HomeMy WebLinkAbout20182172.tiffHEARING CERTIFICATION DOCKET NO. 2018-64 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0038, FOR A KENNEL (UP TO 30 DOGS, SIX (6) MONTHS OF AGE OR OLDER TO INCLUDE DOGGIE DAYCARE AND BOARDING) IN THE A (AGRICULTURAL) ZONE DISTRICT- BRIAN AND SARAH CARR A public hearing was conducted on July 18, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad - EXCUSED Commissioner Mike Freeman Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Frank Haug Planning Services Department representative, Kim Ogle Public Works Engineer representative, Evan Pinkham Health Department representative, Ben Frissell The following business was transacted: 2-= I hereby certify that pursuant to a notice dated May 30, 2018, and duly published June 4, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Brian and Sarah Carr, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0038, for a Kennel (up to 30 dogs, six (6) months of age or older to include doggie daycare and boarding) in the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of record. Chair Moreno reviewed, for the applicant and the public, the procedures to follow should the case result in a tie vote due to four Commissioners being present and Commissioner Cozad excused. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and provided the location in relation to the Town of Severance Growth Management Area (GMA) and the Future Land Use Map. He stated the Town of Severance provided comments in the referral response referencing the Coordinated Planning Agreement with Weld County and offering annexation to the applicants, and requesting to review the landscape plan and signage. He clarified the applicant is willing to provide this information if the Board of County Commissioners requests them to do so. Mr. Ogle described adjacent land uses, and commented on the proximity of surrounding rural residential parcels, stating most of these were created by the Recorded Exemption process. He reported no letters of objection from surrounding property owners; however, one (1) telephone call was received asking for information about the proposed facility and the operation. He described the site as a single-family home with one (1) outbuilding which will house the doggie daycare, asserting the applicants will maintain the existing landscaping and al. pt. (AM Ic-O), (EP) El-tif3F) 021B crs) 2018-2172 PL2563 HEARING CERTIFICATION - BRIAN AND SARAH CARR (USR18-0038) PAGE 2 screening, and provide six (6) parking spaces He reviewed the hours of operation, lighting and signage requirements and stated staff sent out fifteen (15) referrals with three (3) responses that included comments that were considered in the staff recommendation He displayed images of site and surrounding properties and entered the favorable recommendation of the Planning Commission into the record as written Evan Pinkham, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, stating this site accesses from County Road (CR) 72 He provided the average daily traffic counts with truck percentages and stated the traffic narrative indicated a maximum of 30 passenger vehicle daily round trips and the Department of Public Works is requiring an Improvements Agreement Mr Pinkham presented the drainage and grading requirements and stated the site meets an exception for drainage, therefore, the applicants submitted a drainage narrative JR Ben Fussell, Department of Public Health and Environment, reviewed the water and sewer provisions, stating there will be two (2) full-time employees and customers on -site and water service will be provided by the North Weld County Water District (NWCWD) and a new septic system will be installed Mr Frissell asserted a current PACFA License is required and Development Standards (DS) #11-20 address Environmental Health items Brian and Sarah Carr, applicants, stated they searched for and purchased property with no neighbors in close proximity and located outside city limits, however, they notified surrounding property owners of their intent to operate a doggie daycare and boarding facility Ms Carr stated the neighbors are supportive and they have parents who live nearby and plan to assist with the business In response to Commissioner Conway, Ms Carr explained the maximum daily vehicle trips No public testimony was offered concerning this matter In response to Chair Moreno, Mr and Mrs Carr stated their agreeance with the Conditions and Development Standards as presented In response to Commissioner Conway, Mr Pinkham explained the reason for the Improvements Agreement and that dust abatement would be required f+� Commissioner Freeman suggested the deletion of Condition of Approval (COA) #1 A regarding the requirement for an Improvements Agreement In response to Commissioner Kirkmeyer, Ms Carr stated the Town of Severance was concerned with the visual aspect of the signage, however, the landscaping was not a concern Commissioner Kirkmeyer recommended deleting COA #1 C related to landscaping and signage In response to Commissioner Freeman, Ms Carr requested increasing the number of employees to four (4) on DS #3 Mr Frissell explained the septic requirements in relation to an increase in the number of employees 2018-2172 PL2563 HEARING CERTIFICATION - BRIAN AND SARAH CARR (USR18-0038) PAGE 3 In response to Commissioner Kirkmeyer, Ms. Carr explained the hours of operation for both the doggie daycare and the boarding. In further response, Ms. Carr described the privacy fence and the existing landscaping. Comm ssioner Kirkmeyer requested amending DS #8 to stipulate "existing" landscaping, and she suggested deleting DS #15 regarding noise and deleting DS #25 and #26 to correlate with the deletion of COA #1.A. The Board agreed with all of the aforementioned amendments. In response to Chair Moreno, Mr. and Mrs. Carr indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Brian and Sarah Carr for a Site Specific Development Plan and Use by Special Review Permit, USR18-0038, for a Kennel (up to 30 dogs, six (6) months of age or older to include doggie daycare and boarding) in the A (Agricultural) Zone District based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:47 a.m. This Certification was approved on the 23rd day of July, 2018.
