WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being
the property of Edmund C. Dworak, Longmont, Colorado, and more
particularly described as follows, to-wit:
A tract of land located in the North One-Half
(Ni) and part of the Southwest One-Quarter
(SWj) of Section 32 in T3N, R68W of the 6th
Principal Meridian, Weld County, Colorado
and being more particularly described as
follows:
Beginning at a point on the North line of the
Northwest Quarter (NW 4) of said Section 32
from whence the North Quarter corner of said
Section 32 bears N89°29'55" E, 200. 00 feet,
and considering all other bearings relative to
said North line, NW,' thence N89°29'55" E,
200. 00 feet to said NI corner, thence along
the North line NEI, Section 32, N89°36'48" E,
2658. 71 feet to the NE corner of said Section
32, thence along the East line of said Section
32, S00°07'46" E, 1971. 46 feet to a point on
the Westerly right of way line of the Great
Western Railroad, said Westerly line being
the arc of a curve bearing Southwesterly and

amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under 1973 C.R.S., 30-28-101
(10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described of land owned by Edmund C. Dworak, Longmont, Colorado,
be exempted from the definition of the terms "subdivision" and "subdivided
lands" as provided for in the new Weld County Subdivision Regulations at
Section 2-1, A. , (3) adopted August 30, 1975.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 29th day of October, A,D. ,
1975.

Dear Sirs:
This letter is in reference to a request from Edmund C. Dworak
for a Recorded Exemption on property in the North Half and part
of the Southwest Quarter of Section 32, Township 3 North, Range
68 West of the 6th P.M. , Weld County, Colorado. The 226.371
acre farm is primarily irrigated land. The 1 acre parcel pro-
posed is land situated between existing improvements on the
farm.
The Planning Commission staff recommends approval for the follow-
ing reasons:
1 . The Intent Clause of Section 9-2 of the Weld County
Subdivision Regulations has been met in that non-
productive agricultural lands will be utilized.
. Al requirements of Section 9-3 and 9-4 of the
S division Regulations have been met.

9-4 Review Procedures for Recorded Exemptions from Definition of
"Subdivision" or "Subdivided Land "
A . The Planner shall review the application for recorded exemption
from the definition of " subdivision " or " subdivided land " and
make his recommendations to the Board of County Commissioners .
Upon hearing the recommendations of the Planner and reviewing
the evidence presented in the application , the Board shall
make its decision . The Board shall not approve the exemption
of the proposed land division unless it finds the following :
(Rev . 4/ 17/74 )
( 1 ) That the proposed lots are not part of a recorded ex-
emption from the definition of " subdivision" or " sub-
divided land " or a subdivision approved within less
than five (5 ) years previous ;
(2 ) That if the recorded exemption is approved , further
division of either tract or lot included in the re-
corded exemption into two (2 ) or more building sites ,
tracts or lots would not be allowed within a five ( 5 )
year period ; such five ( 5 ) year period being defined
as that period commencing upon the date of approval of
the most recent recorded exemption on the parcel of
land in question and extending five (5 ) years after
the date of such approval ; (Rev . 4/17/74 )
(3 ) That the lots resulting from the proposed land division
shall be accessible from an existing public road with
a minimum frontage in conformance with the Weld County
Zoning Resolution ;
(4 ) That the proposed lots will have access to an adequate
water supply;
(5 ) That the proposed lots will have access to an adequate
means for the disposal of sewage ;
(6 ) That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution ;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners
or where said tract or parcel of land lies within the
comprehensive plan area of an existing incornorated
town of Weld County. (Rev . 4/17/ 74 )
(7 ) That the minimum size of any building site , tract or
lot created by such land division shall not be less
than one ( 1 ) acre , except where smaller lot sizes are
allowed in a specific zoning district : (Rev . 4/ 17/74 )
(8 ) That the proposed land division is in compliance with
the Weld County Comprehensive Plan ;
(9 ) That said land division does not interfere with or lie
w.ithi.n major floodways or drainage courses ;
(101;- That the method of disposition described in this Section
9 is not being adopted by the applicant for the purpose
of evading the requirements and intent of the Weld County
Subdivision Regulations . (Rev . 4/ 17/ 74 )
9-5 Violations - Further division of building sites , tracts or lot
defined by an approved recorded exemption into additional building
sites , tracts or lots within five (5 ) years from the date of
approval of said recorded exemption , shall constitute a viola-
tion of the Weld County Subdivision Regulations . ( Rev . 4/ 17/74 )
