RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT,
USR17-0043, FOR MINERAL RESOURCE DEVELOPMENT INCLUDING ASPHALT
AND CONCRETE BATCH PLANTS, MATERIALS PROCESSING (CRUSHING AND
SCREENING), MATERIAL STOCK PILES, AN OFFICE, A SHOP, AND OUTDOOR
TRUCK AND EMPLOYEE PARKING IN THE A (AGRICULTURAL) ZONE DISTRICT -
CACTUS HILL RANCH COMPANY, C/O SIMON CONTRACTORS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 25th day of
October, 2017, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing
the application of Cactus Hill Ranch Company, do Simon Contractors, Inc., P.O. Box 691,
Windsor, CO 80550, for a Site Specific Development Plan and Use by Special Review Permit,
USR17-0043, for Mineral Resource Development including Asphalt and Concrete Batch Plants,
materials processing (crushing and screening), material stock piles, an office, a shop, and outdoor
truck and employee parking in the A (Agricultural) Zone District on the following described real
estate, to -wit:
Part of the W1/2 of Section 16, Township 7 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, deemed it advisable to
continue the matter to Monday, November 6, 2017, at 10:00 a.m., to allow Cactus Hill Ranch
Company, do Simon Contractors, Inc., adequate time to schedule a second open house for
surrounding property owners to be able to address questions and concerns, and
WHEREAS, on Monday, November 6, 2017, the Board heard all of the testimony and
statements of those present and due to time constraints, recessed this hearing until Wednesday,
November 8, 2017, at 9:00 a.m., at which time the Board reconvened and heard further testimony
and statements of those present and based on the amount of information submitted on both of
the aforementioned dates, deemed it appropriate to continue the matter to Wednesday,
January 10, 2018, at 10:00 a.m., to allow Cactus Hill Ranch Company, do Simon Contractors,
Inc., adequate time to reach an agreement with the Larimer County Canal Company, and to allow
both the applicant and the Board of County Commissioners time to review the document
submittals before returning to address all the questions and concerns that were raised at both the
prior hearing sessions, and

WHEREAS, on January 10, 2018, the Board allowed a rebuttal period for the applicant
and based on the amount of material submitted deemed it necessary to again continue the matter
to Monday, February 5, 2018, at 10:00 a.m., to allow the Board adequate time to review the large
number of documents provided by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to Monday,
February 5, 2018, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of January, A.D., 2018.
