Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated November 13, 2018, and duly published November 19, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Anna Hill, do Outrigger DJ Operating, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0104, for Mineral Resource Development Facilities including Oil and Gas Support and Service, including six (6) gas compressors and related equipment, one (1) up to seventy (70) feet in height secure communications tower, and up to five (5) construction office trailers and ten (10) conex containers for use during the construction of the facility in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. IR (CLERK'S NOTE: Chair Pro-Tem Kirkmeyer instructed the applicant and reviewed for the public, with two (2) of the five (5) commissioners being excused, the vote must be unanimous for the case to be approved. Cody Kerrigan, applicant's representative, indicated he would like to proceed with the hearing as scheduled. See HE18-142 for audio recording.) Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the site is approximately 20 acres created by Subdivision Exemption, SUBX18-0034. He described the adjacent County roads and stated the site is not located within the three (3) mile referral area of any municipality or county. He indicated there are eight (8) property owners and cc-: PLC KO/TP). Mr. Ogle stated Planning Staff did not receive any correspondence concerning the application, and described the surrounding USRs. He stated Outrigger is expanding their operations and the proposed facility will compliment the previously approved gas plant. He mentioned the facility is unmanned and will contain six (6) compressor stations, a communication tower, and intersecting pipelines for the purpose of gathering raw natural gas and preparing it for compression. Mr. Ogle stated the applicant will implement the Dark Sky Policy for site lighting, and the site will be fully fenced, with the area inside the fence surfaced with gravel and grated, and the area outside of the fence revegetated in native grasses. He described the site and surrounding properties and indicated 11 agencies have reviewed the application and two (2) agencies offered comments, with specific conditions that were addressed in the staff recommendation. He provided images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. • Hayley Balzano, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, and stated the application is proposing a new access point that meets the spacing criteria off of County Road (CR) 95. She mentioned there are no traffic counts available and indicated, after construction, there will be one (1) to two (2) daily round trips. She stated Public Works is requiring a Drainage Report and a Road Maintenance Agreement during construction, and presented the drainage and grading requirements. • In response to Chair Pro-Tem Kirkmeyer, Mr. Ogle indicated the closest residence is approximately a half mile away and mentioned other nearby residences. el Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and reiterated there will be no employees at the site once construction is complete. He indicated during and after construction, bottled water and portable toilets are acceptable, and stated Development Standards (DS) #18-33 address Environmental Health (EH) items. He mentioned due to the proximity of neighbors, a commercial noise standard has been placed on the facility. • Cody Kerrigan, Outrigger DJ Operating, LLC, stated the application is for the Koki Compressor Station and described the use of the facility to prepare raw natural gas for processing. He indicated the compressor station is unmanned and mentioned operators will check in as needed. He further stated operators will be able to access the compressor station control station from any remote location and indicated emergency contact information will be provided on station signs. • No public testimony was offered concerning this matter. • In response to Chair Moreno, Mr. Kerrigan indicated they had reviewed the Conditions of Approval and Development Standards, as presented; however, he indicated DS#34 is a duplicate of #8 and requested clarification regarding the omitted language regarding the right to extract mineral resources. The Board agreed to delete DS #34 and inserted the "Right to Extract" typical language as a new DS#40. He corrected the applicant's name in criteria paragraph#2.F to state, 2018-4077 PL2621 HEARING CERTIFICATION - ANNA HILL, C/O OUTRIGGER DJ OPERATING, LLC (USR18-0104) PAGE 3 "Outrigger DJ Operating, LLC" rather than "Outrigger DJ Services, LLC", and the Board agreed to the change. 1--- In response to Commissioner Cozad, Mr. Ogle clarified the meaning of DS #6 regarding pasture grass restoration. Commissioner Kirkmeyer requested additional language regarding the Dark Sky Policy in DS #8, and the Board agreed. In response to Chair Moreno, Mr. Kerrigan indicated they had reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Ei Commissioner Cozad moved to approve the request of Anna Hill, do Outrigger DJ Operating, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0104, for Mineral Resource Development Facilities including Oil and Gas Support and Service, including six (6) gas compressors and related equipment, one (1) up to seventy (70) feet in height secure communications tower, and up to five (5) construction office trailers and ten (10) conex containers for use during the construction of the facility in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 11:55 a.m. This Certification was approved on the 26th day of December, 2018.
