This project does not include any anchor institutions, but serves first responders in rural Colorado, and will provide coverage for school age children residing in this area, which is full of new residential development. Project Requirements: 2 1. Describe in detail how your project meets each of the following requirements. Attach supporting documentation as appropriate. a. The area lies outside of municipal boundaries or is a city with a population of fewer than 5,000 inhabitants; and consists of one or more contiguous census blocks in which a majority of the households lack access to at least one provider of a broadband network that uses satellite technology and at least one provider of a broadband network that uses non-satellite technology. The entire area encompassing this project has a population of less than 5,000 inhabitants, and consists of rural residents of Adams and Weld Counties outside of the city limits. b. The project for which funding is requested must be a new project, and not a project in progress already. A "project in progress" means one in which construction of infrastructure has started. Phased projects may be considered a new project if the phase for which funding is being requested would not otherwise be completed without funding from the Broadband Fund. This is a new project that will upgrade three exiting towers, installation of approximately 35 miles of fiber for backhaul capacity and redundancy, and 3.65 infrastructure deployments on three sites enabling access to a broadband network. c. Grant funds shall be used for infrastructure deployment only, and not for on-going operating costs. Viaero hereby commits that all grant funds will be used for infrastructure deployment. d. The project provides access to a broadband network. This project will enable infrastructure upgrades, consisting of 3.65 equipment to provide broadband at the required speeds of at least 25Mbps down and 3Mbps upload to this unserved area. Additionally, this project will provide for fiber installation to provide redundancy and backhaul. e. The project shall provide last mile service, which is defined as the portion of broadband service that delivers an internet connection to an end user that lacks access to broadband service at measurable speeds greater than fifty-six kilobits per second. Proposed projects may include middle mile or other infrastructure necessary to expand broadband networks into unserved areas. This project will be a last mile service. From the e-Nobe B back to the switch located in Fort Morgan, CO, this is a middle mile infrastructure upgrade for the three existing towers at Sand Creek, Mule Creek and Prospect East. f. The applicant shall provide independent matching funds of at least 25% of the total cost of the proposed project. The Board may only consider in-kind matches for the purposes of infrastructure deployment. In-kind matching contributions shall not include consulting, planning or operational fees or costs. The applicant shall provide an appraisal of all in-kind matching contributions, sufficient to enable the Board to determine the fair market value of the in-kind matching funds. 3 Viaero hereby commits to provide independent matching funds of at least 25% of the total cost of the project, with the remaining cost to be funded from the grant award as set forth in the detailed budget. g. The project does not conflict with, or duplicate, federal or state sources of high cost support or broadband grants and programs. To the best of Viaero Wireless's knowledge, this project does not conflict with or duplicate federal or state sources of high cost support or broadband grants and programs. h. The applicant demonstrates to the satisfaction of the Board that the proposed network meets industry reliability standards. Viaero hereby commits to deliver the proposed project and operate a network that meets industry reliability standards. i. The applicant demonstrates to the satisfaction of the Board an ability to deliver on the proposed project within established timelines and within budget. Viaero hereby commits to deliver the proposed project within the established timelines and within the projected and approved budget set forth herein. j. The applicant demonstrates to the satisfaction of the Board the ability to operate the network as proposed for a minimum of 5 years following project completion. Viaero hereby commits to offer the supported broadband services described in this Application upon completion of any funded Project to all households within the service area defined in this Application for a minimum of five (5) years. k. The project shall be completed within two years from the date in which the grant award contract is executed. Viaero hereby commits to complete the project within two (2) years from the date in which the grant award contract is executed. L. The applicant shall demonstrate to the satisfaction of the Board an ability to provide broadband service at a reasonable cost per household and at reasonable service costs to end users in the area to be served. Viaero hereby commits to offer its broadband services at reasonably comparable rates for comparable services in the area to be served. m. The applicant demonstrates to the satisfaction of the Board that the project is