objection to Discovery DJ Services, LLC's ("Discovery") application for use by special review (USR), case number USR18-0075 The Sanctuary contends the USR application must be denied for the reasons below A The Planning Commission's analysis of the USR application violates several sections of the Weld County Municipal Code B The proposed USR and the current path of the pipeline poses a danger to the occupants of the home on the Sanctuary property C The proposed USR and Discovery's unwillingness to negotiate with the Sanctuary interferes with the land use D The Planning Commission, in making their recommendation, did not evaluate the safety record of Discovery and its parent companies KKR& Co and Williams Companies If the application is not denied,the Commission should impose the conditions outlined below upon the permit to require Discovery engage in negotiations with the Sanctuary for alternative pipeline routes Background The Sanctuary is a Colorado nonprofit corporation that was established in 1980 It owns approximately 800 acres in Weld County for the purpose of rescuing large endangered and exotic carnivores held in captivity The Sanctuary is responsible for the care of over 450 large animals and is the largest sanctuary of its kind, providing large acreage habitats for the rescued creatures The Sanctuary acquired the property in question on January 31,2018 from the William Artie Rowe and Carol Ann Rowe Joint Living Trust("the Trust") The purpose of the acquisition was to expand the Sanctuary, providing more space for the rescued animals and housing for employees of the Sanctuary 1 The Right of Way Agreement on the property was negotiated between the previous property owner, the Trust, and Discovery While the Sanctuary was aware of the Right of Way Agreement negotiations, the Sanctuary was not aware a valid agreement had been finalized between the parties In addition, the Sanctuary is concerned about the accuracy of the Memorandum of Right of Way Agreement, as the Memorandum was signed December 19th, 2017 However, the attached Exhibit A to that Memorandum was dated January 17, 2018 The Sanctuary is not wholly opposed to oil and gas development on the property There are two pipelines constructed on its property, which were built after proper negotiations to find the best route for both parties The Sanctuary's special use of their land requires special considerations to protect the animals, the people who care for them, and the employees of the company constructing the pipelines The Sanctuary has attempted to contact Discovery to initiate negotiations As of the time of filing these comments, Discovery has contacted the Sanctuary, but been unwilling to engage in any meaningful discussions In addition, the Sanctuary has a long relationship with the Weld County Commissioners to ensure compliance with county regulations and ensure the safety of the public 1994-1995 Worked with Commissioners to obtain USR establishing Sanctuary 1998 Obtained recorded exemption for mobile home 2011 Obtained permission to construct housing for animals 2012 Worked with Commissioners to construct employee facilities, equine facilities, and elevated walkway to lion habitat 2014 Applied for and received permits to build new Welcome Center shell building 2015 Worked with Commissioners to build new animal shade structure 2016 Received permits to complete the interior of new Welcome Center and %2 mile of walkway to connect new Welcome Center In the past, the Commissioners have held the Sanctuary to strict standards, requiring exact acquiescence with the Weld County Municipal Code A. The Planning Commission's analysis of the USR application violates several sections of the Weld County Municipal Code 1. Section 23-2-480 A 2 Section 23-2-480 A of the Weld County Municipal Code provides that the Planning Commission has a duty to ensure that an applicant has "met the standards or conditions of Section 23-2-480 " Section 23-2-480 A 2 requires that an applicant demonstrate "the pipeline - natural gas and pipeline will not have an undue adverse effect on existing and future development of the surrounding area, as set forth in applicable master plans "The Planning Commission stated in their comments that "the pipeline will not have an undue adverse effect on existing and future development of the surrounding area, as set forth in applicable Master Plans "i The Sanctuary disagrees with the Planning Commission's conclusion Special Review Permit Administrative Review,Discovery DJ Services,LLC,Case Number USRI 8-0075,page 3 2 First, Section 22-1-140(G)(3) of the County Comprehensive Plan states, "the County will discourage inappropriate development in natural hazard areas and reduce environmental degradation as much as possible " Although the Sanctuary notified the Planning Commission of its opposition to the Discovery application through written comments submitted on August 31, 2018 (attached as Exhibit A), the Planning Commission did not acknowledge the comments By disregarding the Sanctuary's comments, the Planning Commission has potentially allowed Discovery to degrade the integrity of the Sanctuary's animal habitat The Sanctuary is requesting the assistance of the County to protect the unique use of the property It is requesting the USR application be denied Or, at least require that Discovery negotiate in good faith with them to preserve their interests Section 22-1-140(G)(5)states,"the County will cooperate with the land use applicant in evaluating the objectives of the applicant and the options available to the applicant,while ensuring the health, safety and welfare of County residents"(Emphasis