BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
NOVEMBER 14, 2018
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, November 14, 2018, at the hour of 9:00 a.m.
CI ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

• MINUTES: Commissioner Freeman moved to approve the minutes of the Board of County
Commissioners meeting of November 7, 2018, as printed. Commissioner Kirkmeyer seconded the
motion, and it carried unanimously.
• READ ORDINANCE BY AUDIO: Commissioner Kirkmeyer moved to read Code Ordinance
#2018-09 by audio. The motion was seconded by Commissioner Conway, and it carried unanimously.
IR CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of
Hearings conducted on November 7, 2018, as follows: 1) USR18-0076 — Mountain View Fire Rescue
District, 2) USR18-0088 - Shelton Land and Cattle, Ltd, c/o DCP Operating Company, LP, and 3)
1MJUSR17-14-0059 — Albino Bustillos, Caroline Bustillos, and Cassandra Bustillos.
Commissioner Freeman seconded the motion, which carried unanimously.
IR AMENDMENTS TO AGENDA: Commissioner Cozad moved to amend the Agenda and remove
the following item from New Business: 3) Consider Agreement for Cobra Service and authorize Chair to
sign — Aetna Life Insurance Company. Seconded by Commissioner Kirkmeyer, the motion carried
unanimously.
• CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.

PROCLAMATIONS:
• 1) APPRENTICESHIP WEEK - NOVEMBER 12-18, 2018: Chair Moreno read the certificate for the
record recognizing the commitment of the Workforce Development Board and Employment Services who
are committed to the development and expansion of registered apprenticeships to support the local
workforce needs while increasing the talent pipeline. Tami Grant, Director of Employment Services,
thanked the Commissioners for the proclamation recognizing apprenticeship week. She stated they are
developing strategies to help bring classroom-based training closer to Northern Colorado. Rich Warner,
Executive Director of Economic Development and member of the Workforce Development Board,
thanked the Commissioners for the proclamation and their support. He explained the main goal is to
match employees with employers. Each one of the Commissioners thanked everyone for training the
County's workforce and stated it is also a commitment from employers and non-profits. Commissioner
Cozad stated the apprenticeship program is the most successful way to start individuals on a career path
and prepare people for the workforce. Commissioner Kirkmeyer commented on the commitment of the
Workforce Development Board to train the workforce to join the working population. (Clerk's Note: The
Board paused the meeting for a photo opportunity.)
Ei PUBLIC INPUT: Bill Gillard, resident of Greeley, expressed his appreciation to Carly Koppes, Clerk
and Recorder, for the successful outcome of the recent election process and stated Ms. Koppes' re-
election as Clerk and Recorder spoke to the good job she is doing. He stated the Commissioners need
to make sure the taxpayers' money is spent efficiently regarding County Road 29. In response to Bill
Gillard, Commissioner Kirkmeyer also thanked the Department of Information Technology for their hard
work during the recent elections. Commissioner Kirkmeyer stated she had expressed her disappointment
that the Board's decision was undermined when they applied for a million-dollar grant.
BIDS:
• 1) APPROVE BID #61800146, RICOH PRO C7110SX OR EQUIVALENT - PRINTING AND
SUPPLY: Rob Turf, Department of Purchasing, reviewed the bids received and stated staff recommends
awarding to the low bidder who meest specifications, Capital Business, in the amount of $57,685.00.
Commissioner Freeman moved to approve said bid. Seconded by Commissioner Cozad, the motion
carried unanimously.
• 2) APPROVE BID B#1800147, RISO COMCOLOR FW5230 OR EQUIVALENT- PRINTING AND
SUPPLY: Mr. Turf reviewed the bids received and stated staff recommends awarding to the low bidder,
who meets specifications, Capital Business, for a Xante En-press system for the total amount of
$13,000.00. Commissioner Cozad moved to approve said bid. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
IR 3) PRESENT BID #B1800136, CHILD WELFARE-SOUTH COUNTY VISITATION SERVICES -
DEPARTMENT OF HUMAN SERVICES: Mr. Turf presented the three (3) bids received and stated staff
will bring back a recommendation on December 5, 2018.
NEW BUSINESS:
• 1) CONSIDER APPLICATION FOR MARIJUANA TAX CASH FUNDS FOR JUVENILE DIVERSION
PROGRAM AND AUTHORIZE CHAIR TO SIGN: Kirsta Britton, District Attorney's Office, presented the
details of the continuation grant application and the previously approved 25% cash match.
Commissioner Conway moved to approve said application and authorize the Chair to sign. The motion,
which was seconded by Commissioner Kirkmeyer, carried unanimously.

