THIS AGREEMENT, made at Greeley, Colorado, this fifteenth
day of June, 1956, by and between GRACE WOOD, First Party; and
ALFRED JOHNSON, Second Party; WITNESSETH: •
That First Party is the owner of the West Half (WI) of the
Southeast Quarter (SE*) , and Second Party is the owner of the
Southwest Quarter (SW.4) of Section Thirty-one (31) in Township
Seven (7) North, of Range Sixty-four (61.1.) West of the Sixth (6th)
P.M.
That for many years, the lands owned by the said parties
have been drained through a °tile along the North side of the
County Highway which extends East and West along the South bound-
. ary line of. said section. That the said tile has deteriorated
and filled, and is no longer adequate and must be replaced in
part. That it is to the advantage of both parties to this agree-
ment to rebuild and reconstruct the said drainage system.
THEREFORE,• in consideration of mutual promises and other
considerations herein expressed, IT IS AGREED:
1. That D. M. Faris, doing business under the , trade name
of Faris Concrete Products, will be engaged to lay, construct and
install Five Hundred Feet (500' ) of eighteen-inch (18" ) tile . of
No. 2 cement, at a cost of One Dollar and Seven Cents ($1.07) .
per foot, plus labor costs of One Dollar and Fifty Cents ($1.50)
per hour per man, extending westward from a point where it will
connect with a tile now there and extending eastward, the said
point being in the line of the tile and just West of the driveway
into the Finch home.
2. That said tile shall be constructed with entrance boxes
and stationary trash racks and laid upon such grade as shall be
recommended by the engineers of the Soil Conservation District office.

3. That all. joints shall be properly cemented to prevent,,
as far as possible , the clogging of the tile by the growth of .
tree roots through the joints.
4. That First Party shall 'pay to D. M. Faris one-third
(1/3) , and Second Party; two-thirds (2f3 ) of all the costs, after
deducting all amounts contributed by any persons not parties to
this agreement.
- --- 5. Conditional_upon the. parties' performing _the._terms of . -
this agreement, it is understood that Weld County will make an
adequate open ditch, extending to the West, from the end of this

tile and will open the ditch for the laying of the tile and will
backfill over the tile, after it is laid, .without any cost to • .
these parties..
6. The parties hereto,', their heirs and assigns shall be
jointly obligated to maintain said drain ditch and tile in pro-
per condition, the expense to be born proportionately to the,
expense of each party in the construction.
7. The provisions of this agreement shall be covenants
running With the lands described herein, and :shall be binding
upon and shall inure to the benefit of the heirs, personal re-
presenntatives and assigns of the respective parties hereto.

tion about the Galeton road'problem. It is our opininn that all ••

together and agree upon a solution d ut their agreement into a
detailed, written, signed. contract.

All of you hate tailed to me about your tile line along the north side
of the highway west of Walston.
I understand that you propose to ranove the tile and leave the barrow pit
open without replacing the tile or refilling the barrow pit. It will be impossible
for the County to participate in any way in this project.
So long as your plans do not injure the highway or the rights of the public
in it, I have no objection. *sever, it must be understood that this project is a
purely private and personal one and that the County and I, as County Commissioner,
have and will have no part in it. If adjoining land owners or anyothsr party or .
pasties object or are damaged, the responsibility is entirely yours and any clearance
or cooperation to be obtained by or from then is up to you. hither the County nor
I personally will assume any blame nor condone any plan which may injure or damage
any one else.

the parties hereto squally.
4. It is agreed that the entire cost of the labor and :materials
necessary to toe renovation and recou traction of said drain ditch as
rtereivabove specified, shall be paid equally by the parties _hereto, and
the parties hereto agree to deposit in escrow with The Weld County Savings
Bank of Greeley, Colorado, as escrow agent, the sum of $100.00 each as
a guarantee of prompt payment of the estimated costs, with any balance
remaining after payment of such costs to be refunded in equal amounts to
the parties hereto, or any deficiency in the amount deposited to be paid
in equal amounts by the parties hereto.
7. It is agreed that all of the work to be dons shall be under
the direct supervision of tlol.and Johnson (son of the second party) and
C. T. Carney, and that said work shall be done at a time 'men the road
overseer for Weld County, Ar. Charles still, will be present with county
machinery to do or have done the portion of the work involved which the
County of Weld, through its Board of Coas issioners, his verbally agreed to
do.
6. After said drain ditch has been renovated and reconstructed,
the parties hereto, their heirs and assign, shell be jointly obligated

at their joint expense, to maintain said drain ditch in proper efficient
condition.
• The provisions of this agreement shall be binding upon and shall
inure to the benefit of the heirs, executors, administrators end assigns
of the respective parties hereto.
