RE: RECORDED EXEMPTION NO. 245 - LOUIS AND IDA DINNER.
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 14thday of February, 1977 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Louis and Ida
Dinner, Weld County, Colorado, more particularly described as
follows:
A tract of land located in the Northwest Quarter (Nrn) of
Section 13, Township 4 North, Range 66 West of the Sixth
Principal Meridian, Weld County, Colorado being irore particu-
larly described as follows:
Considering the West line of said Section 13 to bear North
O1°31'20" West and with all bearings herein relative thereto:
Beginning at the Northwest Corner (NW Cor) of said Section 13,
said Northwest Corner being the true point of beginning of Lot A;
Thence North 86°14'46" Fast along the North line of Section 13,
1360.79 feet to the West 1/16 Corner of Sections 12 and 13 (W
1/16 Cor Sec 12-13) ;
Thence South 01°27'56" East along the Fast line of the Northwest
Quarter of the Northwest Quarter, (NA, NWa) of Section 13, 661.38
feet;
Thence North 86°13'50" East along the North line of the South Half
of the Northeast Quarter of the Northwest Quarter (NEa, NWa) of Section
13, 831.00 feet to a point on the West right-of-way line of the
Western Mutual Ditch.
Thence South 38°32'46" West along said right-of-way line 893.61 feet
to a point on the South line of the North Half of the Northwest
Quarter (NW of Section 13;
Thence South 86°12'54" West along said South line 1615.51 feet to the
North 1/16 Corner of Sections 13 and 14 (N 1/16 Cor, Sec 13-14)
Thence North 01°31'20" West along the West line of Section 13,
1323.45 feet to the true point of beginning.
The above tract contains 49.526 acres of land including rights-of-
way for railroads and public roads,
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,

Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Louis and Ida Dinner, be
exempt from the definition of the terms, "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the
Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 14th
day of February, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 23rd day of February, A.D. , 1977.

Re : Recorded Exemption 245
Dear Commissioners :
The attached application, plat, and related items are
in reference to a request by Louis and Ida Dinner for
a recorded exemption. The parcel of land in question is
described as pt. of the NW$ of Sec. 13, T4N, R66W of the
6th P.M. , Weld County, Colorado. Said property is located
2 miles south west of LaSalle. The subject property con-
tains 49. 526 acres of Class I and II irrigated soils. The
request is to split the property into parcels of 48. 526
acres and 1. 00 acre. As indicated by Mr. Melvin Dinner
in a letter dated December 15, 1976, the purpose for
creating the one acre parcel is to provide Mr. and Mrs.
Hergert a site for the construction of a retirement home.
Mr. Raymond Hergert has been a tenant farmer for the Dinner
family for approximately 32 years. Mr. Louis Dinner desires
to give the Hergerts this one acre parcel so that they may
build their retirement home thereon.
Based upon the information submitted and the adopted policies
in the County, the Planning Staff recommends the request be
approved for the following reasons:
1 . The Town of LaSalle Planning Commission has indicated
the town has no objections and sees no problems with
the request since the proposal agrees with their
master land use plan.
2. The proposed split conforms with the intent clause of
the recorded exemption procedure (Sec. 9-2 of the
Weld County Subdivision Regulations) , the intent clause
of the Agricultural District (Sec. 3 . 3A of the Weld
County Zoning Resolution) , and the Weld County Compre-
hensive Plan since the use would be compatible with
the surrounding agricultural uses.

Re: Louis Dinner Recorded Exemption
Dear Tom:
I am enclosing herewith the following:
1. Recorded Exemption Form (Mylar) and blueprint copy.
2. Application Form for Recorded Exemption, signed by me as the
agent for and on behalf of my father and mother, Louis and Ida Dinner.
3. Check in the amount of $54.00 to cover the Application Fee in
the amount of $50.00 and recording fee for the Recorded Exemption in the
amount of $4.00 (being the rate of $2.00 per page) .
Lot B constituting 1 acre of ground, is the site where a former residence
was located on the property which was destroyed by fire. The site in
question also previously had a domestic irrigation well located at that
location as well. As a result of a fire, the residence was destroyed
and the area in the past few years has been converted to farm acreage.
Mr. Raymond Hergert, a tenant who has been farming this and other adjoining
irrigated farm properties in the Peckham area for my father and mother
for approximately 32 years, desires to construct a dwelling for himself
upon retirement and desires to utilize the location which is described
as Lot B for the construction of this residence. My father and mother
have indicated their willingness to provide this acreage without charge
to Mr. and Mrs. Hergert as a result of their consciencious efforts and
industrious and faithful devotion to their farming duties over the past
years as tenants on the Dinner farms. As indicated, the property is not
to be sold but is to be given as a outright gift to Mr. and Mrs. Hergert
for the purpose of providing them with a site for the construction of a
residence for them.
Accordingly, I would appreciate your submitting this to the Board of
County Commissioners for their approval. I would be pleased to provide
them with any additional information they would desire in connection

KNOW ALL MEN BY THESE PRESENTS: That I, Louis Dinner, a legal
resident of the State of Colorado, anticipating that a Power of Attorney
may be useful in certain circumstances, have made, constituted and
appointed, and by these presents do make, constitute and appoint my son,
Melvin Dinner, whose address is 630 Greeley National Plaza, Greeley,
Colorado, my true and lawful attorney to act in, manage and conduct all
my estate and all my affairs, and for that purpose for me and in my
name, place and stead, and for my use and benefit, and as my act and
deed, to do and execute, or to concur with persons jointly interested
with myself therein in the doing or executing of all or any of the
following acts, deeds and things, that is to say:
(1) To buy, receive, lease, accept, or otherwise acquire; to sell,
convey, mortgage, hypothecate, pledge, quit claim or otherwise encumber
or dispose of; or to contract or agree for the acquisition, disposal or
encumbrance of, any property whatsoever or any custody, possession,
interest, or right therein, upon such terms as my said attorney shall
think proper;
(2) To take, hold, possess, invest, lease, or let, or otherwise
manage, any or all of my property or any interest therein; to eject,
remove, or relieve tenants or other persons from, and recover possession