not in an area with a population density large enough to require service under an existing franchise agreement. All of the areas designated within this Project are unserved and lie outside of municipal boundaries or are within a city with a population of fewer than 7,500 inhabitants, and are not in an area with a population density large enough to require service under an existing franchise agreement. n. The applicant has not been awarded a grant by the Board in the current calendar year. 4 Viaero has not been awarded a grant by the Board this current calendar year. o. The applicant shall agree to all award contract terms required by the Board and State of Colorado including but not limited to reporting and accountability requirements. Viaero hereby commits to fulfill all reporting and accountability requirements by the State of Colorado and Broadband Deployment Board for oversight by the Broadband Program; and commits to abide by all applicable Broadband Deployment Board rules, regulations and orders. 2. Provide a list of all parties that were given a copy of this application, including all attachments, and the date which it was provided to them. (You are required to submit this application including all attachments and exhibits to the Board of County Commissioners, City Council, or other local entity with authority over the area to be served; and the incumbent provider(s).) Complete copies of this Application, minus any exhibits marked confidential, were sent to the following entities on October 12, 2018. Include Attachment G (a)- A map demonstrating the insufficient availability of broadband service (25/3Mbps) in the proposed service area. Provide additional documentation and support as appropriate to prove the entire area to be served is outside of municipal boundaries or is a city with fewer than 5,000 inhabitants. Please see Attachment G (a) taken from the Colorado Broadband Map of the project area to be served. This map indicates that the project area does not have broadband at speeds of 25/3 Mbps. Additionally, the Broadband Now website: https://broadbandnow.corn/Colorado/Bennett?zip=80102#show=business states that "In Adams County, approximately 23,000 people do not have access to 25mbps wired broadband." 4. To your knowledge have state or federal sources of high cost support or broadband grants been awarded or used in the proposed service area? If yes, please provide a brief description including the name of the grant award/high cost support, who it was provided to, what it was used for and the outcome. To Viaero's knowledge, no state or federal sources of high cost support or broadband grants have been awarded or used in the project area. This was verified against the Colorado Broadband Mapping Tools. 5 Demonstration of Need: 1. Why is this project needed at this time? Please include an explanation why you believe state funds are needed more in your project area than in other unserved areas of the state. Broadband has become an essential part of everyday living affecting access to services, healthcare, education, housing and social interaction, just to name a few. This project will enable the Logan County residents in the hard-to-reach rural areas within the proposed service area to be provided adequate broadband service, where such areas have previously been considered uneconomical to serve. Additionally, this project will help the Broadband Deployment Board in reaching its goal in the implementation of broadband serve in unserved areas of the State of Colorado. This project is designed to provide broadband speeds of at least 25/3Mbps to those residents of Logan County that currently do not have access to broadband. 2. How does the proposed project address the needs of the community that will receive service? The project consists of infrastructure upgrades on three existing sites, along with the installation of fiber and will be designed to deliver broadband service to unserved areas in Colorado. Support from the Board for this Project would enable consumers in these areas to obtain broadband services which meet and exceed the Board's specified minimum speed of at least 25 Mbps download and 3 Mbps upload. With Viaero's existing infrastructure in place, the necessary funding would allow these rural residents and communities to complete their leap across the digital divide, and receive cutting-edge wireless broadband service, fulfilling the goals of the Broadband Deployment Board. Viaero will provide wireless broadband to rural consumers, businesses, and first responders. Viaero's pricing and services would attract a wide range of broadband users: rural Colorado households, lower-income populations, public safety, local governments, and rural businesses, just to name a few. Viaero's solution offers those individuals and organizations reliable, high- speed connections with scarcely more cost or technical difficulty than a wireless telephone, making their use of broadband connections affordable, easily adopted and sustainable. 3. If you have considered implementation options other than what is proposed in this application, describe all other options and why they were not chosen. No other implementation options were considered in developing this proposed project. 