The property in question is located in the NZ of Section 9, T7N, R67W of the 6th P.M. The property totals 315.11 acres, and Mr. Drake ' proposes to split off a parcel of 2.944 acres. The Weld County Planning Commission staff recommends approval of this request for a Recorded Exemption for the following reasons: 1 . Section 9-2 of the Weld County Subdivision Regulations states that: "The intent in establishing the Recorded Exemption pro- cedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-productive agricul- tural lands may be developed for higher or more productive • uses, in-so-far as such uses are compatible with surround- ing agricultural uses in areas where such land divisions are proposed." The land in question is comprised of Class IV soils. The proposed lot is intended as a building site, and that use would be compatible with 'surrounding agricultural uses. 2. All requirements of Section 9-3 A of the Subdivision Regu- lations have been met and are in order. 3. The criteria for approval of a Recorded Exemption listed in Section 9-4 A of the Subdivision Regulations have been met except for Section 9-4 A 3. which reads: "That the lots resulting from the proposed land division shall be accessible from an existing public road with a minimum frontage in conformance with the Weld County Zoning Resolution." The applicant has applied to the Weld County Board of Adjustment for a variance from the requirement of 180 feet of frontage in an Agricultural district. It should be noted that there is no county road along the West side of the NZ of Section 9, T7N, R67W. Approval of this request by the Board should be contingent on said variance being approved. The First Party agrees to furnish, at its expense, a commitment for title insurance, showing a merchantable title in the First Party, subject to the matters set forth in Paragraph 3 hereof. 5.
