RE: APPROVE SUPPLEMENTAL ENVIRONMENTAL PROJECT (SEP) GRANT
APPLICATION FOR WELD COUNTY PUBLIC WORKS MASTER POLLUTION
PREVENTION PLAN AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Supplemental Environmental Project
(SEP) Grant Application for Weld County Public Works Master Pollution Prevention Plan from the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Department of Public Works, to the Colorado Department of Public Health
and Environment, commencing August 6, 2018, and ending August 6, 2021, with further terms
and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Supplemental Environmental Project (SEP) Grant Application for Weld
County Public Works Master Pollution Prevention Plan from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, to the Colorado Department of Public Health and Environment, be
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said application, and the Department of Public Works is authorized to electronically submit.

1.0 Background and Purpose
When a reguLated enthy My enters into an agreement with the Colorado Department of Public -eatth and
Environment (tne ceoartment) and/or the Environmental Protection Agency (EPA) to resolve alleged
violations of federal or state environmental regulations, the agreement may include a monetary penalty
or fine, Tne department arc EPA may allow an entity to offset a portion of the penalty if the regulated
entity agrees to implement a Supplemental Environmental Project (SEP),
The main elements of a SEP can generally be defined as follows:
A voluntary project that benefits public health ant/or the environment beyond any steps taken
bo correct tie alleged violation and beyond what is already required by law or regulation;
A project that would not nave been implementer but for inclusion in the settlement agreement;
A project typically implemented in the region there the alleged violation occurred; anc
While participation in a SE3 is voluntary, if both the department and the regulated entity agree
to a SEP, it will be put into a Compliance Order on Consent or SEP Agreement with enforceable
terms and conditions,
In October 2017, tne EPA, the Department of Justice, and the State of Colorado announced a settlement
with PDC Energy, Inc. (PDC), an energy company, that comprehensively identifies and addresses alleged
violations with vapor control systems at PDC's condensate storage tank batteries in the Denver -area 8 -
hour ozone marginal nonattainment area (nonattainment area), on February 6, 2018, the U:S, � ist�ict
Court of Colorado approved the parties' settlement.
As part ofthis settlement, PDC agreed to submit one or more possible SEP proposals for department
approval within 90 days of the effective dated Recognizing the importance of community involvement,
PDC is opting to use the SEP Community Process for aopuication selection, through tnis process, PDC and
the department (the parties) will work together to identify potential SEP applications that will result in
an expenditure by PDC of $1 million and secure significant environmental or public healtn protection
and improvement;
The parties are now inviting nonprofit organizations and governmental entities to submit SEP
applications that will benefit communities and neighborhoods in Weld County.
The par ties look forward to approving approximately two to five projects in this area. Project buagets
should appropriately reflect the amount of environmental or public health protection and improvement
received. Funding requests must be greater than $200,000 and may not exceed $500,00Q, Applicants

The SEPs are intended to secure significant environmental or oublic health projection and improvement
in Colorado, especially for communities impacted by tne alleged violation(s). Nearly all of the
condensate storage tank batteries covered oy tnis settlement are located in Weld County, Therefore,
projects are required to provide significant environmental or public healti protection and improvement
within Weld County.
4.0 Eligible SEP Catepries
Eligible projects must directly benefit the environment or public heai.tn protection and improvement in
at least one oriority area listed above and fail in one of the categories described below.
Pation Prevention
For the purposes of developing a SEP, a pollution prevention project is any project that
suostantially recuces or prevents the generation or creation of pollutants through:
a Source recuction - eliminating the source of pollution by changing industrial processes or
substituting less poiLiting fuels or less toxic raw materials in existing processes;
Alternative/Renewable Energy, Energy Efficiency - application of measures anc
technologies to reduce/eliminate dependency upon traditional resources.
Waste minimization - conserving those materials that are sources of pollution; this
includes application of closed -loop processes or other resource -efficiency measures;
in -process recycling - returning waste materials produced during .a manufacturing process
directly to production within the same manufacturing process using dedicated, fixed, and
physically integrated equipment so that no releases, including ► ug4tive :releases, occur;
Innovative recycling technologies - substantially reducing the discharge of generated
pollutants through innovative recycling technologies that keep the pollutants out of the
environment in perpetuity; anc
Conserva':ion ._ protecting natural resources through conservation or increased efficiency

Eligible projects may induce an environmental education component, but must also include an

in constructing improvements,

by implementing

Master
Pollution
Prevention
Plan.