4. Is completion of the project dependent on the award of the entire requested amount of grant funds? If not, what is the minimum amount of grant funds you require to complete the project? Yes, this project is dependent on the award of the entire requested amount of grant funds. 5. If you are not awarded funds for this project, do you have plans to complete it using other funding sources? If yes, please describe your plan and the source of the funds. No. In the event that funds are not awarded for this project, Viaero does not have any plans to complete the project at this time. 6. Does the project address a need(s) as identified in a local or regional broadband plan? If yes, please explain and attach a copy of the plan. This area is not covered by a local/regional broadband plan at this time, at least that is identified on the Colorado Broadband map. 6 7. Include Attachment H - letters of support from local governments, businesses, and organizations that support your grant application. Included in Attachment H are letters of support from rural Adams County residents, and the Weld Central High School. Project Information: 1. Project Budget: a. Complete Attachment B and provide supporting documentation for line item expenditures. b. If any portion of the project funding is coming from a third party, describe the requirements and limitations of that funding (e.g. third party grants requirements, loan conditions, etc.) See Attachment B, incorporated herein. There will not be any funding coming from any third party for this project. 2. Design: a. List and describe in detail the infrastructure and technologies that will be deployed. Include, at a minimum, the following applicable items in your list and description: i. Last mile infrastructure and technology 1. Plant (locations, technology, equipment, owner, etc.) The last mile infrastructure will consist of a licensed 3.65 GHz Point-to-Multi Point wireless network. Base station equipment (aka eNode B) will be located at new tower sites as well as at existing locations. Subscriber equipment will be located at the subscriber's location and will include the user equipment and any antennae that may be deemed necessary at the time of installation. The technology utilized will be LTE. The 3.65 GHz wireless Point to Multi Point eNode B equipment will be deployed at the following locations: • Sand Creek, CO - Viaero owned tower • Mule Creek, CO - Viaero owned tower • Prospect East, CO - Viaero owned tower 2. A diagram of the route is attached and incorporated as Attachment J(a). 5. Wireline and fiber installation and utilization (locations, type of cable, owner, etc.) Armored fiber optic cable will be placed within conduit and terminated on each end location. Viaero Wireless will own all of the fiber installed in this project. 6. Customer drop to serviceable address (locations, type of cable, etc.) Since this is to be a wireless solution for the Customer Premise Equipment, there will be little if any drop cable. 7. Customer premise equipment (type of equipment, installation requirements, etc.) Customer Premise Equipment will consist of an integrated 3.65 GHz wireless transceiver/modem with dedicated Ethernet ports and Wi-H capability. Use of an external antenna may be required for locations blocked by foliage or buildings. This equipment would be provided and installed by Viaero. i. Middle and backhaul infrastructure and technologies 1. Plant (locations, technology, equipment, owner, etc.) 2. Towers/Antennae sites (locations, height, technology, equipment, owner, etc.) The proposed and existing sites for which 3.65 GHz LTE will be deployed connect back to the existing Viaero network through a combination of existing high capacity licensed microwave radio and new high capacity fiber. See the "CO Broadband Project Network Diagram" Attachment C. These three sites will be connected back to the Viaero network via high capacity fiber. These sites will also have redundant connections with fiber and microwave. In regard to the microwave paths from Sand Creek to Mule Creek, and Mule Creek to Prospect East, for which 3.65 GHz LTE will be deployed, they will connect to the fiber installed for backhaul. 3. Wireless equipment (locations, technology, equipment, spectrum utilized, owner, etc.) Viaero utilizes a combination of high capacity hot standby, space diversity licensed microwave along with Viaero owned high capacity fiber to operate a backhaul network that connects the existing and proposed sites back to its switching center in Fort Morgan, CO and thence to the Internet. 4. Trenching (locations, type of cable, etc.) 8 Plow, Trench and Directional bore will be utilized to place conduit from Colorado SH-52 to SH 79 along County, State and City right-of-ways by permit. A diagram of the route is attached and incorporated as Attachment J(a). 