WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 25th day of June, 1979 at the hour! of 9 :00 o 'clock a.m. for the purpose of hearing the i application' of Harry Raven for the granting of a Conditional Use Permit for a private air landing strip on the following described real estate, to-wit: A parcel of land located in the Northeast Quarter of Section 26, Township 8 North, Range 65 West of the 6th P.M. , County of Weld, State of Colorado, being more parti- cularly described as follows : Beginning at the Northeast Corner of said Section 26 and considering the East line of the Northeast Quarter of said Section 26 as bearing South 01°30 ' 27" East with all other bearings contained herein rela- tive thereto; Thence North 90°00 '00" West, along the North line of said Northeast Quarter, 50. 02 feet to the True Point of Beginning; Thence South 01°30 '27" East, 2633 .25 feet to -.a point- on -the South line of said Northeast Quarter; Thence North 90°00 '00 " West, along said South line, 60 .02 feet; Thence North 01°30 '27" West, 2633.25 feet to a point on the North line of said North- east Quarter; Thence North 90°00 '00" East, along said North line, 60 . 02 feet to the True Point of Beginning. Said described parcel of land contains 3 . 627 acres, more or less, and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a private air landing strip, and �n I � 91.1 a l to 790482 —�' ' r WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District upon the granting of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners-Of' Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a private air landing strip on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Harry Raven for a Conditional Use Permit for a private air landing strip on the hereinabove described tract of land be, and hereby is, granted subject to the development standards con- tained in the Conditional Use Permit. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated June 18 , 1979 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. The Weld County Planning Commission held a scheduled meeting on June 19 , 1979 in the Weld County Centennial Center County Commissioners Hearing Room, first floor, 915 10th Street, Greeley, Colorado. Roll Call was as follows : Chuck Carlson Present Ben Nix , Present Percy Hiatt Present Bette Kountz Present Jim Gilbert ' Present Irma White Present Frank Suckla Absent Fred Otis Absent ' Jerry Kiefer Absent Also present were: Tom Honn, Zoning Administrator Lee Morrison, Assistant County Attorney As a quorum was present the meeting proceeded as scheduled. Chairman Carlson called for a motion to 'approve the minutes of June 5 , 1979. Percy Hiatt made a motion to accept the minutes as presented. The motion was seconded by Bette Kountz. .All present cast a unanimous vote of "aye" to accept them as presented. Motion carried. SW4, Section 29, T6N, R65W LOCATION: Northeast corner of North 11th Avenue and "0" Street (County Road 64) at Mumper Hill, approximately - mile north of 'the City of Greeley DISCUSSION: The applicant has requested a continuation of this request until the City, of Greeley completes the North Greeley Study which is scheduled for 'completion in October of this year. The Planning Staff' s recommendation was for continuation of the request. MOTION: Be it therefore resolved to continue the request based on the staff ' s recommendation. NE4j Section 26; T8N, R65W LOCATION: Approximately 61/2 miles east of Pierce APPEARANCE: Ken Lind, attorney DISCUSSION: Mr. Lind stated that Mr. Raven is the landowner and was approached by Ault Aerial Applicators , Inc. who -.is involved with . agricultural spraying operations , seeding, and -fertilizing. Only one plane will be used in the operation and will operate mainly in the spring months. There are no plans for any buildings on the sit . There are no; homes closer than 3 miles, so noise will be minimal. The e being no questions at this time, Tom Honn read the staff' s recommendat on for approval and the Development Standards. Mr. Lind then stated that the Soil Conservation Service' s comments were applicable if there was going to be a hangar constructed. Discussion followed regarding water use at the site. MOTION: Be it therefore resolved to recommend approval based on the staff ' s recommendation to the Board of County Commissioners. Motion b Ben Nix, seconded by Irma White. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Jim Gilbert, Irma White, Bette Kountz, and Chuck Carl on. Motion carried. APPLICANT: Tri-State Generation and Transmission Association, Inc. CASE NUMBER: ; SUP-392 :79 :14 SUBJECT: Electric Transmission Line LOCATION : 30 miles long from northwest of Ault north to the Colorado-Wyoming Line APPEARANCE: Frank Niesen, Jim Ellis DISCUSSION: Chairman Carlson first asked Lee Morrison to explain the County' s situation in regard to this type of application. Mr. Morrison explained that it is the opinion of the County Attorney' s office that under the current regulations the County has no authority to prohibit a transmission line. The ultimate authority for allowing a transmission line lies at the State level and the County cannot completely stop the line from passing to the required points. Jim Ellis then gave the details of the need for power and why the lines are being built. This request is for the construction, replacement and maintenance of a 345 kV electrical transmission line for power from the Laramie River Generating Station to the Ault Substation. He stated that the trans- mission line will be of benefit to the transmission system as a whole in Colorado and Wyoming and also to Weld County consumers. Mr. Niesen then went into a great amount of detail bringing the Planning Commission up-to-date regarding when the project was first begun approximately nine years ago and the various permits and approvals that are required, etc. up to the present time. He also explained how the different routes were chosen and the possible effects on agriculture, the impact on vegetation,Iwildlife, economy of the area, human activity, .noise, radio-TV interference, etc. A condensed series of video tape of one hour flying time of the various routes were then shown which showed the various land uses and agricultural ground. Tom Honn then read the staff' s recommendation for the Center Route, Entry Route, and 6. 