SECTION I
GENERAL PROVISIONS
A. Relationship to Other Rejlations
1 1 . These regulations are supplementary to requirements adopted under
Title 30, Article 28, parts 1 and 2, Colorado Revised Statutes
1973, as amended.
2. Nothing in these regulations shall he construed as exempting an
applicant for a development permit from any other requirement of
Weld County or other state or federal laws and regulations.
3. To the extent that the requirements of these regulations differ
from other applicable requirements, the more restrictive require-
ments shall apply.
B. Authority
These regulations are adopted pursuant to, inter alia, section 29-20-
101 , et. seq. , 24-65.1-101 , et. seq. , and 30-28-101 et. seq. , C.R.S.
1973.
C. Applicability
1 . Jurisdiction - These regulations apply to all applications for
development permits in areas within the unincorporated portions
of Weld County, Colorado, which have been identified for regulation
by the Board of County Commissioners.
2. Boundaries - The boundaries of regulated areas shall be as they
appear on maps officially adopted by the Board of County Commissioners.
Maps officially adopted by the Board shall be on file with the Clerk
and Recorder and shall also be available for public inspection in the
Weld County Department of Planning Services. However, where flood
elevation information is available for a floodplain area and has been

adopted by the Board of County Comissioners, such elevation data
shall take precedence over the adopted maps on file with the Clerk
and Recorder of the County and in the Department of Planning Ser-
vices. Where there is a conflict between the boundary lines illus-
trated on the map and the actual field conditions, the disputes
shall be settled according to "Mapping Disputes", Section I. G. of
this regulation.
3. Required Information - Any person seeking to engage in development
in any area in Weld County governed by these regulations shall sub-
mit the information called for by these regulations as a supplement
to his application for a development permit.
4. Waiver of Submission Requirements - The Board of County Commissioners
may waive any part, but not all , of these submission requirements if
the submission requirements or any portion thereof are inapplicable
to the development for which the permit is sought.
' 5. Disclaimer - The regulation of a hazard area by these supplementary
regulations does not constitute an affirmation by the County of Weld
tthat lands outside the regulated area as defined on maps adopted by
the Board of County Commissioners will be free from the regulated
hazard.
D. Definitions
1 . Applicant - means any person applying for a permit to engage in
' development in a regulated area.
' 2. Development - means any construction or activity which changes the
character or the use of land.
3. Development Permit - means a permit for a Conditional Use, Special Use
change of zone or subdivision of land including Recorded Exemptions
' and Planned Unit Developments.

4. Fill - means a material such as earth, clay, sand, concrete, rubble
' or waste of any kind, placed, stored, or dumped upon the surface
1 of the ground, which increases the natural ground surface elevation.
5. Flood Elevation Information - means the elevation and depth of
' flooding which is determined for specific locations in the flood-
plain.
' 6. Flood Hazard Area - means one or more of the following: flood prone
area, floodway area, low hazard area.
7. Flood Prone Area - means areas subject to inundation whose physical
conditions give a definite direction to a flow of runoff, the 100 year
elevations of which have not been determined. The physical location of
' flood prone areas on officially adopted maps is representative of
existing ground conditions and may be based, among other things, on
historical flood records or other readily available data.
' 8. Floodplain - means an area in and adjacent to a stream, which is
subject to flooding as the result of an intermediate regional flood.
' 9. Floodproofing - means the design or modification of lands, properties,
or structures intended to mitigate or eliminate flood damage in a
flood hazard area.
' 10. Floodway Area - means that portion of the floodplain in which the
waters of an intermediate regional flood exceed one and one-half
' feet in depth.
' 11 . Geologic Hazard - means a geologic phenomenon which is so adverse to
past, current, or foreseeable construction or land use as to consti-
tute a significant hazard to public health and safety or to property.
The term includes, but is not limited to: unstable or potentially un-
stable slopes, seismic effects, radioactivity, and ground subsidence.

