HomeMy WebLinkAbout20184139.tiff HEARING CERTIFICATION DOCKET NO. 2018-144 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0086, FOR A HOME BUSINESS (PARKING OF VEHICLES ASSOCIATED WITH A LANDSCAPING/SNOW REMOVAL BUSINESS ALONG WITH AN OFFICE FOR PAPERWORK) IN THE A (AGRICULTURAL) ZONE DISTRICT - JOSE CARBAJAL CASTILLO AND CAROLINA SALINAS CORONA A public hearing was conducted on December 26, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Frank Haug Planning Services Department representative, Chris Gathman The following business was transacted: • I hereby certify that pursuant to a notice dated November 13, 2018, and duly published November 19, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Jose Carbajal Castillo and Carolina Salinas Corona, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0086, for a Home Business (parking of vehicles associated with a landscaping/snow removal business along with an office for paperwork) in the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of record. 07 Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, mentioned the location in Aristocrat Ranchettes and explained the applicant is only able to apply for a home business in this subdivision. He described the violation and explained the construction of the single-family residence will not be completed and ready for the Certificate of Occupancy until May of 2019. He mentioned the Planning Commission hearing was continued to May 7, 2019, and requested a continuance on behalf of the applicant. • No public testimony was offered concerning this matter. • In response to Chair Moreno, Mr. Gathman provided dates for a continuance and stated there have been no correspondence from surrounding property owners regarding the application. After further discussion regarding the home business operating prior to the home being built, Commissioner Cozad recommended stipulations regarding the violation, ZCV18-00141. In response to Commissioner Kirkmeyer, Mr. Gathman stated there was a modular home on the property that was removed and clarified the application process began in July, 2018, in response c c: Pl-(;GG(TPJ, PwC EP) , BF.) 2018-4139 oal is( 19 PL2619 HEARING CERTIFICATION - JOSE CARBAJAL CASTILLO AND CAROLINA SALINAS CORONA (USR18-0086) PAGE 2 to the violation. Commissioner Cozad requested going forward with the violation, to ensure the business does not operate without a home on the property. Mr. Haug stated there was a court case against the applicants to remove the modular and close the business on the property, which was completed in March of 2018. He further explained commercial vehicles were also removed from the property at that time and clarified the applicants had a prior violation with stipulations that allowed one (1) commercial vehicle on the property to which the applicant complied. After further discussion regarding the Use by Special Review(USR) approval with no home built, Commissioner Kirkmeyer reiterated the violation needs to be pursued and motioned to refer the request of Jose Carbajal Castillo and Caroline Salinas Corona for a Site Specific Development Plan and Use by Special Review Permit, USR18-0086, for Home Business (parking of vehicles associated with a landscaping/snow removal business along with an office for paperwork) in the A (Agricultural) Zone District back to the Department of Planning Services. The motion was seconded by Commissioner Cozad. Commissioner Freeman supported the motion and Commissioner Kirkmeyer reiterated if there is a business operating on the property, the violation needs to be pursued. The motion carried unanimously and there being no further discussion, the hearing was completed at 10:10 a.m. This Certification was approved on the 2nd day of January, 2019.
