This meeting was called to order by Chair, Terry Cross, at 12:40 pm. Roll Call. Present: Bruce Johnson, Bruce Sparrow, Gene Stille, Lonnie Ford, Michael Wailes, Richard Beck, Terry Cross, Tom Cope. Evan Pinkham, Public Works, reported on the existing traffic and access to the site. Hayley Balzano, Engineering, reported on the drainage conditions for the site. Ben Frissell, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Richard Bauer, 1884 Grace Ave, Wattenberg, stated that he has been in business for 32 years and was previously in Longmont. The City of Longmont purchased the property he was operating from and because of the zoning in Longmont he wasn't allowed to continue to operate his business. Therefore, he relocated to Weld County. Commissioner Sparrow asked when he relocated to Weld County. Mr. Bauer said that they moved in December of 2015. Commissioner Ford clarified if they won't be using water to clean vehicles. Mr. Bauer said that the vehicles they clean up they rinse off with spray bottles and detailers. Commissioner Ford referred to the Brighton Fire Department's referral regarding fire sprinklers for the buildings. Mr. Bauer said that he is installing a fire sprinkler in the paint booth. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Ms. Aungst noted that two letters were received regarding this request. One letter was received from an oil and gas company adjacent to the site indicating that there will be traffic congestion, lights and noise until all the wells are drilled. The second letter was in support of this request. The Department of Planning Services recommends approval of this application with the attached conditions of approval and development standards. Commissioner Sparrow asked if there will be a fence next to the ditch to keep animals and kids away. Ms. Aungst stated that the applicant has been diligently working with Henrylyn Ditch Company and they will install a fence to prevent animals and kids entering the ditch. Evan Pinkham, Public Works, reported on the existing traffic and access to the site. Mr. Pinkham stated that the applicant is proposing to build the site in phases; therefore, staff is reviewing a new study submitted by the applicant on the installation of improvements according to the proposed phases. Hayley Balzano, Engineering, reported on the drainage conditions for the site. Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Bob Frachetti and Dan LaCoe. Mr. Frachetti said that they are proposing an agricultural complex on 178 acres. The complex is primarily infrastructure to support a company that Mr. LaCoe started, which is a 503(c)3 company called Achieve More. The complex will include a livestock barn, indoor show arena, outdoor horse rodeo arena, community center, community park and playground, hiking and horse trails, community garden, family rented RV park and 130 acres in active farmland. Mr. Frachetti noted that Mr. LaCoe lives adjacent to the site. 2 Dan LaCoe stated that this proposal is to provide an opportunity for kids to get involved in the community and agriculture. This will allow kids who don't necessarily live in agricultural areas to contract with them, at no expense to them, to raise their animals. He added that the kids will feed and be responsible for their animals, under their direction. Mr. Frachetti provided a description of the layout of the site. He said that the RV Park will target the participants of Achieve More programs, agricultural travelers, as well as recreational travelers and families. He added that they are proposing a 30 -day maximum stay. Mr. Frachetti said that they have met with the ditch company and their engineer and are waiting to hear from the Ditch Board's discussion regarding their mitigation concerns. Mr. Frachetti said that they are also working with a landscape architect for landscape buffering. Mr. Frachetti referred to Development Standard 8 in the Staff Report and requested an amendment to require one (1) security guard per 250 persons. Additionally, they requested an amendment to Development Standard 9 regarding required EMT's on site and Development Standard 10 regarding the requirement for an ambulance on site. He added that they are 10 minutes from a hospital, unless such an event they feel would require an ambulance to be present. Commissioner Ford clarified if they will be charging for the RV park. Mr. Frachetti replied yes. Mr. LaCoe said that they are building this site in phases as finances allow. Commissioner Ford asked who will manage all these people that will be taking care of the animals. Mr. LaCoe said that he will be in charge, however there will be several volunteers such as parents and people from the community. Commissioner Sparrow wished to clarify the length of stay at the RV park. Mr. LaCoe said that their intent is for one (1) overnight stay; however, they found that it will be used for longer when people are showing their animals at events. He added that they will stipulate a 30 -day maximum stay. Commissioner Beck asked when the anticipated completion date will be. Mr. LaCoe replied that they are expecting the date of completion in June of 2019. Commissioner Cope referred to the anticipated traffic and said that 800 vehicles per day is a lot of traffic. He asked how the applicant came up with that number. Mr. LaCoe said that the traffic engineer put those numbers together and added that he didn't feel that number is realistic. Commissioner Cope referred to the proposed reuse of water and asked what kind of storage will be onsite during the winter when it is not being recycled. Mr. Frachetti said that they will have a groundwater discharge permit as well. Mr. Cope asked if they would be capable to store the water. Mr. LaCoe said that a pond is located on site for the treated water. