RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR JUSTICE ASSISTANCE
GRANT (JAG) AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for the
Justice Assistance Grant (JAG) between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriffs
Office, and the City of Greeley, commencing upon full execution, with further terms and conditions
being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for the Justice Assistance Grant (JAG)
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Sheriffs Office, and the City of
Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 15th day of August, A.D., 2018.

Weld County Sheriff's Office Proposal for COMMUNICATIONS Purchase
with 2018 Formula JAG funds; Total Award of $13,152.00
The total 2018 JAG award allocated to the Weld County Sheriff's Office is $13,152.00. The
Sheriffs Office would like to utilize the JAG funds to purchase up to four (4) additional radios
for newly hired inmate transport deputies within Weld County.
Project Identifiers and Cost Summary:
COMMUNICATIONS: Each radio and associated equipment for a deputy can cost between
$3,200 and $4,800 each, depending on the necessary set up for the deputy's duties. The Weld
County Sheriffs Office is asking to purchase up to four (4) additional radios and associated
equipment (batteries, antenna, microphones, etc.) using a total of $13;152 of JAG dollars, and
any additional will be paid for by the Sheriffs Office.
Justification:
The Weld County Sheriffs Office is required by Colorado Revised Statute to operate and
maintain a secure jail facility, and part of that requirement is to hold inmates from other
jurisdictions within the county. The Sheriffs Office is opening a new inmate booking intake area
in the Southwest region of the County, and part of that project includes hiring seven positions to
ensure it is properly staffed each day. Due to the limited resources in the budget request, the
Sheriffs Office only asked for three (3) radios to be shared by these new positions. The grant
funding would allow for an additional four (4) radios to be available for staffing, and will ensure
that each deputy has the appropriate supplies needed to do the job required. This project is not
budgeted, and complies with current JAG rules and regulations.

Department for FY2018-FY2019

Brief description of the problem/issue:
The Bureau of Justice Assistance will award $59,580 to the Greeley Police Department and to the Weld
County Sheriff's Office through the Edward Byrne Memorial Justice Assistance Grant (JAG). The Sheriff's
Office portion of the formula -based award is $13,152. The City of Greeley is the fiscal agent for the grant and
will complete all necessary reporting requirements, and issue us the reimbursement of these dollars once spent
on eligible projects.
As in past years, a Memorandum of Understanding is needed between the City of Greeley and the Weld
County Board of County Commissioners to memorialize the division of funds. Historically the Sheriff's Office
has spent JAG grant funds on equipment needs. This year, the JAG monies will be used to supplement the 2019
budget for additional radios. With the multiple positions being requested, the Sheriff's Office did not ask for
enough radios to keep operating expenses as low as possible for the 2019 request.
Due to the short turnaround for this grant application, and the multiple years it has been in place, we are
asking for approval of the request as it meets the JAG requirements, does not supplant existing budget requests,
and would be an additional asset to the Sheriff's Office. The MOU is being reviewed by the County Attorney's
Office as well.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
1) Authorize Chair to sign the MOU and receive the $13,152 from the JAG by partnering with Greeley.
2) Request more information and schedule a work session.
3) Refuse to enter into the MOU, causing the forfeiture of these dollars for FY2018.
Recommendation:
We recommend the Board of County. Commissioners authorize the Commissioner Chair to sign the MOU with
Greeley to receive the JAG funds as designated by the Bureau of Justice Assistance. Thank you.

MEMORANDUM OF UNDERSTANDING
I'IIIS MINIORANDUM OF UNDERSTANDING is made this /5111 day of
, 2018, by and between THE CITY OF GREELEY, COLORADO and THE
WELD OUNTY BOARD OF COUNTY COMMISSIONERS, COUNTY OF WELD,
COLORADO.
WHEREAS, the Bureau of Justice Assistance has provided joint funding that is available
to both the City of Greeley and Weld County; and
WHEREAS, the funding that is being provided by the Bureau of Justice Assistance is in
the total amount of $59,580; and
WHEREAS, the City of Greeley Police Department will be the Fiscal Agent for the grant
and will initially receive the total grant award of $59,580; will remit the amount of $13,152 to
Weld County as the Sheriff's Office portion of the grant award; and, will retain the amount of
$46,428 as the City of Greeley Police Department's portion of the award.
WHEREAS, as with previous funding, both agencies have determined that they have
different needs and uses for the funds being made available; and
WHEREAS, this Memorandum of Understanding provides for the division of funds being
made available; and
WHEREAS, the parties wish to reduce their understanding to writing.
THE PARTIES HEREBY AGREE AS FOLLOWS:
I) Upon receipt of the total funding amount of $59,580, the Greeley Police Department
(Fiscal Agent) will pay the sum of $13,152 to the Weld County Sheriff's Office as and for the
Weld County's portion of the Edward Byrne Memorial Justice Assistance Grant (JAG) formula
program.
2) The remaining sum in the amount of $46,428 will be retained by the City of Greeley as
and for the Greeley Police Department's portion Edward Byrne Memorial Justice Assistance Grant
(JAG) formula program.
3) The financial reporting to the Bureau of Justice Assistance will be maintained by the
Greeley Police Department (Fiscal Agent) with each party maintaining a financial and operational
record of their respective portions of the program and in compliance with the Federal Financial
Guide, the parameters of the grant and any special conditions as noted in the SOGA award. The

request by the Department.