added )the Sanctuary has significant concerns regarding the safety of its employees, the employees of Discovery, and its animals if the construction of the pipeline proceeds There are special considerations that need to be addressed to facilitate a successful relationship between the Sanctuary and Discovery For example, inspection of the pipelines needs to be carefully coordinated to protect Discovery agents and the animals In addition,heavy equipment is used as a part of the Sanctuary's routine operations,which may impact the safety of the Sanctuary's employees None of these concerns were acknowledged or addressed by the Planning Commission in their comments The Sanctuary requests that the USR application be denied, as Discovery has not met their burden of proof required by Weld County Municipal Code Alternatively, conditions should be placed on the permit to protect the Sanctuary's environmental assets 2. Section 23-2-480.A 3 Pursuant to Section 23-2-480 A 3, the Planning Commission is required to ensure the applicant's natural gas pipeline has mitigated negative impacts to the greatest extent feasible In their comments, the Planning Commission stated, "the design of the proposed pipeline mitigates negative impacts on the surrounding area to the greatest extent feasible "2 The Planning Commission states that "the applicant works with the surface owners to determine the best route when following the property boundaries is not possible " Discovery did not cooperate with the Sanctuary while negotiating the Right of Way It dealt only with the previous owners, even though those owners had no incentive to ensure there were no negative impacts to the property, as the sale was pending Discovery was aware that a wildlife sanctuary was under contract to purchase the property, and it may have unusual issues that needed to be addressed prior to the Right of Way Agreement being finalized Yet, Discovery did not attempt to solve any of those issues with the future owner In addition, had Discovery accepted the Sanctuary's offer to negotiate,the Sanctuary has several alternatives for the pipeline paths that would minimize impacts to both parties The Planning Commission had notice of the pui chase of the property and associated issues when the Sanctuary submitted its comments on August 31, 2018 (previously incorporated Exhibit A) 2 Special Review Permit Administrative Review,Discovery DJ Services,LLC,Case Number USRl8-0075,page 3 3 Even with notice of Discovery's lack of cooperation with the Sanctuary to mitigate impacts, the Planning Commission did not acknowledge or address it in their comments 3. Section 23-2-480 A.6 Section 23-2-480 A of the Weld County Municipal Code states that"all reasonable alternatives to the proposal have been adequately assessed, and the proposed action is consistent with the best interests of the people of the county and represents a balanced use of resources in the affected area " In its comments, the Planning Commission asserts, "All reasonable alternatives to the proposal have been adequately assessed, and the proposed action is consistent with the best interests of the people of the County and represents a balanced use of resources in the affected area"3 It also states, "according to the application, the proposed pipeline route is the most direct route in order to minimize impact on the surrounding area and maximizing safety during construction "4 Again, the Sanctuary would like to point out to the Commissioners that it has attempted to initiate contact with Discovery to negotiate the placement of the pipeline, but Discovery has refused to engage in meaningful discussions The circumstances surrounding the sale of the property has put the Sanctuary in a difficult position The previous owner had no incentive to negotiate an ideal placement of the pipeline, the property was under contract to sell during the right of way discussions Because all reasonable proposals were not addressed, the USR application should be denied However, if the application is approved, conditions should be placed on the permit requiring Discovery to negotiate with the Sanctuary in good faith to reach a solution that is acceptable to both parties B The proposed USR and the current path of the pipeline poses a danger to the occupants of the home on the Sanctuary property. Discovery must consider public health and safety when determining its pipeline location In this case, Discovery ignored the possible impact to persons, animals, and personal property located so close to the proposed pipeline In addition to the impact to animals and animal habitats,the current proposed path places the pipeline within 170' of three family residences Discovery could have easily avoided this close proximity without additional cost Any pipeline leak will impact these homes and families(including the animals) from exposure to leaks,fumes, and possible explosion The United States Department of Transportation, Pipeline and Hazardous Materials Safety Administration contains data and reports on pipeline incidents, including serious and significant incidents These can be found at https //www phmsa dot Gov/data-and-statistics/pipeline/pipeline- incident-20-year-trends If the USR application is not denied by the Commissioners, Discovery should be required to post a bond for any incidents that may occur as a result of the proposed pipeline due to the unique and specific use of the land as serious injury may occur to persons,animals, and the Sanctuary property if any incident occurs 3 Special Review Permit Administrative Review,Discovery DJ Services,LLC, Case Number USRI8-0075,page 4 4 Id. 4 C. The