STORAGE) PROVIDED THAT THE PROPERTY IS NOT IN AN APPROVED OR
RECORDED SUBDIVISION IN THE A (AGRICULTURAL) ZONE DISTRICT - ROBERT
L. SELTZER FAMILY TRUST
A public hearing was conducted on October 29, 2018, at 10:00 a.m., with the following present:
Commissioner Steve Moreno, Chair
Commissioner Barbara Kirkrneyer, Pro-Tem
Commissioner Sean P. Conway
Commissioner Julie A. Cozad
Commissioner Mike Freeman
Also present:
Acting Clerk to the Board, Stephanie Frederick
County Attorney, Bruce Barker
Planning Services Department representative, Chris Gathman
The following business was transacted:
ci I hereby certify that pursuant to a notice dated October 11, 2018, and duly published October
16, 2018, in the Greeley Tribune, a public hearing was conducted to show whether good cause
exists for revocation of Use by Special Review Permit, USR12-0022, for any Use permitted as a
Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone
Districts (outside recreational vehicle storage and miscellaneous storage) provided that the
property is not in an approved or recorded subdivision in the A (Agricultural) Zone District, issued
to Robert L. Seltzer Family Trust. Bruce Barker, County Attorney, made this a matter of record.
ei Chris Gathman, Department of Planning Services, stated the applicants' attorney is not
present due to health issues.
El Tim Seltzer, resident of Briggsdale, and Jack Seltzer, resident of Camp Verde, Arizona,
introduced themselves. Tim Seltzer explained their attorney is not present because of health
concerns. In response to Commissioner Cozad, Jack Seltzer stated since they don't have an idea
what the Planning Department is going to recommend and submit to the Board, they don't feel
comfortable proceeding without the attorney. Tim Seltzer stated they were not made aware of
what was to be presented to the Board today.
Chris Gathman stated there was some correspondence between the Clerk to the Board's
Office and Tim and Jack Seltzer's attorney. He stated he wasn't sure if the Seltzers had a chance
to review the recommendations from the Department of Planning Services staff.

• In response to Commissioner Kirkmeyer, Mr. Gathman stated he would allow the Seltzers
time to review the documents and recommend a continuance. Commissioner Kirkmeyer
suggested a 15-minute recess so Mr. Gathman could meet with Tim and Jack Seltzer and review
what he plans on presenting to the Board today.
(Clerk's Note: The Board recessed the meeting at 10:06 a.m. and reconvened at 10: 21 a.m.)
• Tim Seltzer and Jack Seltzer stated, after meeting with Mr. Gathman, they would like to
request a continuance. Jack Seltzer stated he can come back if the hearing is continued. Mr.
Gathman presented options for continuing this matter, one of the options being to continue the
hearing until Spring, 2019, to verify the landscaping is established.
• No public testimony was offered concerning this matter.
Commissioner Kirkmeyer moved to continue the Show Cause hearing, PCSC17-0014, to
April 10, 2019 at 10:00 a.m., concerning the Site Specific Development Plan and Use by Special
Review Permit, USR12-0022, for any Use permitted as a Use by Right, Accessory Use, or Use
by Special Review in the Commercial or Industrial Zone Districts (outside recreational vehicle
storage and miscellaneous storage) provided that the property is not in an approved or recorded
subdivision in the A (Agricultural) Zone District, issued to Robert L. Seltzer Family Trust, to allow
Tim and Jack Seltzer's attorney to be present and allow the newly planted trees time to become
established. The motion was seconded by Commissioner Conway, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:25 a.m.
This Certification was approved on the 31st day of October, 2018.
