As the leases shown above are secondary spaces with primary space typically leasing at a higher rental rate, Petitioner determined an overall rental rate, including both primary and secondary space, of $12 per square foot triple net is appropriate. Petitioner found vacancy ranged from 13% to 18%. Petitioner applied a 15% vacancy adjustment and an expense allowance of 10% to cover reserves for capital replacements; management fees; legal and accounting; and similar landlord non -reimbursable expenses. Petitioner reviewed the Summer 2014 Burbach and Associates, Inc. Real Estate Investment Survey and found capitalization rates ranged from 7% to 9.5% for Suburban/Low Rise Office. The Property is larger in size than the typical market standard bank property and, as such, would present a higher risk in the market place. Based upon market conditions as of June 30, 2014, we have capitalized our Net Operating Income at 9.5%. For commercial buildings more than 10 years old it is difficult to accurately estimate the amount of physical depreciation to apply. For this reason, a cost analysis was not developed. Market Approach: A search for sales of similar properties during the extended data collection period of 7/01/2009 - 06/30/2014 revealed two sales. #1 at 2425 35t11 Ave., Greeley (formerly New Frontier Bank) sold 8/1/12 for $2,525,000 or $179 sq. ft. It was a pleasure speaking with you, and I hope we are able to resolve this issue regarding our office not receiving notice of the BOCC hearing determinations relating to the abatement cases we have outstanding for calendar years 2015 and 2016 for the below -referenced schedule numbers. Per your request, I have included a brief outline of the series of events leading up to our call yesterday (see below my signature line). I have also done some additional research relating to the statutory law I referenced yesterday in our phone conversation. CRS 39-1-113(5) addresses notice with respect to abatement hearings; however, I do not see explicit language with respect to notice flowing from BOCC determinations. I do note, however, that the language is virtually identical to that of CRS 39-8-107(2)(b), which, though addressing protests, explicitly references the Board of County Commissioners as an acting party. My goal is simply to see if we can remedy the issue wherein we may obtain from the County revised Notices of Determination with a new date so that we may appropriately appeal the determinations to the Board of Assessment Appeals. No directive was provided to Weld County indicating that email notice alone to the taxpayer's agent was sufficient; as such, it is our contention that notice should have been mailed to our office, which it was not. However, to protect our client's interest, we plan to file an appeal to the BAA tomorrow, given 30 days from the date at which we "received" notice by way of our inquiry is this coming Friday, September 28th. While I recognize it may likely take your office longer to research and address the issues presented herein, as well as the likelihood that the BAA may reject our petition based upon the date of the documents sent by 1 Chloe on August 29th, I want to create a record and ensure we are acting in accordance with the legal requirements to the best of our abilities. (Note - this hearing did not occur within the six month timeframe as required under CRS 39-1-113(1.7)) June 22, 2018 We were informed on August 29th (see below) that Chloe emailed the two denial decision letters on Account Numbers R2941304 and R1358002 to Lieth Khatib's email. Our office was unaware of this information being forwarded and did not receive hard copies in the mail which we typically do see hard copies followed up in the mail. Our client did receive these denials via mail. The documentation for the third account number (which was a partial reduction) for Account Number R0840701 was not sent. Our client did not receive this information either. July 9, 2018 Lieth's email deactivated and there was no longer an auto reply being sent out. August 28, 2018 We began to review all of our outstanding cases and proceeded to follow up with the necessary counties for status. Nina Langston emailed Chloe to follow up on the status of the decisions for the three schedule numbers since we were unaware of the emailed information on June 22nd due to Lieth not being employed by Sterling and an auto reply being created. August 29, 2018 Chloe forwarded via email the decisions for the three account numbers (two denials and one partial reduction) to Nina in response to her inquiry. Since all of these documents were dated back in June, Victoria called Chloe to discuss the instruction sent out from Lieth's email for information to be forwarded to another employee within Sterling's organization. Chloe had stated she had not received any "bounce backs". We have emails sent from Lieth's email to show during that time frame the auto response was in fact active and the response should have been received by Chloe on June 22nd when she originally sent two of the three documents. 3 August 31, 2018 Victoria reached out to client to verify if any documentation was received by our client. As stated above, they received the two denials via mail but have no record of the outcome of the partial reduction. Sterling's Plan of Action in the absence of sufficient notice: Sterling will file these three account numbers to the Board of Assessment Appeals using the date of notice of determination as the date we were informed of the decisions, which was August 29, 2018. First, you stated that the abatement hearing on these cases did not occur within the six month timeframe required by C.R.S. §39-1-113(1.7). I agree that the petition was dated November 15, 2017 and received by the Assessor's Office on November 16, 2017. See Resolution 2018-1884, p. 3, attached. However, the abatement hearing was scheduled within six months, on May 14, 2018. It was the taxpayer's agent, Mr. Khatib, who requested a continuance of the hearing to June 18, 2018. The Board of County Commissioners granted that request. See Resolutions 2018-1548, 2018-1549 and 2018-1550, attached. Therefore, there was no violation of the six-month limitation. Second, you indicated that the only notice of the abatement denial was sent by email from Ms. Chloe Rempel to Mr. Lieth Khatib on June 6, 2018, whose auto -reply indicated that all email correspondence should be sent to Desiree Fox. However, although Ms. Rempel sent a courtesy email to Mr. Khatib, she also mailed notice of the denials to the taxpayer, USPS Certified, and mailed notice to the agent, USPS regular, at the same time. See Resolution 2018-1884, pp.31-33; Resolution 2018-1885, pp. 28-30. Finally, when we spoke on the phone you mentioned that the Clerk to the Board had not sent notice related to the Board's determination of the third abatement protest, case number R0840701. The Board granted the abatement appeal in part, but it does not appear there was any notice sent. Therefore, the Clerk to the Board has now mailed notice to you. A courtesy copy is provided with this letter. In regards to case numbers R2941304 and R1358002, the Clerk to the Board has already issued notice, and therefore respectfully declines to issue a new notice.
