These cainpa�� ies h�ve either already built, or plan to build their pipelines underneath historic irrigation ditches without even informing the ditch owners of the location or depth of thosc pipelines , These flagrant property right violations are not only endangering the safety af those who routinely excavate those ditches, but also jeopardizir�g the ability of the ditchcs to transpo �t vital irrigation water ta the farms and crops that desper�tely need it for their survival . Historic irrigation ditch easements are lawfully-established, legally-recagnized, right-of-ways that convey catu-t-decreed wates• rights to specific lands . I am the duly-Authorized Age ►St of the owners of the Irons Lateral Ditch, �vhich was built in Ehe [ ate 1 S00s and has been in use for over l20 consecutive years . The ditch is appruximately 4 miles long and transverses 4 sections of land north and west of Kersey , It conveys wat� r from thc t; v ��_ Lower Lathain Ditch to several of its shareholders to irrigate �esr�-500 acres of their fannland . Many inantl�s ago , I learned tlu•ough the grapeviiie about DCPs plans to btuld this pzpelizie uilderneath the Iroi� s Lateral Ditch, but I wvas only contacted by a DCP representative about �t just last week. Accardingly, I intend to prov � de DCP with the same ditcll erossing easernent four other pipeline companies recently agreed to before building their � ipelines. They routinely acqtiure easements to cross other rigE}t-oF-ways before building their pipelines , and there is t�o legitii�.ate excuse for them not to obtaui erossing easements fi-am historic irrigation ditch owners as well. Howevar, 811 can c��rrently only accurately �nd and mark pipelines i ❑ specific, pin-pointed areas within c�esignated boundaries of just se�eral hundred feet [rrigation ditches are often several miles long and are routinely excavated for the entire length of the ditch. 81 L is not readily capable of tracing pipelines that are buried at unknown locations alang the whale cai�rse of a lang ditch on a timely basis . As a resLllt, ditch excavators already risk life and limb when �hey di� out longer ditches witllout �Cnowing where wrongly insta�led pipelines are.
