HomeMy WebLinkAbout20181214.tiffHEARING CERTIFICATION DOCKET NO. 2018-37 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0008, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY 2.5 MILES LONG (24 -INCH NATURAL GAS PIPELINE) IN THE A (AGRICULTURAL) ZONE DISTRICT — KERR-MCGEE GATHERING, LLC A public hearing was conducted on April 25, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair - EXCUSED Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman, Acting Chair Pro-Tem Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Evan Pinkham Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated March 15, 2018, and duly published March 20, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0008, for a greater than 12 -inch high pressure natural gas pipeline approximately 2.5 miles long (24 -inch natural gas pipeline) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Fi Acting Chair -Pro Tern Freeman provided notice to the applicant and the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the project to construct, own and operate a high pressure natural gas pipeline that will connect the Dacono Compressor Station to the Frederick Compressor Station, which will accommodate Kerr-McGee's pipeline development in Weld County and provide flexibility to their existing system. He provided the preferred pipeline route, stating the pipeline will cross County roads and the Little Dry Creek floodplain. Mr. Ogle clarified the applicant is required to submit a Floodplain Development Permit prior to installing the pipeline, and delineate the floodway and floodplain boundaries on the map. He stated the applicant has negotiated a permanent easement that is 100 feet in width to accommodate this and future pipeline projects to minimize the impact on landowners. He reviewed safety protocol using smart pigs and routine maintenance. Mr. Ogle stated the pipeline is located within the three (3) mile referral area of the Towns of Dacono and cc PLC Ko/ Mal), ICJ( EP/H6), H C LL), C T& TS) 000(05(( 2018-1214 PL2545 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR18-0008) PAGE 2 Frederick; however, neither jurisdiction returned a referral response. He explained that a Cultural Resource Inventory was performed to assess the impact to biologic, aquatic and cultural resources adjacent to the route. He stated the Colorado Department of Wildlife did not return a referral response. Mr. Ogle stated an Emergency Action and Safety Plan is required. He reported 14 referrals were sent out and only four (4) agencies offered comments. He stated there was one (1) letter of objection received; however, it was objecting to oil and gas overall. Mr. Ogle displayed images of the pipeline route and entered the favorable recommendation of the Planning Commission into the record as written. • Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements, stating the pipeline will cross County Roads (CR) 10 and 15, which are both local gravel roads and require the pipeline be bored ten (10) feet below the lowest roadside ditch flowline elevation. He explained the Department of Public Works is requiring a Road Maintenance Agreement. la Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating portable toilets are acceptable along the construction route. She explained the requirements for an Air Permit, if disturbing more than 25 acres, and stated Development Standards (DS) #12-19 address Environmental Health items. • Samuel Samet represented the applicant and stated staff presented the case very well and he had nothing to add. • No public testimony was offered concerning this matter. O In response to Commissioner Conway, Mr. Pinkham explained the required Access Permits for construction and valve locations. • Commissioner Cozad amended Condition of Approval (COA) #5.C to remove the words, "...will require a Flood Hazard Development Permit." • In response to Acting Chair Pro -Tern Freeman, Mr. Samet indicated the applicant has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. IR Commissioner Conway moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0008, for a greater than 12 -inch high pressure natural gas pipeline approximately 2.5 miles long (24 -inch natural gas pipeline) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Cozad, and it carried unanimously.