5 miles of the Substation Approach Route and the Development Standards. The Chairman then asked if anyone in the audience would like to make any comments regarding the application. At this time Norm Brown stated that he just wants them to make the best possible decision because wherever it ends up going it will involve him as he lives near the Ault Substation. Lois Jones stated that she had never been contacted at all regarding the request. Vernon Biamonte and Leo Scherrer also expressed concern regarding their property. General discussion followed. Motion by Percy Hiatt, seconded by Bette Kountz. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Irma White, Bette Kountz,! and Chuck Carlson. A vote of "no" was cast by Jim Gilbert. Motion carried. SUBJECT: Consider a recommendation on proposed amendments to the Weld County Zoning Resolution which will clarify the duties and responsibilities of the Department of Planning Services, the Planning Commission, and the Board of County Commissioners in actions concerning amendments to the map of the Zoning Resolution DISCUSSION: Thom Rounds, Planner for the Planning Department, stated that this was adopted on June 23 by the Planning Commission. During the time thatit was recommended to the Board of County Commissioners and actual actionitaken by them, the Department of Planning Services staff went back through the Amendment section and found some items that they feel needed to be changed, but these changes were not able to be made at the time of the Board of County Commissioners action. There were some language in the Statute that they were not comfortable with. The best way was to come before the Planning Commission and recommend additional amendments . He then briefly explained the recommended changes . One change was recommending that mineral rights owners as well as surface owners of land be notified of any proposed change of zone on the property. A great deal of discussion followed regarding this. Several member's of the Planning Commission were opposed to this notification of mineral rights holders. MOTION: Be it therefore resolved to table the request until such time as the Board of County Commissioners make a positive step in the area of taxaction of severed mineral rights to the next regular Planning Commission meeting. Motion by Jim Gilbert, seconded by Ben Nix. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Jim Gilbert, Irma White, Bette Kountz, and Chuck Carlson. Motion carried. SUBJECT: Consider a recommendation on the repeal of Section 4. 5(3) of the Weld County Zoning Resolution which requires the annual renewal of sign permits in June of each year DISCUSSION: Gary Fortner, Director of Planning, read Section 4. 5(3) of the Weld County Zoning Resolution regarding the general sign requirements and their annual renewal. The staff is recommending that this be deleted from the Zoning Resolution because the Planning Staff has no basis for requesting the Irenewal of signs and paying a fee on an annual basis. General discussion 'followed. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff' s recommendation. Motion by Irma White, seconded by Bette Kountz. A vote of "aye" was cast by Percy Hiatt, Ben Nix,ll Irma White, Bette Kountz, and Chuck Carlson. A vote of "no" was cast by Jim Gilbert. Construction Of the landing strip shall conform to Federal Aviation Administration standards and/or regulations regarding air safety and any other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 3. The Conditional Use Permit area shall be maintained in such a manner so as to ,prevent soil erosion, fugitive dust, and the growth of noxious weeds. . • 4. All phases of the operation shall comply with all County, . State and Federal Health Standards and Regulations pertaining to air quality, water quality, noise emission and appropriate disposal systems. • 5. The appearance of the Conditional Use 'Permit area shall be maintained in a neat and orderly condition. 6. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Conditional Use Permit by the Planning Commission and Board of County Commissioners, before such changes from the plans and/or Development Standards shall be permitted. The principal operation is the construction and operation of an airstrip in the Northeast Quarter of Section 26 , Township 8 North, Range 65 West of the 6th P .M. , Weld County , Colorado . Due to the location and type of land for the airstrip , very minimal strip work is required , and the location allows Ault Aerial Applicators , Inc. to operate in an area in which many of the agricultural customers are located , thus allowing efficient and economical operations with quick turn-arounds for refueling and loading chemicals , and reducing ferry time , all of which result in cheaper costs to agricultural customers . As the proposed area is located northwest of Ault , this type of operation will produce minimal air pollution , no water pollution , odor , glare , fire or traffic congestion . The only air pollution will be that related to aircraft operation , and noise will be reduced as the aircraft owned by Ault Aerial Applicators is a Piper Pawnee which is one of the most quiet agricultural aircraft on today' s market , and produces no more noise than a modern farm tractor . The takeoff and landing corridors are not located over any type of improvements . In fact , the nearest home is located one mile to the west and the next closest homestead is 12 miles to the east . All takeoffs and landings will be from north to south and the closest improvements which would be underneath the takeoff or landing corridor are more than 2 miles away, which should produce no noise or safety dangers tir Weld County Planning Commission May 8 , 1979 Page 2 for those homesteads . Waste disposal related to aerial applications consists of empty combustible and noncombustible chemical containers . To promote good environmental practices through proper disposal and storage techniques for excess pesticide and pesticide related wastes , Ault Aerial Applicators , Inc . will strictly follow the guidelines established by the Hazardous Waste Management Section of the State Department of Environmental Control , and all pesticide manufacturer ' s disposal instructions . It is proposed that noncombustible containers will be rinsed with the rinse water used in the spraying operations as a spray dilutant. Large containers such as 30 and 55 gallon drums will be returned to the manufacturer, formulator or distributor for recycling or reuse . Small rinsed containers shall be punctured , crushed and buried in sanitary landfills , and due to the rinsing , there should be no harmful chemical residue . Combustible containers such as boxes or bags will be cut into pieces and taken to sanitary landfills for burial or burning in accordance with the then existing waste and pollution laws . As the specific location for this airstrip is far removed from the populated areas , it is expected that any adverse environmental consequences will be held to a bare minimum. Wj LA Greeley, Colorado 80631 This letter is in answer to your request for soil and site information for the construction �of an air strip in the NE; of Section 26, Twp. 8N, Range 65W, Weld County, Colorado. r. There are four soil types found in that area: 1) Olney loamy sand, 0 to 3 percent slopes (49) , 2) Renohill loam, 0 to 5 percent slopes (57) , 3) Vona loamy sand, 3 to 9 percent slopes (75) , 4) Olney fine sandy loam, 6 to 9 percent slopes (53). Please refer to attached soils map and soil descriptions for complete information. The only interpretative data that might relate to air strip construction is information on street and road construction. Both Olney soils and Vona soils have a moderate':limitation for streets and roads as both exhibit a low strength characteristic which may cause holes and settling under load conditions. The Renohill soil has' a severe limitation for streets and roads due to low strength and a shrink swell potential which may cause heaving whenever wetted or cracks whenever dried. I do not know the precise area where the strip is to be located, therefore, I am not sure what soil type will be most affected. However, in light of the above information, it may be best to have a qualified soil engineer analyze the area to provide proper construction details to avoid later problems. When range condition deteriorates , sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site 'as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. The subsoil is yellowish brown heavy clay loam about 14 inches thick. The substratum is light yellowish brown calcareous clay loam. Available water capacity is mod— erate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. This soil is suited to limited cropping; intensive cropping is hazardous because of wind erosion. The cropping system should be limited to close grown crops such as alfalfa, wheat and barley. The soil also is adapted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by corn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grow-u crops may be irrigated from closely spaced contour ditches or sprinklers. Contour furrows or sprinklers should be used- for new Lai crops. The substratum, to a depth of 60 inches, is calcareous fine sandy loam. I Permeability is moderate. Available water capacity Is moderate . Effec- t I tive rooting depth is 60 inches or more. Surface runoff is medium and `•t`'?4 erosion hazard is low. . Where irrigated this soil is suited to the commonly grown crops in the I area. However, perennial grasses and alfalfa or close grown crops should belgrown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows , ' contour furrows and cross slope furrows will work on row crops . Sprinkleriirrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility Iiaintenance is important. Crops grown on these soils respond to fertili er applications of phosphorous and nitrogen. In non-irrl.gated areas this soil is suited to winter wheat , barley and sorghum. Most of the area is devoted to winter wheat which is alternated al , with summer fallow to allow moisture accumulation. Normally, precipi- tation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terracing 'may also be needed to control water erosion.