Public Works has been working to create a Master Pollution Prevention Plan to bring
together specific stormwater management components, including drainage improvements,
chemical containment and salt storage, which have been built piecemeal over the last 20
years. The goal of this project is to improve the water quality of the Cache la Poudre River by
more stringently preventing and reducing pollutants potentially discharged from the Public
Works campus, in addition to complying with all local, state, and federal regulations.
This project includes the purchase and installation of three large (7200) Stormceptors®,
which would remove potential stormwater pollutants, such as suspended sediment, trash,
free oils, and other contaminants that may attach to particles, no matter how fierce a storm.
These Stormceptors° would be installed in strategic locations to intercept flows from valley
pan improvements which would directionally guide and connect flows for the entire campus.
The first Stormceptor° would be located on the east part of the campus at the south end of
the fleet vehicle fueling site. The second Stormceptor° would be placed on the west side of
the campus to treat runoff from the laydown yard and parking lots prior to discharging into
our drainage ponds. The last Stormceptor° would be located at the lowest elevation where
the entire campus drains and collects prior to reaching the Cache La Poudre River. Should a
spill occur, the Stormceptor° would contain the material, where it can be pumped out and
recycled if possible. Routine maintenance may also provide an opportunity for oil recycling.
Project
escription
The project would also include installing a trench drain and evaporation pond to collect salt
residue from the salt/sand storage shed area. The evaporative pond would be concrete lined
over a clay liner mixed into the earth, which will allow the water to evaporate or be
vacuumed up with a vacuum truck if necessary. Once the water evaporates, the sand and
salts can be cleaned out with a small skid -steer or by hand and transferred back to the
sand/salt covered shed for reuse.
Existing, proposed, and future improvements of the Master Pollution Prevention Plan are
detailed on the attached site plan. These improvements have been specifically developed by
Weld County Engineers to encompass all municipal operations activities and onsite materials
to ensure if human error occurs, any spills or contaminants are prevented from being
discharged from the Public Works campus.
The SEP funds will be used to purchase the materials, such as gravel, clay, and cement, etc.,
and equipment, such as Stormceptors®, inlets, and drains, needed to make these very
important improvements. To save money, Weld County Public Works Crews will perform the
installation of the site construction improvements, except for the Stormceptors®. Weld
County will follow our procurement procedures for purchase and installation of the
Stormceptors° through a competitive bid process. Public Works will project manage the
installation of this equipment in accordance with our policies and procedures.
If Weld County can contract with CDPHE by the end of this year, Public Works can design the
improvements needed for the bid documents with an anticipated construction time starting
in February of 2019. Depending on the contractor's schedule for ordering and installing the
Stormceptors®1 Public Works anticipates completing construction and documentation by Fall
of 2020, if not sooner.

The Master Pollution Prevention Plan will substantially prevent or reduce discharge of
pollutants into the environment, especially any spills that may occur through human
error. These improvements are significant pollution prevention measures, which assists
with eliminating source pollution, minimizing waste, protecting natural resources through
conservation and allowing Weld County to support water quality improvements by
implementing more effective structural control measures.

reducing its load of sedimen, free oils, hydrocarbons, salts and trash resulting from everyday
activities. Structural improvements will provide an added level of security in the event
of a spill, ensuring containment while performing spill response procedures. Additionally,
the wastes collected in the improvement structures may be recycled (oil) or reused (salt).
Weld County anticipates protecting approximately eight acres of critical habitat area including
an established wetland area and vegetated channel, in addition to approximately six miles of the
Cache la Poudre River, which joins the South Platte River. Since none of the
proposed improvements identified on the site plan currently exist, this project will
guarantee immediate remediation should a potential spill occur. The Master Pollution
Prevention Plan will significantly reduce the risk of human exposure to pollutants, while
simultaneously providing additional environmental and public health protection.
The amount of pollution reduced will be quantified during routine maintenance, as needed.

