RE: GRANT APPEAL OF THE DECISION BY THE DEPARTMENT OF PUBLIC WORKS TO
DENY AN ACCESS PERMIT FOR PLANNED UNIT DEVELOPMENT FINAL PLAN,
PUDF18-0001, SERENITY VIEW ESTATES - H & K INVESTMENTS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Sections 2-4-10 and 5-4-155 of the Weld County Code, the Board
of County Commissioners considered the appeal of the decision by the Department of Public
Works to deny an Access Permit for Planned Unit Development Final Plan, PUDF18-0001,
Serenity View Estates, submitted by the appellant, H & K Investments, LLC, and
WHEREAS, the Board heard testimony and took evidence from the Departments of Public
Works and Planning staff and appellant, H & K Investments, LLC, and
WHEREAS, upon consideration of such appeal, including a review of all information
submitted by the appellant and the Departments of Public Works and Planning Services, the
Board deems it advisable to grant the appeal of H & K Investments, LLC, reverse the decision of
the Department of Public Works, and direct staff to issue an Emergency Only Access Permit for
Planned Unit Development Final Plan, PUDF18-0001, Serenity View Estates.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the appeal of H & K Investments, LLC, be, and hereby is, granted, and the
decision of the Department of Public Works to deny an Access Permit for Planned Unit
Development Final Plan, PUDF18-0001, Serenity View Estates, is reversed, with direction to staff
to issue said Emergency Only Access Permit.

SUBJECT: Appeal of Access Permit Denial for Serenity View Estates
On October 18, 2017 the Board of County Commissioners (BOCC) reheard and approved with conditions
a change of zone (COZ) case, PUDZ17-0005. A change of zone (PZ1131) had originally been approved
on November 19, 2008 conditional on recording the change of zone plat. Recording of the plat never took
place. Weld County staff then received a letter dated June 13, 2017 that requested a paving variance as
ownership of the property had been transferred. This letter is what triggered Planning Services staff to
bring the case back before the BOCC (PUDZ17-0005). When the BOCC was presented the case for the
COZ, only one access point was clearly indicated. As the project was moving forward with the referral
process the Planning Services Engineer requested on December 15, 2017 that the emergency access be
removed from the COZ map as it was not in the original proposal. The map for PUDZ17-0005 was recorded
on February 14, 2018 in which the access had been removed with the exception of it being shown on page
two, grading plan sheet, in error.
On February 28, 2018 a map for PUDF18-0001 was sent out for referral comments and did not include a
second access point. On March 28, 2018 Public Works (PW) staff submitted a referral to Planning Services
requesting that the one access shown be moved 30 feet to the east in order to align with an existing access
point on the south side of WCR 84. This 30 -foot move would require the relocation of an overhead electric
pole which the owner/applicant agreed to accommodate. On March 29, 2018, Poudre Fire Authority (PFA)
submitted a referral to Planning Services. The referral in whole is attached but some specific language is
as follows:
"This development falls within the jurisdictional boundaries of Poudre Fire Authority and is subject to
compliance with the 2015 International Fire Code (IFC) as locally adopted or amended. The following Fire
department comments are provided so as to enable the applicant to submit a successful site plan. These
comments shall remain active until acknowledged and resolved by the applicant.
In applying these minimum fire lane standards to this development:
• The dead-end road with an approximate overall length of 1,820' will trigger requirements for a
second (and third) point of access. In lieu of providing additional access points, the fire marshal
will approve the existing plan with the addition of residential fire sprinkler systems for all lots
beyond 660' as measured from the centerline of CR 84 (This will affect Lots 3-9). The applicant is
required to respond with intent to provide additional access to the development or install residential
sprinkler systems in the affected lots. This note shall be added to the Plat."
PW staff received an official access permit application dated April 9, 2018 requesting an access to the
property. Through discussions with PW staff the applicant submitted a variance request letter on April 24,
2018 and a revised access permit application requesting two access points on May 7, 2018. PW denied
the request of variance due to this item not being addressed when the case originally went to the BOCC.
Weld County Code sections that may be applicable:
Weld County Code 27-2-20, Access Standards, all PUD developments will be served by an internally paved
road system according to County standards. An exception to paving may be granted by the Director of
Public Works for residential PUDs of nine (9) lots or less located in nonurban areas as defined in Chapter
22 of this Code, when the PUD is not located within close proximity to other PUDs, subdivisions and
municipal boundaries, and when access to the PUD is not from a public road which is paved or will be
paved within a year of approval of the PUD.