12. Geologic Hazard Area - means an area which contains or is directly
affected by a geologic hazard.
13. Ground Subsidence - means a process characterized by the downward
' displacement of surface material caused by phenomena such as removal
of underground fluids, natural consolidation, dissolution of under-
ground minerals, or underground mining.
14. Hazard Area - means any area governed by these supplementary regulations
' where a natural or man-made condition presents a potentially signifi-
cant harm to public health, safety, welfare, cr property.
15. Intermediate regional flood - means a flood with an average statisti-
cal one percent chance of occurring during any one year. The term
is used interchangeably with a one percent flood or a one hundred
year flood.
16. Low Hazard Area - means that area of the floodplain in which the
waters of an intermediate regional flood will not attain a maximum
' depth greater than one and one-half feet.
17. Mitigate - means to take preventive or remedial action to lessen the
' adverse impact of a natural hazard.
' 18. One Hundred Year Flood - means an intermediate regional flood.
19. One Percent Flood - means an intermediate regional flood.
' 20. Person - means any individual , partnership, corporation, association,
company, or other private, public or corporate body, including the
' federal government, and includes any political subdivision, agency,
instrumentality, or corporation of the state.
21 . Radioactivity - means various types of radiation emitted by natural
radioactive minerals that occur in natural deposits of rock, soils,
and water.

' 22. Regulated Area - means any area in Weld County falling within the scope
of these supplementary regulations.
' 23. Seismic Effects - means a rapid shifting and displacement of geologic
formations caused by earthquakes, volcanic action, or man created
explosions, the consequences of which are potentially destructive
' to human life and property.
24. Structure - means anything constructed, erected, or placed on or
attached to the ground, including, but not limited to, docks, dams,
fences, mobile homes, sheds and buildings.
25. Unstable or Potentially Unstable Slope - means an area susceptible
' to landslide, mudflow, rockfall , or accelerated creep of slope-
forming materials.
E. Evaluation of Permit Application
' The Board of County Commissioners shall approve an application for
a development permit in an area governed by these supplementary regula-
tions only if the applicant has complied with all the provisions of the
particular development permit application procedure and the applicable
' requirements of these supplementary regulations.
F. Adoption and Amendment of Official Maps
Maps delineating regulated areas shall be officially adopted by the
Board of County Commissioners only after a public hearing. Notice of
such hearing shall be published one time in a newspaper of general dr-
illculation in the county at least thirty (30) days, but not more than
sixty (60) days, prior to the hearing. The published notice shall include
the time and place of the hearing, and shall designate a county office
' where the proposed maps will be available for public inspection.
Within thirty (30) days of the conclusion of the hearing, the map(s)

' shall be adopted by the Board upon its finding that the boundaries
shown are consistent with available data which determines the geo-
graphic extent of the regulated area and that the regulation of the
area is necessary for the protection of public health, safety, and
welfare.
Prior to consideration of a map for official adoption by the Board of
' County Commissioners , the proposed map(s) shall be reviewed by the
Planning Commission, which shall present to the Board its recommendations
for adoption, rejection or adoption with modification of the map(s) .
Maps officially adopted by the Board shall be on file with the Clerk
and Recorder of the County and shall also be available for public
' inspection in the offices of the Weld County Department of Planning
Services.
Maps officially adopted by the Board of County Commissioners as a part
of these supplementary regulations may be amended in accordance with the
above procedures.

G. Aping Disputes
' The following procedure shall be used by the Board of County Commis-
sioners in deciding cases in which the boundary of a regulated area
is disputed. A person contesting the location of an area falling
' within the scope of this regulation shall present his case to the
Board at a public hearing held in accordance with the procedures
' found in Section I. F. above for the amendment of officially adopted
maps. The contestant shall submit technical evidence to support his
case. The Board shall not allow deviations from the boundaries shown
on the official adopted map unless technical evidence presented by
the contestant clearly and conclusively establishes that the boundary
' shown on the official adopted map(s) is incorrect.
' Prior to the public hearing held before the Board of County Commissioners
to consider a mapping dispute, the Planning Commission shall review the
1 technical evidence of the contestant at a regularly scheduled meeting
of the Commission, and shall submit its recommendations to the Board.

H. Administration & Enforcement
These regulations shall be administered and enforced according to the
Iprovisions of the Weld County Zoning Resolution and Subdivision Regu-
lations which are applicable to the type of development permit sought
IIby the applicant.