2) CONSIDER CHANGE ORDER #1 FOR SOUTHWEST BUILDING DESIGN AND AUTHORIZE
CHAIR TO SIGN - MARKLEY DESIGNS, LLC: Toby Taylor, Director of the Department of Buildings and
Grounds, explained after construction was started for the Southwest Service Center, booking remodel
staff realized changes were needed to allow for an isolation cell. He stated the change order amount is
$2,450.00. Commissioner Cozad moved to approve said change order #1 and authorize the Chair to
sign. Seconded by Commissioner Freeman, the motion carried unanimously.
ki 3) CONSIDER STIPULATION OF MINERAL INTEREST AND AUTHORIZE CHAIR TO SIGN -
RICHARD BORYS: Bob Choate, Assistant County Attorney, presented the stipulation to clarify the
County's ownership of mineral interests. He stated in 1990, the County entered a purchase and sale
agreement for right-of-way, but the deed did not state the reservation of oil and gas interests; therefore,
this is a clarification that no oil and gas interest was conveyed with the deed in 1990. Commissioner
Kirkmeyer moved to approve said stipulation and authorize the Chair to sign. The motion was seconded
by Commissioner Cozad, and it carried unanimously.
ID 4) CONSIDER TEMPORARY CLOSURE OF CR 35 BETWEEN CR 70 AND STATE HIGHWAY
392: Amy Mutchie, Department of Public Works, reviewed the closure beginning November 13, 2018,
through November 16, 2018, to replace a drainage culvert. She stated the one-mile gravel detour route
is treated with magnesium chloride for dust abatement. Commissioner Freeman moved to approve said
closure. The motion was seconded by Commissioner Conway, and it carried unanimously.
ID 5) CONSIDER TEMPORARY CLOSURE OF CR 33 BETWEEN CRS 72 AND 74: Ms. Mutchie
reviewed the closure beginning November 26, 2018, through November 30, 2018, for an irrigation culvert
replacement. She stated the one-mile gravel detour route is already treated with magnesium chloride for
dust abatement. Commissioner Cozad moved to approve said closure. Commissioner Kirkmeyer
seconded the motion, and it carried unanimously.
12 6) CONSIDER PETITION FOR INCLUSION OF LANDS (SOUTHWEST SERVICE CENTER) AND
AUTHORIZE CHAIR TO SIGN - CENTRAL COLORADO WATER CONSERVANCY DISTRICT:
Bruce Barker, County Attorney, stated this is a follow up to the class C contract that was entered earlier
this year to bring property into the Central Colorado Water Conservancy District, in April, 2018, to provide
water to 5.07 acres of landscaping around the Southwest Service Center. Commissioner Conway moved
to approve said petition and authorize the Chair to sign. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
PLANNING:
1) FIRST READING OF WELD COUNTY CODE ORDINANCE #2018-09, IN THE MATTER OF
REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS,
OF THE WELD COUNTY CODE: Jose Gonzalez, Department of Planning Services, presented the
proposed changes to Chapter 29 Building Regulations. He stated one of the proposed changes will allow
a building permit to be transferred from one owner to another. Mr. Gonzalez reviewed changing the snow
load, requirement for residential and commercial construction, which came about after a study was done.
In response to Commissioner Conway, Mr. Gonzalez stated most new construction is already using the
30 pounds per square inch, for the snow load requirement. Commissioner Cozad inquired if changing the
snow load from 20 psi to 30 psi would increase the construction costs. Mr. Gonzalez stated there aren't
many engineers that use 20 psi for the snow load, but it is for the roof requirement based on the region
and how much snow we get. No public testimony was offered concerning this matter. Commissioner
Conway expressed his appreciation with the proposed change to allow a building permit to be transferred.

Commissioner Cozad moved to approve Code Ordinance#2018-09 on First Reading. The motion, which
was seconded by Commissioner Freeman, carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2018-09 was approved on First Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:33 a.m.