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Roger Allgeier, 27000 168th Avenue, Brighton, Colorado, stated that that the idea is great but he has several concerns. He asked if there will be water storage and what will the capacity be as it will not keep up with the demand of usage. He asked if the fire district is going to require sprinkler systems for any of the buildings. Additionally, he asked how the RV park relates to a 503(c)3 corporation when it will charge fees and expressed concern for the length of stay at the RV park. Mr. Allgeier inquired about the traffic study and provided a traffic count of the vehicles past his home during a specific time period of the day. Clint Brown, 1803 Golden Willow Court, Ft. Collins, stated that he represents the Henrylyn Irrigation District. Their concerns are along the fence and property line mainly with the playground and community park located adjacent to the ditch. He added that they are also concerned with the lagoon placed adjacent to the ditch since it is an unlined lagoon. He said that the structures adjacent to the ditch are their main concerns so that they have access to their ditch for maintenance. 3 Mark and Jamie Longhurst, 27550 East 168th Ave, stated that they live south and east of this proposed project. Mr. Longhurst stated that they are not opposed to the concept. He said that with the large number of animals to be taken care of daily it will increase the traffic on County Road 2. He expressed concerns of the long-term RV parking and suggested limiting the stay to 14 days. Ms. Longhurst said that it seems this is another county fair with all the congestion and traffic and asked why we need another one. She added that there is a trailer behind Mr. LaCoe's office and asked if it is temporary or will be permanent. Mr. LaCoe said that the water storage they have proposed will meet all the Colorado State regulations with a 50,000 -gallon storage tank. With regard to the sludge, he added that another property will be used to apply and will be managed by McDonald Farms. Commissioner Sparrow asked about who will take care of the animals if there is a snow storm and no one can get there. Mr. LaCoe said that during the winter they don't anticipate having animals at capacity. He added that the individuals will be staying in RVs and will be able to take care of the animals as they will be on site. They have no intention to have long-term stay; however, they are proposing 30 -day stay for families that have more of a distance to travel that want to be part of this facility. Commissioner Cross referred to the trailer on site and asked if it will be permanent. Mr. LaCoe said that when they obtained their Use by Special Review on the adjacent property they were allowed to park their trailer. He added that it is not used as a residence. The Chair referred to the three development standards the applicant wished to amend. After some discussion, Commissioner Wailes suggested amending Development Standard 8 to read "One (1) security guard for a scheduled event with 250 people or more and an additional security guard for every 250 persons". Additionally, Commissioner Wailes suggested amending Development Standard 9 to read "One (1) person trained in emergency medical technology for every 350 persons during a scheduled event". Motion: Amend Development Standard 8 and 9, as suggested and delete Development Standard 10, Moved by Michael Wailes, Seconded by Gene Stille. Commissioner Johnson said that he feels there needs to be a smaller number that would be an exception to that. Commissioner Sparrow agreed with Mr. Johnson and felt it should be 100-250 persons. The Chair asked the applicant if they have read through the amended Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Commissioner Sparrow echoed Mr. Wailes comments. 4 The Chair called a recess at 2:45 pm and reconvened the hearing at 3:00 pm CASE NUMBER: USR17-0065 APPLICANT: RICHARD & HEIDI ROBERTSON, C/O CURETON FRONT RANGE, LLC PLANNER: CHRIS GATHMAN REQUEST: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (CRYOGENIC GAS PROCESSING PLANT) IN THE A (AGRICULTURAL) ZONE DISTRICT. LEGAL DESCRIPTION: LOT B REC EXEMPT RE -3799, BEING PART S2NE4 AND LOT B REC EXEMPT RE 3190, BEING PART NE4; ALL BEING IN PART OF SECTION 19, T2N, R64W OF THE 6TH P.M., WELD COUNTY, COLORADO. LOCATION: WEST OF AND ADJACENT TO CR 51 AND 1/4 MILE SOUTH OF CR 20/CR 51 INTERSECTION. Chris Gathman, Planning Services, presented Case USR17-0065, reading the recommendation and comments into the record. Mr. Gathrnan noted that two letters and one email was received outlining concerns and objections regarding dust and road damage to County Road 51, visibility of the flare and towers associated with the facility, noise concerns, lighting (both during construction and during ongoing operations), adding to existing impacts caused by existing businesses in the area, impacts to property values, potential for ground contamination, potential for groundwater contamination, potential for air contamination, ground vibration impacts, impacts on wildlife and weed control. The Department of Planning Services recommends approval of this application with the attached conditions of approval and development standards. Ben Frissell, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Nick Holland, Cureton Front Range, LLC, 518 17TH Street, Denver, Colorado, stated that Cureton is proposing a cryogenic gas processing facility. Mr. Holland provided an explanation of their safety procedures on site. He said that they have held several community meetings over the last month with inviting residents within one mile of the site. Additionally, they have developed a facebook page as a form of communication to the residents. Mr. Holland also provided an explanation of how the lighting plan will work. They will have some lighting zones that they will be able to manually control as well as having minimal lights at night to mitigate the light concerns. Mr. Holland provided some view studies with landscape diagrams and presented them on visual slides. Commissioner Ford asked where the noise comes from. Mr. Holland said from compressors. Commissioner Wailes asked about the vibration frequency issue. Mr. Holland replied that they are considering that as well and looking at how to enclose the compressors so that it will mitigate that concern. Mr. Wailes asked how long with the proposed landscaping take to match the renderings shown. Mr. Holland said that they anticipate planting 8 to 12 foot trees at time of construction of the facility. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Ellen Swieter, 25027 CR 18, Keenesburg, Colorado, expressed concern over the lack of information from the applicant, quality of life, drone of the engines, and lighting pollution. She indicated that the details of the project (truck traffic, number and size of towers, noise mitigation, and plan expansion) outlined in the community meetings are different from the details outlined in the application and the details outlined in the presentation today. She is concerned about a blind spot at the intersection of County Road 18 and County Road 51. Ms. Swieter said that there have been a lot of new oil and gas uses that have been recently approved in this area and that the applicant should consider a more remote area further to the east. 5 Barbara Ries, 8880 CR 49, Hudson, Colorado, stated that her land borders the western boundary line of the proposed project. She expressed concerns regarding her quality of life, lighting pollution, noise, impact on property values and loss of their agricultural lifestyle. She is not in favor of this location and believes that Cureton is proposing this location versus parcels further to the east simply due to cost. She is concerned that this facility will expand into a facility the size of Lancaster off of County Road 22 and that the neighboring property owners are not receiving a consistent message from them as to what the plans are for the facility. She added that trying to get trees to grow in the desolate area is very, very difficult. Jamie Herzmann, 9561 CR 51, Keenesburg, Colorado, stated that this area has become more populated with oil and gas wells. She expressed concerned with plant expansion, road damage, facility safety, investment of their property and decrease of property values and their quality of life. She is not opposed to oil and gas and added that her husband works in the industry; however, she believes this should be placed in a more remote location. Mr. Holland referred to the lack of consistent information and said that things change throughout the process. He said that they feel they are designing a robust plant and will operate it in a safe manner. With regard to traffic, landscaping and noise, they feel they are putting together those mitigation plans for review and approval. Mr. Holland said that the safety measures in place at the plant allows them to deenergize the plant within a matter of seconds to remove any fuel sources. They have submitted an Emergency Action Plan which details the safety procedures for any possible incidents. Mr. Holland stated that they have looked at alternative locations. However, this site is located near residue gas lines serving Colorado and Wyoming and close to natural gas liquid lines, close to production wells, and it sits in a natural depression and also because of water rights. Commissioner Cope asked what is being proposed on the land to the west of where the facility is proposed. Mr. Holland replied that they have nothing planned at this time and added that they purchased the large piece of property to use as a buffer for their facility. He added that the landowner wanted to sell the parcel as a whole and not in parts. The Chair asked the applicant if they have read through the Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Commissioner Johnson said that there are a lot of producing wells that are being shut in temporarily because the pipelines are over pressured to take it and questioned the timeliness of why this is important. He indicated that maybe there should be a Plan B. Motion: Forward Case USR17-0065 to the Board of County Commissioners along with the Conditions of Approval and Development Standards with the Planning Commission's recommendation of denial, Moved by Gene Stille, citing Section 22-2-20, Seconded by Bruce Johnson. CASE NUMBER: USR17-0046 APPLICANT: ANADARKO E&P COMPANY LP, C/O KERR MCGEE OIL AND GAS ONSHORE, LP 6 PLANNER: CHRIS GATHMAN REQUEST: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (STORAGE AND STOCKPILE AREA FOR SOIL, HAY BALES AND CONSTRUCTION EQUIPMENT FOR OFFSITE WELL LOCATIONS AND ASSOCIATED OIL AND GAS PRODUCTION FACILITIES) IN THE A (AGRICULTURAL) ZONE DISTRICT. Chris Gathman, Planning Services, presented Case USR17-0046, reading the recommendation and comments into the record. Staff noted that in addition to this proposed USR, there is also a Use by Right Exploration and Production Waste Facility (mud farm) on the facility regulated by the COGCC. Multiple phone calls, photos and emails have been received by Staff from two surrounding property owners. The main concerns are related to amount of truck traffic, dust, noise and road impacts. The Department of Planning Services recommends approval of this application with the attached conditions of approval and development standards. Ben Frissell, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Nathan Keiser, Anadarko Petroleum, 1099 18th Street, Denver, Colorado, stated that Anadarko has purchased this property since 2011 for drilling operations, waste management and agricultural operations. He said that traffic has