The BOCC waived, per Resolution, the paving requirement to the internal road system during the November
hearing.
Weld County Code 12-5-30, Regulation of access onto County Roadways:
12-5-30.D — Emergency Access Allowed. Police, fire, ambulance and other emergency providers may
have direct access to County roadways if no other access is permitted.
12-5-30.1— Access permit a condition of a land use case. When a new or existing access is to be utilized
in conjunction with a land use case, the issuance of an Access Permit shall be a condition for obtaining
approval. The granting of the Access Permit may be conditioned upon the applicant signing an
Improvements and Road Maintenance Agreement, if applicable. A "land use case" may include, but not be
limited to, applications seeking approval for use of property under the processes listed in Chapter 23 of this
Code, division of properties, pursuant to the procedures found in Chapter 24 of this Code, or Planned Unit
Development through processes detailed in Chapters 23 and 27 of this Code.
Staff performed a site visit of the property and finds that the proposed access points, main and emergency,
both along WCR 84 east of WCR 15 would meet both spacing and site distance criteria if approved. Public
Works Staff requests a determination by the BOCC based on the lack of clarity and materials submitted
throughout the process.
WCR 84 is a local road with 60' of right-of-way as identified on the County's functional classification map.
The ADT is 85 with 15% of the vehicles per day being trucks.

I am requesting to appeal the Weld County Public Works decision to deny an Emergency Access to
Serenity View Estates. I wish to go before the Board of County Commissioners for resolution to this
request based on the following variance request.
This variance letter is intending to address the request for an Emergency Access onto Weld County Road
84 for the Serenity View Estates project. The Poudre Fire Authority is requiring a second access into the
above -mentioned site. We would request that this access be granted at the end of the private road
Serenity View Way. An emergency access would be approximately 700 feet to the East of the main
entrance to the subdivision.
The use of this access would be for the sole use of the Poudre Fire Department and would be equipped
with gates and Knox Box key held only be the authority. No private use of this access would be allowed.
We are very close to Final Plat recording on this project and final administrative review. Any expedited
communication regarding this request would be greatly appreciated.

This development falls within the jurisdictional boundaries of Poudre Fire Authority and is subject to
compliance with the 2015 International Fire Code (IFC) as locally adopted or amended. The following
Fire department comments are provided so as to enable the applicant to submit a successful site plan.
These comments shall remain active until acknowledged and resolved by the applicant.
FIRE LANES
Fire access is required to within 150' of all exterior portions of any residence within the development as
measured by an approved route around the building perimeter. In order to successfully achieve
minimum fire access requirements to the properties at this site, the private road is required to be
dedicated to its fullest extent as an Emergency Access Easement (EAE) and minimum fire lane standards
shall apply (see below). The EAE may be dedicated with the Plat or by separate document.
If residences are fully accessible to within 150' as measured from the private road, additional fire access
requirements may not apply; however, extended setback distances may require individual driveways to
meet minimum fire lane requirements. In such a circumstance where minimum access cannot be met,
residential fire sprinkler systems may be required to offset fire lane deficiencies. Such information shall
be added to the Plat and supporting documents to inform property owners of their responsibility to
install a sprinkler system where fire access standards cannot be met.

➢ IFC 503.1.1: Approved fire Lanes shall be provided for every facility, building or portion of a
building hereafter constructed or moved into or within the jurisdiction. The fire apparatus access
road shall comply with the requirements of this section and shall extend to within 150 feet of all
portions of the facility and all portions of the exterior walls of the first story of the building as
measured by an approved route around the exterior of the building or facility. When any portion
of the facility or any portion of an exterior wall of the first story of the building is located more
than 150 feet from fire apparatus access, the fire code official is authorized to increase the
dimension if the building is equipped throughout with an approved, automatic fire -sprinkler
system.
FIRE LANE SPECIFICATIONS
In addition to the design criteria already stated above or contained in relevant standards and policies,
any new fire lane must meet the following general requirements:
➢ Shall be dedicated as an Emergency Access Easement.
➢ Maintain the required 20 foot minimum unobstructed width & 14 foot minimum overhead
clearance. Where road widths exceed 20' in width, the full width shall be dedicated unless
otherwise approved by the AHJ.
➢ Be designed as a flat, hard, all-weather driving surface capable of supporting 40 tons.
➢ Dead-end roads shall not exceed 660' in length without providing for a second point of access.
Dead-end fire access roads in excess of 1320' in length require a third point of access.
➢ Dead-end fire access roads in excess of 150 feet in length shall be provided with an approved
area for turning around fire apparatus.
➢ The required turning radii of a fire apparatus access road shall be a minimum of 25 feet inside
and 50 feet outside.
➢ The limits of the fire lane shall be fully defined and be visible with "No Parking -Fire Lane"
signage. Sign locations shall be labeled on final plans. Refer to Lorimer County LCUASS details
#1418 & #1419 for sign type and placement standards. Appropriate directional arrows required
on all signs.
In applying these minimum fire lane standards to this development:

