RE: AUTHORIZE WELD COUNTY TREASURER TO ACCEPT SURETY BOND AND
FURTHER AUTHORIZE THE COUNTY TREASURER TO ISSUE A DUPLICATE
TAX SALE CERTIFICATE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with, the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Weld County Treasurer, Francis M. Loustalet,
has requested authority to accept a surety bond indemnifying
him against loss by reason of so doing, and to issue a dupli-
cate tax sale certificate No. 335/1976 issued by the Weld County
Treasurer to Alicia Zuniga in the amount of Thirty Six and
61/100 Dollars ($36. 61) , dated in 1976, and which certificate
has been lost, misplaced or stolen or destroyed, and
WHEREAS, the Weld County Treasurer has presented such a
Lost Instrument Bond for the Board's approval and acceptance,
and
WHEREAS, the Board believes it to be in the best interests
of the County to authorize the County Treasurer to issue a new
certificate under proper circumstances of indemnification of
both the Weld County Treasurer and Weld County, Colorado, and
as contained in the aforementioned bond.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Weld County Treasurer,
Francis M. Loustalet, be, and hereby is, authorized to issue a
duplicate tax sale certificate No. 46/1976 to Alicia Zuniga in
the amount of Thirty Six and 61/100 Dollars ($36. 61) , subject to
receiving a penal bond in the amount of Sixty Five and 72/100
Dollars ($65. 72) hereinabove referred to, being a proper bond
and in the proper amount as complete indemnification of the Weld
County Treasurer and Weld County, Colorado.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
October, A.D. , 1979 .

Weld , State of Colorado, being first duly and legally
sworn upon oath, depose and say: That I, We; are the identical person(s) to
whom was issued (or assigned) Tax Certificate Numbered 335 of the 19 76
Weld County Tax Sale, covering the 1975 taxes on:
L55 Espanola Sub NW1/4NE1/4 36 6 66.
Assignment being made by Weld County
That said (assigned) Certificate has been misplaced, lost or destroyed
and after the most careful and diligent search, I, W< cannot find the same
nor can I, WC, produce the same for presentation for a Treasurer's or Tax
Deed for the property covered by this Certificate. That I, We; have not
assigned or disposed of this Certificate to any other person or persons, and
that I, We, are still the legal owner of said Certificate. That I, We; make
this affidavit for the purpose of inducing the county commissioners of said
Weld County, Colorado, to authorize issuance by the County Treasurer of
said Weld County of a new certificate, upon the condition that I, We; indemnify
said Weld County and the Weld County Treasurer for and on account of said
lost tax sale certificate.

KNOW ALL MEN BY THESE PRESENTS, That I , We, ALICIA ZUNIGA
, in the County of WELD and the State of
COLORADO , as principal, and Lupe Rodriquez , of
the County of WELD , and State of COLORADO , as
Surety, are held and firmly bound unto the County of Weld, State of
Colorado, in the sum of $ 65 .72 , lawful money of the United
States of America, for the payment of which well and truly to be made,
we bind ourselves, each of us, and our heirs, executors, administrators,
jointly and severally by these presents firmly.
Signed, sealed and dated this 19th day of OCTOBER A.D.

The condition of this obligation is such that, WHEREAS , a certain Tax
Sales Certificate No. '335 of the 1976 Tax Sale of Weld County, Colorado,
issued and signed by the then Treasurer of Weld County, State of Colorado,
and assigned to Alicia Zuniga , for the sum of $ 36.61 the same
having been lost, and having established by proof of said loss to the
satisfaction of the Board of County Commissioners of Weld County, Colorado,
and they have by proper Order entered a record authorizing the issuance of
a duplicate Tax Sale Certificate by the County Treasurer Numbered 335
of the 19 76 Tax Sale with all subsequent endorsements thereon.
NOW THEREFORE, If the said Obligors shall save the County of Weld and
, ' keep harmless the County and all of its officials from all damages, suits
and claims of whatever nature, occasioned by the issuance of said duplicate
Tax Sale Certificate without the surrender of the original, then this
