The purpose of this instrument is to release any claim which

road-making materials ffom the above-described property, those
rights having been granted to the County of Weld by virtue of
an instrument recorded at Reception No. 968042 in Book 1166
at Page 542 , Weld County Rerojds; and further to include the
property for assessment for tax purposes.
IN WITNESS WHEREOF, said County of Weld acting by and through

RESOLUTION AUTHORIZING SIGNATURES
OF BOARD OF COUNTY COMMISSIONERS,
ROAD MATERIALS EASEMENT:

Section 25-3-67
On motion duly made and seconded, it was,
RESOLVED, that the Board of County Commissioners of Weld
County, Colorado sign the Easement for removal of gravel from the tract
in the NE*: Section 25, Township 3 North, Range 67 West, as described
in the easement hereto attached and made ., part of this resolution.
The resolution was, on vote, unanimously adopted and
so ordered.

by and between William Millensifer
of Weld County, Colorado, part y of the first part, and The County of Weld, in the State of Colorado,
a municipality, party of the second part:
WITNESSETH: The part y of the first part, for and in consideration of
-- Five Hundred & No/100 --- Dollars,
to first part y in hand paid by the party of the second part, the receipt whereof is hereby confessed
and acknowledged, do es hereby bargain, sell and convey unto the party of the second part, its succes-
sors and assigns, the right to remove all gravel, sand and road-making and building material which it
shall be able to remove from the following described lands, situate in the County of Weld and State of
Colorado, to-wit: Part of the N 4: Section Twenty-six (26), Township Three (3) North,
Range 67 West:
Beginning 394' West of the West rail of the Great Western Railway as now located on
South line of NW-�: Section Twenty-five (25) T0wiship Three (3) North, Range Sixty-
seven (67) West:p thence West 1032' , thence North 211.5' , thence Fgst 1032', thence
South 211.5' to point of beginning located in Section Twenty-six (26), Township Three
(3) North, Range Sixty-seven (67) West, together with ingress and egress over land
adjacent thereto.
(This easement good for duration of pit.)
(County agrees to clean out ` mile of seep dithh)
The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees
that said tract of land shall be excluded from further assessment for taxes; the first part y hereby
granting to the party of the second part the right to enter upon said lands at any time hereafter and to
excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its
needs, together with the rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right to remove therefrom
the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure
to the benefit of the heirs, administrators, and assigns of the part y of the first part, and the succes-
sors as4gffs of the party of the second part.