proposed USR and Discovery's unwillingness to negotiate with the Sanctuary interferes with the land use Weld County Code requires no adverse impact on landowners, however, the planner in charge of the USR application and the Planning Commission have ignored the Sanctuary's concern for the adverse impact to the Sanctuary's existing land use and operations including but not limited to the following if the USR application is approved - Animal habitat enclosures will have to be modified, moved, and reconstructed causing serious impact to the animals living in each habitat Impacted, - This type of restructuring may pose a possible danger to the safety and wellbeing of the animals living in the habitat enclosures, - Daily operations such as feeding, care, visitors, etc will be impacted significantly during construction, - The Sanctuary (a non-profit organization) will experience significant costs and expense to modify, move, and reconstruct habitats, and - The heavy equipment used by the Sanctuary for daily operations, including feeding and caring for the animals, may be too heavy to cross a pipeline easement to access habitats Discovery failed to fulfill their obligations as required with Weld County's Use and Special Review process to adequately discuss the Sanctuary's concerns at the required public meeting It has also failed to follow through with their subsequent promise to resolve the situation with the Sanctuary The Sanctuary engaged pipeline officials regarding concerns related to Discovery's proposed path as it interferes with the Sanctuary operations and the safety and care of the animals At that time,the Sanctuary offered a no-cost, or very minimal cost, solution that would resolve the significant issues and Impacts Discovery has not meaningfully discussed these solutions with the Sanctuary As such, Discovery has failed to honestly and in good faith follow through with Discovery's verbal promise to faithfully pursue a resolution The Sanctuary has experience dealing with pipelines such as those proposed by the applicant In 2014, it worked with Conoco Phillips regarding an oil pipeline that was Installed in 1971 that crosses land now owned by the Sanctuary Conoco Phillips decided their 20' easement was not adequate for a number of reasons including - It crossed under a number of occupied Sanctuary habitats, - Any emergency response actions would be nearly impossible based on the dangerous carnivores living inside habitats, - Maintenance would be impossible with animals inside habitats, - The Sanctuary regularly crossed the pipeline in numerous spots with huge machinery and heavy equipment that could rupture the pipeline, - The Sanctuary negotiated a 100' wide easement with no habitats allowed, as well as protected areas with reinforced crossing supports for Sanctuary equipment, and - Conoco Phillips paid $150,000 to secure a wider uninterrupted easement due to the Sanctuary having to remove and rebuild a number of habitats During that same year, Kindei Morgan entered into discussions with the Sanctuary regarding its natural gas pipeline that runs north-to-south across the Sanctuary land Kinder Morgan opted not to widen its easement stating that it was adequate and in no danger with the equipment the 5 Sanctuary operated However, once the Sanctuary's new Welcome Center was completed, the annual attendance numbers elevated the building to a "high concentration of human occupancy" according to federal law, requiring Kinder Morgan to either reinforce the pipeline near the Welcome Center, or reroute the pipeline away from the dangerous area Kinder Morgan decided to reroute its pipeline and are in the planning stages right now for construction which will circumvent the Sanctuary property In both cases, the Sanctuary's residents, habitats, animals, and operations were of great concern, so both oil & gas companies were willing to work with the Sanctuary to find viable solutions Likewise, Discovery should be made to work with the Sanctuary to reach a solution that addresses all of the above concerns D. The Planning Commission, in making their recommendation, did not evaluate the safety record of Discovery and its parent company KKR and Williams Oil and Gas. The route that he prefers would include additional ROW on four landowners and would also effect one County Road crossing and two Ditch Company crossings. I informed Mr. Craig that we would possible consider the reroute per his request under the condition that he was to provide us with the approvals from each landowner on the newly proposed route , approvals from the County and Ditch Companies for the newly proposed crossings and requested that the Wildlife Sanctuary be fully responsible for all cost associated with the route change including ROW cost and any additional survey work performed or drawings we would need to submit for the new crossings . I also requested that all of the approvals would need to be completed by the end of this week and would be finalized in a timely manner that would not effect our current construction schedule . Mr. Craig and his attorneys were agreeable to the terms we requested. We were all under the understanding that this would be a tough task to complete in the time frame needed and also discussed options that we could pursue on the original route if everything didn't fall into place with the reroute . The map attached depicts the Wildlife Sanctuary property highlighted in yellow. The red line on the map is the route that Mr. Craig prefers around his property and the route outlined in blue is our current alignment. If anyone has any questions or concerns please let me know.