SECTION II
GEOLOGIC HAZARD AREAS
A. Purpose and Intent
The Board of County Commissioners finds that there are, within the County
' of Weld, various areas subject to unstable geologic conditions which may
' cause serious damage to properties and subject the safety of residents
of such areas to hazards, and that the imprudent use and occupation of
' these areas will pose a continuing danger to life and property, unless
appropriate land use measures are implemented concerning the use and
' occupation of such hazardous areas. The purpose and intent of these
Geologic Hazard Regulations shall be to:
1 . Minimize hazards to public health and safety or to property in
' regulated geologic hazard areas;
2. Promote safe use of geologic hazard areas;
' 3. Reduce the adverse impact of geologic hazards on life and property by:
a. Requiring land uses permitted in geologic hazard areas to be
protected from geologic hazards by providing for geologic hazard
' investigation and the mitigation of the adverse impacts of such
hazards at the time of initial construction;
' b. Regulating the manner in which structures designed for human
occupancy may be constructed so as to prevent danger to human
' life or property within such structures;
' 4. Protect the public from the burden of excessive financial expenditures
caused by damage from geologic hazards by regulating land uses within
' geologic hazard areas.

' B. Geologic Hazard Area Supplementary Application Requirements
Before a permit for development in a regulated geologic hazard area
is issued, the Board of County Commissioners shall determine that the
' proposed development has met the intent and purpose of these geologic
hazard regulations, after considering the following supplementary
plans, maps, reports, and data, which shall accompany the application
for such permit.
' 1 . A map(s) portraying the geologic conditions of the area with par-
ticular attention given to the specific regulated geologic hazard(s) .
The map shall be delineated in drawing ink on mylar or other draft-
ing medium approved by the Director of Planning Services. The dimen-
sions of the map shall be twenty-four (24) inches by thirty-six (36)
' inches. The map shall be prepared at a 1 " = 100' scale and shall in-
clude the parcel in question, as well as features within 500 feet of
the parcel boundaries. The scale of the map may be reduced or en-
larged upon approval of the Director of Planning Services. Such map(s)
shall also include:
' a. A certified boundary survey of the property for which application
is made. Bearings and distances of all perimeter boundary lines
shall be indicated outside the boundary lines.
b. The topography of the area at ten (10) foot contour intervals or
at intervals as determined by the Board of County Commissioners
' or its authorized representative.
c. Existing structures and landscape features, including the name
and location of all watercourses, ponds, and other bodies of
' water.
d. Proposed building locations and arrangements.

e. The legend shall include a complete and accurate legal descrip-
tion as prescribed by the development permit application form.
The description shall include the total acreage of the surveyed
' parcel .
f. Certificates
(1 ) Engineer's Certificate
' (2) Surveyor's Certificate
g. Title, scale and north arrow.
' h. Date, including revision dates if applicable .
' i . Such additional information as may be required by the Board of
County Commissioners.
' 2. A geologic report explaining the above map(s) with particular em-
phasis on evaluating and predicting the impact of such geologic con-
ditions on the proposed land use changes and developments. The report
' shall also include recommended mitigating procedures to be employed
in meeting the intent and purposes of this regulation. Specific
' requirements of such report are listed below.
a. Ground Subsidence Areas - Applications for development in ground
' subsidence areas shall include, but not be limited to, the follow-
ing information or data, where applicable.
(1 ) Amount of material removed or materials subject to volume
' decrease.
(2) Interval between the ground surface and the location of void
space or materials subject to volume decrease.
' (3) In poorly consolidated aquifers, the effect of pore fluid
withdrawal .

' (4) In wind deposited silt (loess) areas, and areas of pre-
dominantly fine-grained colluvial soils, the amount of
wetting the area is subject to and its effect.
(5) In areas of soluble materials, the effect of wetting.
(6) In areas of underground mining , data regarding air shafts,
' haulage ways, adits, faults , rooms and pillars, and final
' mine maps.
(7) Building type and proportion.
(8) Pertinent geologic and hydrologic factors of the area.
(9) Test hole and well log data.
(10) Mitigation techniques that will be employed, including
' effectiveness and estimated cost of such techniques.
(11 ) Pertinent historic factors including, but not limited to,
past occurrences of ground subsidence in the area proposed
for development.

C. Standards
1 . Applicants seeking a permit to develop in a regulated geologic
hazard area must demonstrate to the Board of County Commissioners
through the required map(s) and report(s) that all significant
geologic hazards to public health and safety and to property
' shall be minimized by use of mitigating techniques.

