RE: EXEMPTION OF LAND TRANSFERRED BY McKAY CATTLE COMPANY TO
HOME LIGHT AND POWER COMPANY FROM THE DEFINITION OF
"SUBDIVISION AND SUBDIVIDED LAND" -- SUBDIVISION EXEMPTION
NO. 36.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, on the 24th day of January, 1977 reviewed the re-
quest of McKay Cattle Company as Sellers and Home Light and
Power Company as Purchasers for an exemption of certain lands to
be transferred by McKay Cattle Company to Home Light and Power
Company, from the definition of "subdivision" and "subdivided
land" pursuant to Section 30-28-101 (10) , CRS 1973, as amended,
and in Section 2-1 of the Weld County Subdivision Regulations,
and
WHEREAS, the Board finds that the contemplated transfer
does not conflict with the intent of the Weld County Compre-
hensive Plan and will not have an adverse impact on the existing
use of the land, and
WHEREAS, the Board has considered the recommendations of the
Department of Planning Services on this matter, and has reviewed
the information submitted by the applicant;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the transfer of certain lands located in the
Northeast Quarter of the Southeast Quarter of Section 28, Township
6 North, Range 66 West of the 6th P.M. in Weld County, Colorado,
and being more particularly described as follows :
Beginning at the SE. Cor. of Sec. 28 ,
T 6 N, R 66 W, of the 6th P.M. , in
Weld County, Colorado, and considering the
East line of said Section 28 to bear North
00°00 ' 00" West and with all other bearings
contained herein being relative thereto;
Thence North along the East line of Sec.
28 a distance of 2434. 93 feet;
Thence West a distance of 30 ,000 feet to
the true Point of Beginning;
Thence West a distance of 208 feet;
Thence North a distance of 208 feet;
Thence East a distance of 208 feet;
Thence South a distance of 208 feet to the
True Point of Beginning. Said Tract of
land contains 0. 993 acres more or less,

be and hereby is exempt from the definition of "subdivision"
and "subdivided land" as found in Section 30-28-101 (10) CRS

The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 24th
day of January, A.D. , 1977.

The owners of the follo,r ng described nronerty have requested
an exemption from Section 2-1 of the Weld County Subdivision
regulations adopted September 1972 which defines the term
subdivision :

Comments : County Road 31 is a proposed arterial in the Weld County
Thoroughfare Plan requiring 100' of right-of-way. An additional
20' of right-of-way should be preserved by setback; therefore all
structures should be set back a minimum of 70' from the existing
right-of-way on County Road 31. Additionally the development of
the proposed sub-station would be subject to the applicable regul-
ations of Weld County at the time of construction.

Re: Request for a subdivision exemption on approximately one acre of
land located in the north east corner of the SE} of Sec. 28, TON,
R66W of the 6th P.M. , Weld County, Colorado.
Dear Mr. Houtchens:
The necessary materials for the above described request are ccniplete
and in order. I have tentatively scheduled the hearing by the Board
of County Cannissioners for January 24, 1977, at 9:30 A.M. Said hearing
will take place in the County Commissioners Hearing Roan, First Floor,
Centennial Center, 915 10th Street, Greeley, Colorado.
It is recommended that you and/or a representative be present to answer
any questions the Board might have with respect to your subdivision
exemption request.
At this point I should bring to your attention the fact that County Road
31 is a proposed arterial in the Weld County Thoroughfare Plan which
requires 100 feet of right-of-way. An additional 20 feet of right-of-way
should be preserved by setback; therefore all structures must be setback
a minimum of 70 feet fron the existing right-of-way on County Road 31.
