Lamont, of the County of Weld And State of Colorado for the consideration of the keeping and performing of the provisions of this deed and One DOLLARS, in hand paid, hereby sell and convey to Weld County, Colorado, the right of way for a public highway over and across the following real property situate in the County of Weld and State of Colorado, to-wit: A strip of land lying and being in the East one-half (Ez) of Section Five (5) , Township Four (4) i North Range 61, West of the 6th P.M. ex- tending 30 feet on either side of the center line of said strip of land, which center line passes through said East one-half (EZ) of said Section in approximately the following manner, to-wit: On the North line of said Section 139 feet West of the Northeast corner of said Section and on the South line of said Section, 1329 feet West of the Southeast corner of said section, the same being the road as now construeted and existing on said land; subject to the covenant by grantee herein expressed and acknowledged by acceptance of this deed, that the grantee will install and maintain cattle guards upon said right-of-way hereby conveyed for the use and benefit of grantors their heirs, representatives and assigns. The acceptance and recording of this deed shall be acknowledgment by the grantee that the former right-of-way for public road and highway heretofore existing on said land is abandoned and all rights in said right-of-way shall revert to the abutting property owner or owners as their own property absolutely free of such former right-of-way The consideration herein stated is in full compensation for all damages which would be considered and assessed in any award or verdict in a proceeding under the Statutes of Colorado, to condemn said strip of land for public road. Whereas heretofore under authority of Chap. 95, Sec. 4, Stat o£ Colorado,-1885, and by Resolution of the-Board 6f -' " '-'- - - - --- County Commissioners of Weld County,Colorado dated October 12, 1889, that certain public road, 60 feet wide, along the section line between Sections 1 and 12 in Tp. 6 N. R. 62 W. 6th P.N. was authorized and declared to be a public road, -and Whereas this Board of County Commissioners, at a hearing now had thereon, hereby finds from an examination of the. road records, road maps of Weld County relative to said above described road, and the oral testimony of long time residents of said locality and from the written certificate of land owners residing on or near said road: that said road between Sections land 12 Tp 6 N. Rg. 62 W. was on Oct. 12, 1889, by resolution of the then Board of County Commissioners, declared to be. a public road as by law provided; that thereafter said road was laid out, constructed, continuously used and maintained to this date; that said road so declared, laid out and constructed has for more than twenty years been used by the traveling public and maintained by Weld County as a public road. Now; therefore, this Board of County Commissioners of Weld County,Colorado, finds said road 60 feet wide being 30 feet each side of the section line between sections 1 and 12 in Tp 6 N. Rg. 62 W. was on Oct. 12, 1889 declared and laid out as a public road and that for more than 20 years last past, has been used continuously and now is used and maintained as a public road. To the Honorable Board of County Cormissioners,Vield Co . ,Greeley,Colorado : Whereas,we understand. that a petition has been sent. to your hon- orable body,asking for a- road -to be built from-Nasters, Colo. to Osggod,Colo. And whereas we believe that the routing of said road is incompetent in as much as the expense of fencing,building culverts,etc.will be great, (at least ten miles of fencing,and at least two culverts would be necessary. ) And whereas we believe we have a much better route in mind,not only a more direct one, (only deviating from the section line at the "blowout"for a short way)but also much less expensive,as five miles of fence is already up and in place,and no culverts would be required . Now, therefor,we the undersigned taxpayers of Weld County petition your honorable body,that if you decide to build this road from Masters to Osgood you will meet with us,or send a representative to us,whom we can and will show our route,and it ' s advantages over any other . - -Our .-plan is to. start east on the half section line of sectionS,township 4,range 61 we'st,and continue three-quarters of a mile,missing the blowout, then turn`north' on the section line between sections P and 9,and thus north the rest of, the way.