5. Wireline and fiber installation and utilization (locations, type of cable, owner, etc.) b. Include Attachment C - network or system map, such as a system block diagram or flow chart, that includes each infrastructure element and technology listed in the above question (2. a.). See Attachment C, incorporated herein. c. Describe the scalability of the network and system elements to meet demand in excess of forecasts (e.g. how will you handle a larger than anticipated number of subscribers). This network design is highly scalable through the use of additional 3.65 GHz channels at the base station level and the use of additional microwave channels and the use of fiber for backhaul. d. List identified risks to a successful project and describe how you will mitigate those risks. Potential risks for the completion of a successful project are identified to be the weather - and any unforeseen issues in land acquisition and permitting. Weather is the biggest factor that can impact long term network reliability, but a fiber cut incident can cause a few hours of outage but can normally be resolved within 24 hours. Given the high winds and frequently-severed power lines typical of the tornado-prone high plains, Viaero attempts to mitigate these issues by building its towers to withstand a direct hit from an F-3 tornado and equips each site with a backup generator that runs for two weeks without refueling. And where commercial power is entirely unavailable, the company has begun to install solar power. When fiber cuts or high winds knock out power lines for wireline providers, Viaero's customers will stay connected. e. If you are using wireless technology, list the spectrum used, where in the network it is used (e.g. last mile, middle mile), whether it is licensed or unlicensed spectrum and if it is licensed whether or not you have a current or pending license to utilize that spectrum. Viaero proposes to use a wireless technology utilizing 3.65 GHz licensed spectrum in the last mile. Viaero has been assigned Call Sign WQUP435 by the Federal Communications Commission for this spectrum. f. List all land, easements, right-of-way and buildings that are to be acquired or leased as part of the project and the status of any acquisitions or leases. All land is already secured by Viaero Wireless, or an affiliate, for existing towers sites. All fiber will be placed within State, County 9 and City right-of-ways by permit. No areas are known to require private easement for fiber optics. g. Answer the following questions for the backhaul - the portion of the network comprises the intermediate links between the core network, or backbone network and the small subnetworks at the "edge" of the entire hierarchical network: i. Is there redundancy? If yes, please explain. Yes, this project includes a hybrid microwave and fiber build out. Fiber will be the primary connection, and the microwave will serve as the back-up. ii. Is there physical diversity? If yes, please explain. Yes, the fiber will be buried and the microwaves will be placed on the towers, serving as two separate transport technologies. iii. What is the capacity of each link? Microwave - capacity will be 400 Mb with dual carrier Fiber - capacity is estimated to be 1Gb - 10Gb. iv. Do you have the ability to increase capacity? If yes, please describe how you would accomplish the increased capacity and the timeframe to complete. Yes, this project will have the ability to increase capacity through the fiber connections as well as additional equipment being placed on the tower structures. h. Answer the following questions for the middle mile - the segment of a telecommunications network linking a network operator's core network to the local network plant: i. Is there redundancy? If yes, please explain. Yes, this project includes a hybrid microwave and fiber build out. Fiber will be the primary connection, and the microwave will serve as the back-up. ii. Is there physical diversity? If yes, please explain. Yes, this project includes a hybrid microwave and fiber build out. Service a. List the network availability and reliability standards used in the design of the proposed project. Network availability is designed to be 6 nines (i.e. 99.9999%) from a backhaul standpoint from the base station to the Tier I Internet Service Provider. Availability from a mobile perspective is primarily measured from an established call and dropped call basis. Current overall network established call rates are over 99% and dropped call rates are in the 1% range or below. Inbound and outbound bandwidth to the base stations will initially be about 250 Mbps with the ability to grow as needed. Maximum sustainable throughput has been measured at over 60 Mbps per subscriber. Latency from a subscriber unit back to the RNC (Switch) is typically under 30 ms with jitter typically under 10 ms. Packet loss from the base station to the RNC is under 1%. b. List all monitoring tools and methods that will be deployed to ensure proper network performance. All Viaero sites are continuously monitored 24 hours per day/7 days per week/365 days per year. There is on-call personnel assigned at all times to ensure that the network is properly performing. c. Is the network capable of providing real-time communications? Yes, the network will provide real-time communications. d. List all standard service package tiers to be offered. The list must include, at a minimum, the following for each: i. Bitrate ii. Usage limits (if any), iii. Total upfront cost iv. Itemized list of all upfront costs (e.g. onetime - fees, installation costs, fiber drop to the premise, customer premise equipment costs, etc.) v. Total monthly cost vi. Fiber connections may be available for drop-in connections. Pricing