(4) In wind deposited silt (loess) areas, and areas of pre-
dominantly fine-grained colluvial soils, the amount of
wetting the area is subject to and its effect.
(5) In areas of soluble materials, the effect of wetting .
(6) In areas of underground mining, data regarding air shafts,
thaulage ways, adits, faults, rooms and pillars, and final
mine maps.
(7) Building type and proportion.
(8) Pertinent geologic and hydrologic factors of the area.
(9) Test hole and well log data.
(10) Mitigation techniques that will be employed, including
effectiveness and estimated cost of such techniques.
(11 ) Pertinent historic factors including, but not limited to,
past occurrences of ground subsidence in the area proposed
for development.

C. Standards
' 1 . Applicants seeking a permit to develop in a regulated geologic
hazard area must demonstrate to the Board of County Commissioners
through the required map(s) and report(s) that all significant
geologic hazards to public health and safety and to property
shall be minimized by use of mitigating techniques.

2. Proposals for development in a regulated geologic hazard area shall
' be designed or reviewed by a registered professional engineer, who
shall certify that the design of the proposal insures the protection
of human life and property from the adverse impact of geologic hazards
to the greatest extent possible.
3. Any construction approved by the Board of County Commissioners within
a regulated geologic hazard area must be supervised by a qualified
professional engineer. Engineering techniques to mitigate geo-
logic hazard conditions at the site must be employed.
4. Recommendations shall be solicited from the Colorado Geological Survey
on all development permit applications in which the proposed develop-
ment would be within a regulated geologic hazard area. Recommendations
must be received within twenty days after they are requested in order
to be considered by the Department of Planning Services in its recommen-
dations concerning the proposed development permit.
D. Qualifications of Investigators
1 . All geologic maps and reports required by these regulations shall be
prepared by or under the direction of, and shall be, signed by a pro-
fessional geologist as defined by Section 34-1-201 , et. seq. , C.R.S.
1973.
2. All engineering work required by these regulations shall be prepared
by or under the direction of a registered professional engineer as
defined in Section 12-25-101 , et. sea. , C.R.S. 1973.
E. Exemptions
These regulations shall not apply to land uses which do not involve any of
the following:

2. Concentrations of people, or
3. Potential hazards to human life or property.

SECTION III
FLOODPLAIN AREAS
A. Purpose and Intent
The Board of County Commissioners finds that there are, within the County
of Weld, various areas subject to flooding which may cause serious damage
' to properties and subject residents of such areas to hazards, and
' that the imprudent use and occupation of these areas will pose a con-
tinuing danger to life and property unless appropriate land use measures
' are implemented concerning the use and occupation of such hazard areas.
The purpose and intent of these floodplain regulations shall be to:
1 . Promote the public health, safety and general welfare.
2. Regulate floodplains , the use and occupation of which pose
a danger to human life and property in the absence of regu-
lation.
3. Facilitate the regulation of flood hazard areas by establish-
' ing requirements which must be met before development in such
areas is permitted.
4. Minimize hazards to public health, safety and property in flood
' hazard areas.
5. Protect the public from the burden of avoidable financial expendi-
tures for flood control projects and flood relief measures.
6. Avoid interruptions of business and commerce.
7. Minimize damages to public utilities, streets and bridges.
B. Flood lain Hazard Area Supplementary Application Requirements
Before a development permit for development in a regulated floodplain area
is issued, the Board of County Commissioners shall determine
that the proposed development has met the intent and pur-

' pose of these floodplain regulations, after considering the follow-
ing supplementary plans, maps, reports and data, which shall accom-
pany the application for such permit. Prior to submittal of an appli-
cation to the Department of Planning Services, the applicant shall
consult with the Department of Engineering Services on the form and
' content of hydrologic data to be gathered and studies to be conducted
in order to insure that adequate and appropriate information will be
' provided for review of the application by the Department of Planning
Services.
' 1 . A map(s) portraying the existing physical conditions of the area
such as surface features, topographic terrain characteristics,
drainage patterns and courses. The map information shall be deline-
ated in drawing ink on mylar or other drafting medium approved by
the Director of Planning Services. The dimensions of the map shall
be twenty-four (24) inches by thirty-six (36) inches. The map
shall be prepared at a 1 " = 100' scale and shall include the parcel
in question as well as features within 500 feet of the parcel bound-
aries. The scale of the map may be reduced or enlarged upon approval
of the Director of Planning Services. Such map shall include:
' a. A certified boundary survey of the property for which appli-
cation is made. Bearings and distances of all perimeter bound-
' ary lines shall be indicated outside the boundary lines.
b. The topography of the area at two (2) foot contour intervals
or at intervals as determined by the Board of County Commissioners
or its authorized representative.