increased because of the increase in the oil and gas industry. Mr. Keiser said that they store dirt for construction of drill pads onsite. They also have multiple locations of these types of facilities throughout the County to reduce road impacts. He added that the mud and soil stockpile area are used intermittently and it depends on the proximity of oil and gas operations in the area. Mr. Keiser noted that a community meeting was held last fall. He added that as a result of that meeting they will send out notification of when they anticipate an increase in traffic and any other communications. Commissioner Beck asked where primary traffic will come from. Mr. Keiser said that primary traffic will come from County Road 21 and exit off of County Road 18. The reason for that is so that if there is a back- up of traffic it will be onsite rather than on a county road. Commissioner Ford referred to photos submitted by Mr. Neal, specifically where the trucks were stopped and asked what caused this backup. Mike Dinkel, Environmental Scientist, Anadarko Petroleum, 1099 18th Street, Denver, Colorado, stated that he believes there was a farm tractor broken down on the road that caused the back-up. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Dennis Neal, 7691 CR 23, stated that the applicant has been operating over a year and he has been contacting the County repeatedly for over a year. He emphasized concern regarding the dust and amount of truck traffic. He suggested that the applicant pave the roadway on County Road 18 to prevent the dust. He added that he was required pave his road as a condition of approval for his subdivision off of County Road 40.5 and feels that it is fair that paving be required for this use as well. Mr. Kesier said that he couldn't commit to paving the road today. He said that they have taken a lot of feedback from the community meeting and have taken efforts to reduce trucks and kept in contact with a lot of those same neighbors. He said that they have notified the community of when the public hearings were scheduled; however no other neighbors are here today. 7 Commissioner Stille asked outside of paving or mag chloride what can be done to mitigate dust. Mr. Keiser said that if they are using the mud farm more than average then they will try to not use the soil area. If they are using the soil area more than normal then they will try to take the mud to another location in the County. He added that by doing that it would reduce truck traffic significantly. He said that they will notify the community ahead of when they anticipate an increase in traffic and mag chloride the road. Commissioner Cope suggested using a soil cement mixture and added that it provides a little better road deck that can also be watered to keep dust down. Discussion was held among the Planning Commissioners regarding paving. Commissioner Cope said that he isn't comfortable in making that a criteria from this Board, but encouraged the County Commissioners to take a look at it. The Chair asked the applicant if they have read through the Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Commissioner Ford referred to Item C, Section 23-2-220.A.3 stating that a Road Maintenance and Improvements Agreement is required as a condition of approval and doesn't believe it has been addressed properly. CASE NUMBER: ORDINANCE 2018-02 PRESENTED BY: JOSE GONZALEZ REQUEST: IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS OF THE WELD COUNTY CODE Jose Gonzalez, Building Department, presented Ordinance 2018-02, and stated that the proposed code change is to adopt the 2017 National Electrical Code. Mr. Gonzalez stated that the reason they need to adopt the 2017 Electrical Code is to follow State requirements. He added that every jurisdiction is required to adopt within 12 months of the State adopting the Electrical Code, which was adopted July 1, 2017. Motion: Forward Ordinance 2018-02 to the Board of County Commissioners along with Planning Commission's recommendation of approval, Moved by Tom Cope, Seconded by Bruce Sparrow. Vote: Motion carried by unanimous roll call vote (summary: Yes = 7). Yes: Bruce Johnson, Bruce Sparrow, Gene Stille, Lonnie Ford, Richard Beck, Terry Cross, Tom Cope. Absent: Michael Wailes. The Chair asked the public if there were other items of business that they would like to discuss. No one wished to speak. The Chair asked the Planning Commission members if there was any new business to discuss. Commissioner Johnson said that we are making recommendations and conditions of approval but every time a compliance issue comes up we cannot have staff recommend anything to them and the Planning Commission cannot look at the site. He doesn't feel it is the neighbor's responsibility to police every one of these approvals. Tom Parko, Planning Director, asked to clarify if he is referring to case that has been in violation and been approved and then that staff would follow-up and ensure that the business stays in compliance with its development standard. Mr. Johnson said that whenever it is in code violation he is concerned that staff cannot have a recommendation. He added that after a permit has been approved and brought into compliance there should be periodic visits to ensure it remains in compliance. Mr. Parko said that it has been a long-standing policy that we are complaint -driven in Weld County. Staff are not able to go out and find violations; however, they come to us through phone calls, letters, etc. and then staff will perform a site visit and determine if a violation does exist. Depending on the magnitude of the violation, 8 then we determine what course of action to take. He added that sometimes it is a matter of dealing with the violation right away or giving them an opportunity to come into compliance. Meeting adjourned at 5:48 pm.