for fiber connections is currently available at $4.00/Gb. ** Construction fees will be determined by the location of the customer's premises. Typically for up to 1000 foot fiber build, construction costs would be less than $10,000.00. e. Provide all proposed terms of service, including any required minimum contract term, customer service hours, additional fees and any early termination fees. A copy of Viaero's standard terms and conditions for services are attached hereto and incorporated herein as Attachment J(c), and can also be found at http://www.viaero.com/support/legal. f. What is the anticipated take rate, for each service package tier offered, for each of the first five years of operation? Normally, we would assume that the anticipated take rate for the first five years of operation is approximately 8% per year. i. What is the basis for your take rate estimations? Provide the data used in determining your estimations. This take rate is based on take rates in similar sized service areas. Data used in determining this was the actual penetration rates for these services in other areas and similar populations. High speed broadband has currently been deployed in 68 towns in Colorado, and the actual penetration rates for these services is a little over 6% per year. ii. What is the total number of anticipated subscribers within the project service area for each of the first five years of operation? The total number of anticipated subscribers within the project area for the first five years is anticipated to be 137. iii. Describe how you will handle variations in take rates. Include at a minimum the following: 1. What is your plan to cover operating costs if take rates are tower than expected? 2. How will service be affected if take rates are higher than anticipated? Viaero Wireless currently provides cellular service and internet services in four states (Colorado, Nebraska, Kansas and Wyoming). 1) Viaero Wireless has a proven track record that it can weather the storm on lower than expected take rates due to the fact it also serves larger cities and towns. 2) Viaero Wireless is also proposing to build in extra 12 capacity to serve the expected higher take rates. We are constantly upgrading middle mile networks to meet increasing demands. 4. Project Implementation Plan a. The corporation was originally established under the name of Cellular One of Northeast Colorado, Inc. on February 6, 1991. The corporate name was later changed to NE Colorado Cellular, Inc. on April 15, 1993, and has been successfully operating for over 27 years. 2. Are you in good standing with the Colorado Secretary of State? Yes, a Certificate of Good Standing is attached hereto as Exhibit J(b). 3. Describe the types of goods and services offered by your business. Viaero currently operated an extensive wireless network, including 4G LTE broadband in some areas within the State of Colorado, and has a proven track record of technical competence in the design and operation of broadband telecommunications networks. Viaero does not block end users from accessing lawful websites, (subject to reasonable network management discussed below), nor do we block applications that compete with our voice or video telephony services, subject to reasonable network management. Acceptable Uses Viaero permits use of broadband services for browsing the Internet (via Viaero phones or devices, including Viaero home routers), using email, downloading legally permissible content via the Internet, accessing and using corporate email and/or corporate business applications associated with its customers' places of employment. Performance Characteristics Many factors affect the speed and performance that customers experience, including the programs running on the device, proximity to a cell site, the capacity of the cell site, the surrounding terrain, use inside a building or moving vehicle, radio frequency interference, how many other customers are attempting to use the same spectrum resources, the high-speed data allotment and other features of your data plan, or data use by an Unlimited high-speed data customer that is excessive compared to the average customer. Customer devices also have varying speed capabilities and may connect to different networks depending on technology. Even within coverage areas and with broadband-capable devices, network changes, traffic volume, outages, technical limitations, signal strength, obstructions, weather, and other conditions may impact speeds and service availability. Speed The term "speed" is commonly used to describe the rate at which a particular broadband Internet access service can transmit data. This rate is typically measured in the number of kilobits or megabits transmitted in one second (Kbps or Mbps). Some applications like email or basic web browsing do not require a high-data speed to function very well, while other activities like video streaming or transferring large data files are better experienced with higher data speeds. Based on our internal testing and specifications from manufacturers and subject to the notes below, we expect at peak periods on capable devices and with qualifying service customers will experience approximately the following speeds on our Home Network**: 4G (LTE) network: typical