c . The boundaries of regulated flood hazard area(s) . In all
' cases except development permit applications for Special
' Use Permits , Conditional Use Permits and Recorded Exemptions
in floodprone areas, the boundaries of the floodplain, flood-
way, and low hazard areas within the flood hazard area(s) shall be
included.
d. Existing structure and landscape features including the name
' and location of all watercourses, ponds, and other bodies of
water.
e. Proposed building locations and arrangements.
' f. A legend which includes a complete and accurate legal description
as prescribed by the development permit application form. The
' description shall include the total acreage of the surveyed parcel .
g. Certificates
(1 ) Engineer' s Certificate
' (2) Surveyor' s Certificate
h. Title, scale and north arrow.
i . Date, including revision dates if applicable.
j . Such additional information as may be required by the Board
of County Commissioners , in order to determine if the intent
1 and purpose of this regulation have been fulfilled.
2. A report detailing any calculations or hydrologic data used in prepar-
' ing the above map(s ) . The report shall also include recommended
mitigating measures to be employed in meeting the intent and purposes
' of this regulation. Other requirements of such report are listed
below:
a. Description of the proposed development to include:
' Cl ) Type and number of structures to be developed;
(2) Proposed floodproofing measures;

' (3) The size of the area and stages to be developed at
any one time;
' (4) A timetable giving the periods of time which will be
required for the various stages of the development;
(5) Water and sewage facilities; and
' (6) County roads and bridges affected.
b. Description of proposed drainage system to include: natural
' drainage ways , underground facilities, street and gutter,
retention ponds, and any other pertinent information. Appro-
llpriate construction and/or design drawings, showing typical
' sections and noting standards to be applied, shall be submitted
with the application form. Such drawings shall demonstrate
' the adequacy of facilities to handle the floodwaters.
c. All available flood elevation information. Within flood
' prone areas, the applicant shall establish flood elevations
' which determine the boundaries of floodway and low hazard areas
located in the proposed development site for all applications
' involving rezoning, subdivision and planned unit developments.
The methods and techniques used to analyze the data unique to
the area 's precipitation runoff conditions shall be noted.
' Such information shall be submitted in a form easily readable
by reviewing agencies.
' C. Standards
1 . Flood Prone Areas
' In order to minimize flood damage, development in flood-
, proneareas shall meet the following standards:

a. The storage or processing of materials which, in time of
flooding, are buoyant, flammable, explosive, or otherwise
' potentially hazardous to human, animal , or plant life shall
' not be permitted.
b. The disposal of garbage or other solid waste materials shall
not be permitted.
c. Such development shall not cause an enlargment of the flood-
plain which would cause damage to other properties.
d. All construction proposed in a development permit application
shall be floodproofed to include anchoring of structures
' where necessary to prevent flotation, collapse, or lateral
movement.
e. All public utilities and facilities, such as sewer, gas, electri-
cal and water systems, shall be located and constructed to mini-
mize or eliminate flood damage.
f. Adequate drainage shall be provided in order to reduce exposure
to flood hazards.
g. New or replacement water supply systems and sanitary sewage sys-
tems shall be designed to minimize or eliminate the infiltration
' of such systems by floodwaters.
' h. The contamination and pollution of water shall be avoided by
designing and locating on-site waste disposal systems so that
' their function is not impaired by the infiltration of floodwaters.
i . The availability of flood protection devices shall be taken into
' account in the design of the development.
j. The design of the development shall take into account the potential
impact of the development on downstream communities, such as the
' creation of obstructions during floods.

