HomeMy WebLinkAbout750411.tiff RESOLUTION WHEREAS, it has been determined by the Board of County Commis- sioners, Weld County, Colorado, that John McCabe, 1155 Monaco, Denver, Colorado, is the owner of 40 acres of land, and Mr. McCabe desires to split off from said parcel of land a portion containing approximately 20 acres; said whole parcel of land being more particularly described as follows, to-wit: The North 40 acres of the Northwest Quarter of the Northwest Quarter of Section 15, Township 2 North, Range 68 West of the 6th P. M. , Weld County, Colorado described as follows: Beginning at the Northwest corner of said Section 15; thence South 89°59'54" East and along the North line of the Northwest one-quarter of said Section 15, 1324. 80 feet to the Northeast corner of the West ore-half of the said Northwest one-quarter; thence South 00°18'13" East and along the East line of the West one-half of the said Northwest one-quarter, 1314. 80 feet; thence North 89°59'54" West and along a line parallel with the North line of the North one-half of said Northwest one-quarter, 1325. 64 feet to the West line of the said Northwest one-quarter; thence North 00°16'01" West and along the West line of the said North- west one-quarter, 1314. 80 feet to the point of beginning, con- taining 40 acres, more or less, and WHEREAS, Mr. McCabe is desirous to split the land into two 20 acre parcels, selling off one parcel and keeping the balance of the 20 acre parcel intact and for his own use, and WHEREAS, it appears that to accomplish this purpose, Mr. McCabe may apply for a recorded exemption from the subdivision regulations of Weld County, as same is defined in Section 9-4 of the Weld County Sub- division Regulations, and WHEREAS, in addition to evidence presented by Mr. McCabe, the Weld County Planning Commission Staff has presented evidence, made represen- tations concerning the desirability of granting said variance, and WHEREAS, the Board of County Commissioners feels that when all of the evidence and representations are considered, good cause for granting a variance from the minimum lot size requirements of the Weld County Zon- ing Resolution has been shown. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers granted to the County under Chapter 106 CRS 1963 and Section 9-4 a(6), Weld County Subdivision Regulations as amended; that Mr. McCabe is granted an exemption from the lot size requirements of the Weld County Zoning Reso- lution. BE IT FURTHER RESOLVED, that this Exemption is allowed so that Mr. McCabe may proceed to apply for a Recorded Exemption and the lot size variance is conditioned on Mr. McCabe applying for and doing all necessary to obtain said Recorded Exemption within one (1) year, and said variance is limited to Mr. McCabe, and will terminate if he sells or other- wise discontinues his interest in the above mentioned land prior to obtaining approval for and recording the above mentioned Recorded Exemption. 750411 The above and foregoing Resolution was, on motion dulyA and seconded, adopted by the following vote on the 2nd day of • A. The parcel contains approximately 40 acres, and the desire is to split the ground into two 20 acre parcels. Under existing requirements of the Subdivision Regulations for Recorded Exemption, Section 9-4A(6), the following is required: "That the original tract or parcel of land to be divided under this Section meets the minimum lot size requirements establish- ed by the Weld County Zoning Resolution; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the comprehensive plan area of an exist- ing incorporated town of Weld County. (Rev. 4/17/74)11 Based upon information submitted and the Weld County Regulations, the Planning staff recommends approval for the following reasons: 1 . The proposed split complies with the intent clause, Section 9-2 of the Weld County Subdivision Regulations, for Recorded Exemption in- as-much as non-productive lands are to be utilized for a higher and better use and is compatible with surrounding agricultural uses. Honn Zoning Administrator jsm enclosures February 26, 1975 Dear County Commissioners: I, John McCabe, being the property owner of forty (40) acres located in the NW 1/4 of Section 15, Township 2 North, Range 68 West, would like to request a variance in your lot size requirement to convey a twenty (20) acre irrigated piece of land to another owner. The land will continue to be used in an agriculture manner and I propose to use the remaining twenty (20) acres to build my own residence on and to pasture some cattle and horses in an agriculture way. The piece of ground is not a real high productive piece of ground and is most suitable for this particular use. The recommendation of the A.S.C. office in Longmont has further indicated this to be the best use. My reason for wanting to convey off twenty (20) acres is that financially it is difficult to sustain because it is not a high returning piece of ground and is more suitable for its proposed use.
