Conway Commissioner Julie A. Cozad Commissioner Mike Freeman - EXCUSED Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate and Frank Haug Planning Services Department representative, Kim Ogle Public Works Engineer representative, Evan Pinkham Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated July 20, 2018, and duly published July 25, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Crestone Peak Resources Holding, LLC, do Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0053, for Mineral Resource Development Facilities including Oil and Gas Support and Service (eight (8) gas compressors and related equipment) and up to five (5) construction office trailers and eight (8) conex for use during construction of the facility in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. E Chair Pro -Tern Kirkmeyer instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved. The applicant agreed to proceed. EJ Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the ten (10) acre parcel is located on County Road (CR) 14 and created by Recorded Exemption, RECX18-0083. He indicated the site is located within the three (3) mile referral area of the Cities of Brighton, Dacono, and Northglenn, and Adams County. He continued stating the City of Northglenn returned a referral response stating no concerns. Mr. Ogle stated the proposed Use will be compatible with the existing and surrounding land uses and the site will be buffered by landscaping and visual mitigation. He described the surrounding properties and stated there QSJ.PL-k.w4m ITP) ic-6l,Pw(SEt+lscl tiv)k.T3 IS%) oa!►3IIg 2018-2561 PL2578 HEARING CERTIFICATION - CRESTONE PEAK RESOURCES HOLDINGS, LLC, C/O DISCOVERY DJ SERVICES, LLC (USR18-0053) PAGE 2 are five (5) surrounding property owners (SPO) on ten (10) parcels, and indicated there was one (1) telephone call from an interested party. _= Chair Pro-Tem Kirkmeyer stated for the record that there was a change in attending Assistant County Attorneys from Bob Choate to Frank Haug, at 10:50 a.m. El Mr. Ogle continued by stating 16 referral agencies reviewed the application and two (2) returned comments which have been considered in the staff recommendation. He stated the applicant was present, and he displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. Ei Evan Pinkham, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements and stated the site accesses on County Road (CR) 19. He mentioned the latest traffic count was 805 vehicles per day with 25 percent trucks and stated after construction, there will be (1) one passenger vehicle daily round trip and two (2) semi -truck round trips weekly. Mr. Pinkham indicated Public Works is requesting a Road Maintenance Agreement during construction, and stated the applicant has submitted a Drainage Report. He stated if the applicant is disturbing more than an acre, a Grading Permit will be required. Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and stated there will be no permanent employees at the site once construction is complete. He indicated the use of bottled water and portable toilets will be deemed acceptable during and after construction and Development Standards (DS) #17-32 address Environmental Health items. El Matt Norton represented the applicant, displayed a PowerPoint presentation and explained the process of site selection for the West Brighton Compressor station. He stated the first site was too impactful to SPOs, the second site was located within an existing Regional Urbanization Area (RUA) resulting in the third choice, which is being presented today. He stated the proposed ten (10) acre site is located to the west of CR 19 and is co -located near and adjacent to other oil and gas facilities. Mr. Norton referred to images of the site location, structure layout, and the site in its entirety. In response to Chair Pro -Tern Kirkmeyer, Mr. Norton pointed out the landscaping and stated it will include some berming. In response to Commissioner Conway, Mr. Norton confirmed the landscaping was designed in consideration of the views of the SPOs by creating careful placement of low to medium height and density plantings and berming. He again referred to the map to show where the landscaping would be installed and reiterated they discussed visual mitigation with neighbors prior to designing a Landscaping Plan. a=y` No public testimony was offered concerning this matter. P. In response to Chair Pro -Tern Kirkmeyer, Mr. Norton questioned Condition of Approval (COA) #1.H regarding the Signage Plan. After further discussion, Mr. Ogle stated staff is simply looking for a sign narrative and indicated it could be submitted with the Landscape Plan. In response to Commissioner Conway, the Board agreed to delete the word "Plan" from COA #1.H, to avoid further confusion. Chair Pro -Tern Kirkmeyer requested the inclusion of "Dark Sky Standards" in COA #1.D. She also requested clarification on COA #1.A regarding the Road Maintenance Agreement. In response, Mr. Pinkham stated the applicant will be required to repair any damages along the access and any damage as a result of traffic during construction; however, there will not be a requirement for further maintenance to the intersection of CR 6 and CR 19 after construction. El Mr. Norton requested clarification concerning the Communication Plan. In response to Chair Pro -Tern Kirkmeyer, Mr. Ogle stated there were five (5) people that attended the community meeting. Chair Pro-Tem Kirkmeyer suggested deleting COA #1.E and the associated Development Standard (DS) #8 and the Board concurred. In response to Commissioner Cozad, the Board agreed there did not need to be an addition to DS #9 for the "Dark Sky Standard" because this requirement will be met through the Condition of Approval (COA) #1.D. In response to Chair Pro-Tem Kirkmeyer, Mr. Norton indicted he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. ... = Commissioner Cozad moved to approve the request of Crestone Peak Resources Holdings, LLC, c/o Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0053, for Mineral Resource Development Facilities including Oil and Gas Support and Service (eight (8) gas compressors and related equipment) and up to five (5) construction office trailers and eight (8) conex for use during construction of the facility in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