' 2. Low Hazard Areas
In order to minimize flood damage, development in low hazard areas
' shall meet the following standards:
' a. The storage or processing of materials which, in time of flood-
ing, are buoyant, flammable, explosive, or otherwise potenti-
ally hazardous to human, animal , or plant life shall not be per-
mitted.
' b. The disposal of garbage or other solid waste materials shall
' not be permitted.
c. Such development shall not cause an enlargement of the flood-
plain which would cause damage to other properties.
d. If the floodwaters on any portion of the development site will
' attain a velocity greater than three (3) feet per second,
additional floodproofing shall be utilized to protect those
structures and lands subject to such water velocity.
' e. All construction proposed in a development permit application
shall be elevated or floodproofed to at least one foot above
' the maximum water elevation of the intermediate regional flood.
All residential structures within the low hazard area shall have
' the lowest floor (including basement) elevated to or above the
' level of the intermediate regional flood. Floodproofing shall
include anchoring of structures where necessary to prevent
flotation, collapse, or lateral movement.
f. All public utilities and facilities, such as sewer, gas, electri-
cal and water systems, shall be located and constructed to mini-
mize or eliminate flood damage.

' g. Adequate drainage shall be provided in order to reduce exposure
to flood hazards.
' h. New or replacement water supply systems and sanitary sewage
' systems shall be designed to minimize or eliminate the infil-
tration of such systems by floodwaters.
i . The contamination and pollution of water shall be avoided by
designing and locating on-sitewaste disposal systems so that
' their function is not impaired by the infiltration of floodwaters.
' j. The availability of flood protection devices shall be taken into
account in the design of the development.
k. The design of the development shall take into account the potential
impact of the development on downstream communities, such as the
' creation of obstruction during floods.
3. Floodway Areas
1 All construction proposed in a development permit application shall
' be flood proofed to at least one foot above the maximum water ele-
vation of the intermediate regional flood. Floodproofing shall in-
clude anchoring of structures where necessary to prevent flotation,
collapse, or lateral movement. No development on any portion of a
floodway shall be permitted which alone, or cumulatively with other
' activities, would cause or result in any of the following:
a. The human occupation of structures for residential purposes.
' b. The storage or processing of materials which, in time of flood-
ing, are buoyant, flammable, explosive, or otherwise potentially
' hazardous to human, animal , or plant life.
c. The disposal of garbage or other solid waste materials.
d. Substantial solid debris being carried downstream by floodwaters.

e. An increase in the water surface elevation of the 100-year
flood by more than one (1 ) toot at any point.
' f. Fill or encroachments that would impair the ability of the
floodway to carry and discharge the waters resulting from
' the 100-year flood, except where the effect on flood heights
' is fully offset by physical changes in the floodplain.
g. Expansion of any existing non-conforming uses, except that
' such uses may be modified, altered , or repaired to incorporate
floodproofing measures, provided such measures do not raise
' the level of the 100-year flood by more than one (1 ) foot.
' h. New or replacement water supply systems and sanitary sewage
systems, unless such systems are designed to minimize or elimi-
nate infiltration by floodwaters.
i . On-site waste disposal systems, unless such systems are de-
lisigned to avoid infiltration by, or contamination and pollution
' of, floodwaters.
4. Where floodproofing is required, a registered professional engineer
' shall certify that the floodproofing methods are adequate to with-
stand the flood depths, pressures, velocities, impact, uplift forces
' and other factors associated with the 100-year flood, and shall sub-
mit supporting data and information.
5. All contour lines shown on maps prepared by private contractors or
' consultants shall meet the following standards of accuracy: ninety
percent (909.:) of the contour lines must be within one-half contour
interval ; the remaining contour lines must be within one contour
interval .
6. All maps submitted by an applicant seeking a development permit shall
show existing (solid lines) and proposed (dashed lines) contours of

the site within the scope of the map at an interval of not greater
than two (2) feet for those portions of the site within a regulated
' flood hazard area.
7. Recommendations shall be solicited from the Colorado Water Conser-
vation Board on all development permit applications in which the
' proposed development would lie within a regulated floodplain area.
Recommendations must be received within twenty days after they are
' requested in order to be considered by the Planning Department in
its recommendations concerning the proposed development permit.
D. Qualifications of Investigators
' All engineering work prepared under the requirements of this regulation
shall be prepared by or under the direction of a registered professional
engineer, as defined in Section 12-25-101 , et. seq. , C.R.S. 1973.
E. Exemptions
' These regulations shall not apply to land uses which do not involve any
of the following:
1 . Human habitation
2. Concentrations of people, or
3. Potential hazards to human life or property.
' Uses which would create or exacerbate flood hazard conditions on other
properties shall not be exempted.
