
31, 2021.
4. Termination. This agreement may be terminated without cause by either WCDPHE or
WCDHS upon 30 days written advance notice.
5. Extension or Modification. Any amendments or modifications to this agreement shall be in writing signed
by both parties. No additional services or work performed by WCDPHE shall be the basis for additional
compensation unless and until WCDPHE has obtained written authorization and acknowledgement by County
for such additional services.
6. Compensation/Contract Amount. Funds for this contract shall be obtained by County from Temporary Aid
to Needy Families (TANF) and other funding sources. County shall pay WCDPHE no more than one hundred
fifty-two thousand, six hundred eighty-nine dollars ($I 52.689.00) for the initial fifteen -month period. from
April 1. 2018 through June 30. 2019, as set forth in Exhibit B. Project Budget, Subsequent year budgets will be
submitted through the amendment process. County agrees to pay WCDPHE through an invoice process during
the course of the contract in accordance with the Scope of Work as described in Exhibit A. WCDPHE agree to
submit invoices which detail the work completed by VvCDPEIE. The County will review each invoice and if it
agrees WCDPHE has completed the invoiced items to the County's satisfaction_ it will remit payment to
WCDP IE,

7. Ownership. All work and information obtained by WCDPHE under this Agreement or individual work
order shall remain (as applicable), the property of County.
8. Warranty. WCDPHE warrants that the service performed under this Agreement will be performed in a
manner consistent with the standards governing such services and the provisions of this Agreement. WCDPHE
further represents and warrants that all services shall be performed by qualified personnel in a professional and
workmanlike manner, consistent with industry standards. and that all services will conform to applicable
specifications.
9. Liability Coverage. WCDHS and WCDPHE shall exchange evidence of insurance showing
general liability coverage in the minimum amount of the Colorado Governmental Immunity Act for
protection from claims for bodily injury, death, property damage, or personal injury which may arise
through the execution of this agreement. Such evidence shall be approved by each recipient prior to
commencement of this agreement.
10. Immunity. Nothing in the Agreement shall be construed (i) as a waiver by either party of
immunity provided by common law or by statute, specifically including the Colorado Governmental
Immunity Act, Section 24-10-101. et.seq. C.R.S., as it may be amended from time to time; (ii) as
creating an assumption of any duty or obligation with respect to any third party where no such duty
previously existed; or (iii) as creating any rights enforceable by such third parties.
11. Acceptance of Services Not a Waiver. In no event shall any action by County hereunder constitute or be
construed to be a waiver by County of any breach of this Agreement or default which may then exist on the part
of WCDPHE. Acceptance by the County of or payment for, the services completed under this Agreement shall
not be construed as a waiver of any of the County ' s right s under this Agreement or under the law generally.
12. Non -Assignment. WCDPHE may not assign or transfer this Agreement or an interest therein or claim
thereunder, without the prior written approval of County.
13. Interruptions. Neither party to this Agreement shall be liable to the other for delays in delivery or failure
to deliver or otherwise to perform any obligation under this Agreement. where such failure is due to any cause
beyond its reasonable control. including but not limited to Acts ofGod. tires. strikes war. flood. earthquake s
or Governmental actions.
14. Non -Exclusive Agreement. This Agreement is nonexclusive and County may engage or use other
contractors or persons to perform services of the same or similar nature.
15. Termination. This agreement may be terminated without cause by either WCHPHE or
WCDHS upon 30 days written advance notice.
16. Entire Agreement/Modifications. This Agreement. including the Exhibits attached hereto and
incorp,1rated herein. contains the entire agreement between the parties with respect to the subject matter
contained in this Agreement. This instrument supersede, all prior negotiations. representations. and
understandings or agreements with respect to the subject matter contained in this Agreement. This Agreement
may be changed or supplemented only by a written instrument signed by both parties.
17. Fund Availability. Financial obligations of the County payable after the current fiscal year are contingent
upon funds for that purpose being appropriated, budgeted and otherwise made available. Execution of this
Agreement by County does not create an obligation on the part 01 -County to expend funds not otherwise
appropriated in each succeeding year.
18. Employee Financial Interest/Conflict of Interest - C.R.S. §§24-18-201 et seq. and §24-50-507. The
signatories to this Agreement state that to their knowledge, no employee of Weld County has any personal or
beneficial interest whatsoever in the service or property which is the subject matter of this Agreement.
19. Severability. If any term or condition of this Agreement shall be held to be invalid, illegal. or
unenforceable by a court of competent jurisdiction. this Agreement shall be construed and enforced without
such provision, to the extent that this Agreement is then capable of execution within the original intent of the
parties.
20. Third Party Beneficiaries. It is expressly understood and agreed that the enforcement of the
terms and conditions of this agreement, and all rights of action relating to such enforcement, shall
be strictly reserved to the undersigned parties and nothing in this agreement shall give or allow any
claim or right of action whatsoever by any other person not included in this agreement. It is the
express intention of the undersigned parties that any entity other than the undersigned parties
receiving services or benefits under this agreement shall be an incidental beneficiary only.
21. Confidentiality. All parties to this agreement shall comply with all federal, state and
county laws and regulations governing confidentiality, subject only to statutory exceptions
applicable to criminal investigations and proceedings.
22. Amendment. Any amendment of this agreement may be made only by written agreement
and signed by all parties hereto.
23. Board of County Commissioners of Weld County Approval. This Agreement shall not be valid until it
has been approved by the Board of County Commissioners of Weld County. Colorado or its de signee.
24. Choice of Law'Jurisdiction. Colorado law. and rules and regulations established pursuant thereto. shall be
applied in the interpretation. execution. and enforcement of this Agreement. Any provision included or
incorporated herein by reference which conflicts with said laws, rules and"or regulations shall be null and void.
In the event of a legal dispute between the parties. the Weld County District Court shall have exclusive
jurisdiction to resolve said dispute.