download speeds of 6-20 Mbps and upload speeds of 2 - 5 Mbps. 4G (HSPA+ Dual Carrier/42 UMTS) network: typical download speeds of 4-11 Mbps and upload speeds of 500-1800 Kbps. 4G (HSPA+ 21 UMTS) network: typical download speeds of 2 - 6 Mbps and upload speeds of 250— 900 Kbps. 3G (HSPA UMTS) network: typical download speeds of 400— 700 Kbps and upload speeds of 100 - 250 Kbps. 2G network: typical download speeds of 40Kbps-200Kbps and upload speeds of 20-80 Kbps. Subject to your data plan and network management, customers using a 4G device within the 4G coverage area can expect to get 4G speeds. Customers using a 3G device within the 3G coverage area can expect to get 3G speeds. Customers with 4G devices may access the 3G network where it's available outside the 4G coverage area. Your speed range will also depend on the high-speed data allotments associated with the data plan you have selected. Latency Latency, is a term used to describe delay, and is the amount of time from when a data packet is sent to when it is received. For internet services, latency is usually expressed as the round-trip time in milliseconds ("ms") that it takes for a data packet to travel between two end points on the Internet (from point A to point B and then back to point A). Some applications, such as email, can tolerate a substantial amount of latency without any noticeable impact on the application's performance, while other applications, such as real-time video conferencing, require lower latency to function properly. With respect to latency for use of real-time data applications, Viaero expects round trip network to device latency to be approximately 35 — 90 ms on its 4G LTE network, 60 — 180 ms on its 4G network, 100-450 ms on its 3G network and 400-900 ms on its 2G network. Network Management We engineer our network to provide consistent high-speed data service, but at times and at locations where the number of customers using the network exceeds available network resources, customers may experience reduced data speeds. To provide the best possible experience for the most possible customers, we implement network management practices, such as caching data, prioritizing data usage, and using video optimization technology, all on a content neutral basis. Viaero may deploy streaming video optimization technology throughout its network. This technology is intended to manage data usage on the network, reduce the risk of streaming video stalling and buffering, and reduce the amount of high-speed data consumption used for streaming video. Streaming video optimization improves reliability allows other users to enjoy higher browsing speeds. The streaming video optimization process is agnostic as to the streaming video content itself and to the website that provides it. While most changes to streaming video files are likely to be indiscernible, the optimization process may minimally impact the appearance of the streaming video as displayed on a user's device. Our plans have different data allotments chosen by the customer. Unlimited data customers do not have a specific data allotment. Some network management of Unlimited plans is required because very heavy data usage by even a few customers at times and places of competing network demands can affect the network performance for all customers. To provide the best possible experience for the most possible customers, and to minimize capacity issues and degradation in network performance, when the Home Network, or any portion thereof becomes congested, any customers in the affected area will experience slower speeds without regard to prioritization. Customers who use data in violation of their plan or Viaero's Terms and Conditions may be see their data speeds slowed to 512 Kbps. The Unlimited data plans are intended for use on mobile devices only, however they may be used for smartphone mobile hot spot (tethering) but after the daily limit of mobile hot spot or tethering data is used, tethering is slowed to 512 Kbps for the rest of that day. Depending on the capability of your device, tethering your device to other lawful devices is permitted pursuant to the terms, conditions and allotments of your Data Plan, provided, however, the data is to be used for the customer and not provided to any third parties. Data used through a customer device by third parties will only be traceable to the customer's device, and as such customer's data allotments will be reached sooner possibly resulting in overages or slower speeds. If you use your Data Plan in a manner that could interfere with other customers' service, affect our ability to allocate network capacity among customers, or degrade service quality for other customers, we may suspend, terminate, or restrict your data session, or switch you to a more appropriate data plan, or terminate your service. Finally, certain uses of our network are also prohibited as described in our Terms and Conditions and above in "Acceptable Uses". For example, applications which automatically consume unreasonable amounts of available network capacity or are designed for unattended use are prohibited as they may interfere with our ability to provide a good service experience for the majority of our customers, cause capacity issues, and/or degrade network performance.