• Fire lanes are required to be constructed of a hard surface (eg. concrete, asphalt). Any deviation
from minimum standards (eg. request to install gravel road base) will require special review and
approval by the fire marshal in conjunction with a structural engineering report. No matter the
road surface, all required fire access roads shall be engineered to support 40 tons.
SECURITY GATES IN GATED COMMUNITIES
If applicable now or in the future, any gate across a designated fire lane shall trigger specific
requirements relevant to obstruction of a fire lane and additional review shall be required for approval.
This note shall be added to the Plat or included in the HOA agreement.
Code language provided below:
➢ IFC 503.6: The installation of security gates across a fire apparatus access road shall be approved
by the fire chief. Where security gates are installed, they shall have an approved means of
emergency operation. The security gates and the emergency operation shall be maintained
operational at all times.
➢ IFC O103.5: Gates securing fire apparatus access roads shall comply with all of the following
criteria:
1. The minimum gate width for vehicle access shall be 20 feet.
2. Gates shall be of the swinging or sliding type.
3. Construction of gates shall be of materials that allow manual operation by one person.
4. Gate components shall be maintained in an operative condition at all times and replaced or
repaired when defective.
5. Electric gates shall be equipped with a means of opening the gate by fire department
personnel for emergency access. Emergency opening devices shall be approved by the fire
code official.
6. Gate design and locking device specifications shall be submitted for approval by the fire code
official prior to installation.
7. Electric gate operators, where provided, shall be listed in accordance with UL 325.
8. Gates intended for automatic operation shall be designed, constructed and installed to
comply with the requirements of ASTM F 2200.

A hydrant is required within 400' of any Residential Building as measured along an approved path of
vehicle travel. Fire hydrants shall be of a type approved by the fire department and local water utility
provider.
By installing three (3) hydrants with the capability of providing 800 gpm at 20 psi residual pressure, the
proposed utility plan appears to satisfy minimum code requirements and no other action need be taken
if all hydrants are on a public system. If hydrants are to be on a private system, a written testing and
maintenance plan shall be submitted for approval and implemented by the HOA. PFA requests
confirmation of private vs. public water system.
➢ IFC 507.5.5: A 3 -foot clear space shall be maintained around the circumference of fire hydrants
except as otherwise required or approved.
PREMISE IDENTIFICATION: ADDRESS POSTING & WAYFINDING
It is the recommendation of the Poudre Fire Authority that the private road be named and identified at
the intersection of CR 84 with appropriate street signage (typical). If not named, monument signage
shall be installed at the entry to the development to include all addresses. In such case, a plan for
monument signage shall be submitted to PFA for review and approval prior to installation.
Code language provided below:
r IFC 505.1: New and existing buildings shall have approved address numbers, building numbers or
approved building identification placed in a position that is plainly legible, visible from the street
or road fronting the property, and posted with a minimum of six-inch numerals on a contrasting
background. Where access is by means of a private road and the building cannot be viewed from
the public way, a monument, pole or other sign or means shall be used to identify the structure.

FIRE LANE SPECIFICATIONS
In addition to the design criteria already stated above or contained in relevant standards and policies.
any new fire lane must meet the following general requirements:
• Shall be dedicated as an Emergency Access Easement.
Maintain the required 20 foot minimum unobstructed width & 14 foot minimum overhead
clearance. Where road widths exceed 20' in width, the full width shall be dedicated unless
otherwise approved by the AHJ.
•- Be designed as a flat, hard, all-weather driving surface capable of supporting 40 tons.
Y Dead-end roads shall not exceed 660' in length without providing for a second point of access.
Dead-end fire access roads in excess of 1320' in length require a third point of access.
Dead-end fire access roads in excess of 150 feet in length shall be provided with an approved
area for turning around fire apparatus.
The required turning radii of a fire apparatus access road shall be a minimum of 25 feet inside
and 50 feet outside.
The limits of the fire lane shall be fully defined and be visible with 'No Parking -Fire Lane"
signage. Sign locations shall be labeled on final plans. Refer to Lorimer County LCUASS details
#1418 & #1419 for sign type and placement standards. Appropriate directional arrows required
on all signs.