HEALTH & SAFETY EDUCATION and CONSULTATION FOR CHILD CARE PROVIDER HOMES
Collaboration between Weld County Department of Human Services and Weld County
Department of Public Health & Environment
SCOPE OF SERVICES
Human Services, in conjunction with the Health Department, will work to provide support to
prospective, new, and existing Weld County child care home providers through health and safety
assessment, consultation, and education. Human Services may approve additional homes to be
assessed to support numerous programs and individuals to include but not limited to TANF,
Foster Care and Kinship.
1. General Description of Services
A. The Weld County Department of Public Health and Environment (WCDPHE),
referred to as the Consultant, and the Weld County Department of Human
Services (WCDHS), in partnership with United Way of Weld County and North
Range Behavioral Health, will collaboratively develop and implement quality
services and supports through:
1) A team -based approach to support the needs of child care home
providers.
2) Providing health and safety assessment, education, and consultation to
child care home providers.
2. Expected Outcome
Anticipated outcomes of the collaboration will include:
A. An increase in the quality of child care and safety of environment in home
child care provider settings.
B. An increase in the number of child care home providers, due to provider
knowledge and use of recommended supports.
c. Having adequate child care home providers will allow DHS clients to maintain or
obtain needed education and employment to be self-sufficient.
D. Children in provider homes will be better prepared for pre-school or kindergarten
and be more successful in a traditional school setting.
3. Planning Period
A. During the first 120 days of the contract, there will be a planning period for the
Consultant (WCDPHE) and Human Services to work together to identify specific
deliverables, quantitative and qualitative outcomes, and assessment tools used to
measure the success of this agreement.
B. The WCDPHE and Human Services staff will meet monthly, at minimum, during the
planning period and provide regular updates to the Department of Human Services
Director and the Director of the Weld County Department of Public Health and
Environment on progress, identified objectives and deliverable methods of
measurement.
C. At the completion of the planning period, a report will be completed by consultant and
Human Services Child Care staff, detailing the specific deliverables, quantitative and
qualitative outcomes, and assessment tools to be used to measure the success of the
project. The report will be ready to present by July 31, 2018.
D. The mutually agreed upon results and deliverables of the planning period will be
incorporated in the scope of services (Exhibit A), through written concurrence of the
Director of the Weld County Department of Human Services and the Director of the
Weld County Department of Public Health and Environment. If mutually agreed upon
results and deliverables are not able to be reached, one of the following options may be
implemented.
I. Agree, in writing, to extend the planning period for a mutually agreed upon
timeframe, not to exceed an additional 60 days.
ii. Terminate the agreement using the terms and conditions outlined in the
agreement.
Adjust the scope of services and agreement through a written amendment to
the original agreement, following the terms and conditions of the agreement
and executed by both parties.
Role of Human Services
The Realizing Economic Advancement through Caring Homes (REACH) Team of
Employment Services of Weld County Division under the Department of Human Services
will provide overall guidance and direction to the family home care health/safety
consultant. The REACH Team will provide the liaison function between providers and
community partners and the Health Department consultant. To this end, ESWC will:
A. Provide financial support, utilizing Child Care, TANF or other appropriate and
available funds for this initiative.
B. Conduct background checks on potential providers, prior to making referrals to
Consultant;
c. Provide referrals to consultant, to complete thorough health
and safety assessment, consultation, and education.
D. Collaborate with WCDPHE, in developing, providing, and participating in trainings.
E. Collaborate and identify solutions with consultant to assist in resolving
the concerns and needs of potential providers.
F. Collaborate with WCDPHE to create a means of tracking
assessment results, such as a database or other acceptable method.
G. Collaborate with WCDPHE, the community, and the other members of
the team to provide education, health and safety training, presentations, seminars,
etc. in order to support the "Expected Outcomes" listed above.
H. Meet with WCDPHE on an ongoing basis or as needed to ensure
Contractual Obligations are met, improve communication, and strengthen the
intent of this Agreement.
Role of Weld County Department of Public Health and Environment
Hire, house, and supervise the health and safety home care provider consultant.
See job description (Exhibit C).
J. In collaboration with Human Services, provide training for the consultant.
K. Assure that the assessments (inspections) requested by WCDHS, through their
recruitment process, are completed. It is understood that the assessments are to
be undertaken solely for family child care providers whose initial goal is to function
as an unlicensed provider. Additionally, assessments (inspections) may be
approved for existing providers, program participants and or kinship families as
determined necessary by WCDHS.
L. Assure that the consultant participates as a member of the REACH Team, in order
to resolve the concerns and needs of potential providers.
nn. Collaborate with DHS, the community, and the other members of the team to
provide education, health and safety training, presentations, seminars, etc., in
order to support the "Expected Outcomes" listed above.
N. In collaboration with WCDHS, create a means of tracking assessment results, such
as a database or other acceptable method.