Results
Since no Stormceptors® currently exist on the campus, CDPHE can be assured that any runoff
from materials and equipment will be treated to a greater extent than current measures allow.
Stormceptors® will also provide additional spill protection during spill response procedures,
ensuring the greatest amount of pollutant removal. Public Works Operations Crews will install
and maintain the improvements for as long as Public Works is located on this campus.
With county crews installing the improvements, they will be very familiar with the project, so
it will make future maintenance easy and efficient. The benefits of these improvements will
be monitored through routine maintenance and cleaning of the system, which will be
implemented and documented in the County's MS4 program. Quantities of pollutants
removed from these structures will be documented in order to evaluate the effectiveness of
the control measure, and this data can be reported to CDPHE, if necessary. In addition, annual
facility inspections required by the Phase II MS4 permit will evaluate the effectiveness of the
Master Pollution Prevention Plan as a whole, and modifications will be implemented if
determined necessary.
Weld County is an active member of the Colorado Stormwater Council, and representatives
meet several times a month to discuss stormwater related issues. If Weld County Public Works
is granted this SEP funding, it may encourage other municipalities and counties to look at
similar improvements. Additionally, becoming more familiar with Stormceptors® and
evaporation ponds will be of great benefit within our development review process. With first-
hand experience, we will be more equipped to recommend (or not) these more advanced
stormwater quality features to the public. Lastly, Weld County will periodically use Facebook
posts, county newsletters, county website, reports to the State, and news articles in the
Greeley Tribune to assist with communicating to the public and other organizations.

Weld County Public Works has significant experience in designing, purchasing, constructing,
and managing construction projects. We have several engineers on staff who work closely
with our operations crews. Our largest design -build five -lane road project for $109 million
dollars was recently completed on time and under budget.

County staff has managed many state construction grant projects from CDPHE, CDOT, and
DOLA for example, with proven compliance experience. Types of grants we are currently
managing or have managed in the past include: CDBG, CMAQ, TAP, STP-Metro, SEP, EIAF,
and Small Communities Grants.
Weld County has the knowledge to implement SEP funding based on our previous
experience and expertise working with Rachel Wilson -Roussel to successfully implement
several prior SEP projects under budget and on -time.

The applicant will submit a biannual project status report to the department's SEP Coordinator with a copy to PDC.
Status reports will be submitted using the department's template and include the following information:

• A discussion of any anticipated changes to the project scope or timeline.
Applicant's Final SEP Completion Report
The applicant will submit the SEP Completion Report to the department's SEP Coordinator with a copy to PDC
within 30 days of project completion. The applicant's Final SEP Completion Report will be submitted using the
department's template, and will contain at a minimum:
• A detailed description of the project as implemented;
• A summary table identifying project deliverables and tasks along with the associated completion date;
• A description of any operating problems encountered and the solutions thereto;
• A full expense accounting including itemized costs, documented by copies of purchase orders, contracts,
receipts or canceled checks;
Demonstration that the SEP has been fully implemented in accordance with the SEP application;
A description of the environmental or public health protection and improvement resulting from
implementation of the SEP along with quantification of the outcomes and benefits;
• Examples of brochures, educational or outreach materials developed or produced as part of the SEP; and
• Photographs documenting both project implementation and results.
Depending on the project scope, the department may also require the applicant to develop and submit a case study
with the Completion Report.
PDC requires a copy of the Applicant's Biannual Status Reports and Applicant's Final SEP Completion Report. These
reports will be used by PDC to comply with the Consent Decree requirement that PDC submit a SSEP Completion
Report to CDPHE within 60 days of the completion of each of the SSEPs.