DESCRIPTION: Provide health and safety education and consultation to prospective,
new and existing Weld County Child Care Home Providers. Complete
initial and follow-up health and safety checks for Child Care Home
Providers following State rules and regulations. Recommend solutions for
the child care provider and Weld County Department of Human Services
(WCDHS) to mitigate health and safety issues in the home. Make
appropriate referrals to community resources and partners, to
strengthen the health and safety of a child care home and to improve
the quality of child care.
ESSENTIAL DUTIES To perform this job successfully, an individual must be able to

Conduct health and safety reviews in accordance with the General Rules

the Weld County Department of Public Health and Environment
(WCDPHE). Provide WCDHS, WCDPHE, and the child care home provider
with a report of observations and recommendations for improvements.
Schedule follow-up home visits to ensure observations and
recommendations have been implemented.
Conduct all home visits regarding health and safety requirements prior
to the Colorado Department of Human Services (CDHS) formal
inspection toimprove the ability of child care home provider to comply
with State rules and regulations.

Provide referrals to community resources to strengthen the health and
safety of a home and improve the quality of child care in the home.
Provide an annual trend analysis of all child care home provider health
and safety pre -operational inquiries, observations and findings.
Create health and safety trainings for potential, new and existing child
care home providers and for community awareness.
Collaborate with the Child Care Provider Recruitment Team by updating
the team on the status of prospective and new provider status, issues
and concerns. Contribute ideas and strategies regarding the recruitment
campaign to increase number of home providers. Participate with the
team to develop solutions for child care provider needs and concerns
with the goal of developing a healthy family.
Maintain current licenses and/or certifications, as applicable. Update
program information and protocol by attending continuing education
courses related to program responsibilities. Keep up-to-date technically
and apply new knowledge to the job.
Complete position -specific training for public health emergency response
activities.
Acquire and retain knowledge of policies, procedures, and Colorado
Department of Public Health and Environment (CDPHE) regulations
related to various Health Department programs.
Work the scheduled hours each day/week established for this position
and be available as -needed outside of normal operating hours to assist
with response to public health emergencies or community outreach
events.
Commute and work from all Health Department locations including
Greeley and Southwest Weld offices or other locations as needed.
Maintain sensitive and confidential records information. Follow the Weld
County Code of Conduct and adhere to strict confidentiality guidelines,
including HIPAA, and the appropriate non -disclosure and/or release of
information.
Enter data into several different computer programs; learn and apply
new computer skills on a regular basis; have a strong working
knowledge of computer programs used on a daily basis such as
electronic health records, program specific software applications,
Microsoft Windows, Word, PowerPoint, Excel, and Outlook, database
user interface and query software (client databases), and web browser
software.
Maintain professional conduct and adhere to the Public Health Code of
Ethics.
Comply with federal, state, and local regulations and employer policies
and procedures.

• Must have a valid Colorado Driver's License and Liability Insurance.
Must provide own transportation and be willing to travel throughout
