I am writing to voice my concerns and opposition regarding the above mentioned USR request (USR18-0032). We
live directly across County Road 53 from the applicant. We attended the POC meeting on July 3r°; however, we are
unable to attend the BOCC Hearing due to previously committed travel requirements. However; we felt it was
important to provide a statement and I ask that our comments in this letter are considered when deciding to
approve or deny the request.
We have lived at our residence, and my wife has had a home -based office for 18 years. The community we live in
has seen its share of growth and expansion however, the level of noise that has been added from the loading and
unloading of pipe has dramatically affected the ability to work from home. Even with the windows closed in the
house, she can no longer conduct business due to the noise generated throughout the day and on weekends.
During the PC hearing, after hearing concerns from 6 people that are directly affected by the request for this
residential property, several members of the PC commented that it was a challenge to deny a support request for a
company that is actively servicing the Oil & Gas industry that is a significant contributor to the Weld County
community; however, there must be a balance between Oil & Gas support and the quality of life for residents in
Weld County. Not all requests should be treated equally just because of the support they provide. Quality of life
and safety are also key considerations for county residents that must be well -thought-out and considered.
The unanimous vote from the PC identified three specific codes for their reason of deny:
Section 23-2-220.A.3 -- That the USES which would be permitted will be compatible with the
existing surrounding land USES.
The applicant property is surrounded by small acreage residential properties. Please reference the map
provided in the power point that identifies 10 residences within 500 feet. The applicant wants to park 15
semi -trucks on the small 10 -acre property to operate his business with the parking lot directly connecting
to a neighboring residential property with operating hours Monday thru Friday 6AM to 7PM, and Saturday
from 6AM to 6PM. Consider the impact to quality of life when you put an industrial/commercial property
in the middle of 10 residences that live in rural Weld County.
There is availability that is currently zoned for commercial/industrial use within 3-5 miles of the
applicant's residence. The applicant is currently operating his business from a location in Kersey where he
currently parks his 15 semi -trucks and has an office. The need does not exist to move in to a residential
community for this type of operation.
section 23-2-220.A.4 -- That the USES which would be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the future
development as projected by Chapter 22 of this Code or MASTER PLANS of affected
municipalities.
County Road 53 is a two-lane road that the applicant will use to enter and exit the property. This is a main
road that is used by families, school buses, teenage drivers to go in to and out of Kersey. The residential
traffic has already been negatively impacted with the limited operations the applicant has been
conducting for the past year and has received violations for, due to the semi's and pickups with large
trailers attempting to turn in to the property on a two-lane road with no shoulder and no turn lanes and
require use of both lanes and the ditch to adequately make the turn in to the property.
Please review the map that clearly shows the residential neighborhood that surrounds the applicant
property. Less than a quarter mile away on County Road 53, a new home is currently under construction.
This area is clearly composed of residential locations.
Section 23-2-220.A.7 — That there is adequate provision for the protection of the health, safety
and welfare of the inhabitants of the NEIGHBORHOOD and the COUNTY.
As stated earlier, County Road 53 is a two-lane road with no shoulder on either side that is a heavily used
route to enter and exit out of Kersey for students of Platte Valley School District. Superintendent, Glen
McClain, attended the PC hearing to state that he had concerns regarding how this business could affect
bus routes for students attending Platte Valley Schools. There are 6 bus stops (within Y of a mile each
direction), 3 to the North, and 3 to the South of the applicant's property that pick up between 7:15AM
and 7:30AM and drop off students between 3:15PM and 3:30PM. These bus stops will require the
students to cross the two-lane road on foot at either pick up or drop off. Adding the additional truck
traffic turning in to and out of the property, will impact the busses that pass in the morning and
afternoon, in addition to the families, and teenage drivers going to and from the school. We have
recently been reminded of what can happen when a car meets a semi on a major highway. Why could we
in good conscience allow to increase the semi traffic on a two-lane road that is heavily used by teenage
drivers, school busses, and families going to and from school on a two-lane road when there are other
options available to the applicant.
Please consider that the applicant has been in violation of operations out of his residence for some time and has
brought forth this USR application following numerous complaints already made against him by the surrounding
neighbors. His illegal operations of this business have already impacted the quality of life of the surrounding
neighbors due to noise of loading and unloading of heavy pipe, and substantial truck traffic increases, damaging
the road and ditch East and West of the property entrance because the road is not compatible with this type of
operation. He is currently operating at a different location and there are suitable locations available for
commercial/industrial use that will meet the needs for Centennial Tools to continue to support the oil field
operations in Weld County.
In summary, a lack of compatibility, impacting the future development of the residential area, and negatively
impacting safety of the inhabitants of the neighborhood are all reasons why we ask that the County
Commissioners deny this request as the Planning Committee recommended.
Because we are unable to attend the BOCC hearing, we ask that our time be allotted to Todd Loose to speak on our
behalf.

I am not able to attend the meeting of the Commissioners on Wednesday and the matter relating to Juan Cruz.
and my wife. Joann will be present to speak to the Board on the USR In addition to the attachment that
includes our recent reply to the USR I just wish to emphasize a couple of things.
We moved to our current location at 25303 CR 53 south of Kersey in 1999. at which time the area was truly a
bedroom residential/ag community Over the years the oil industry was growing dramatically. which we
expected and understood. but the effects of the oil related activities was generally temporary. When we moved
to the country. we knew that mineral rights in the property may conflict with the surface owner rights. and we
had to live with the mineral right owner's ability to execute those rights
What is different with the matter relating to the activities of Juan Cruz is that the effects are permanent if the
USR is approved. and the identity of the related property will always be commercial in nature. forever changing
the character of the community We are about a one -quarter mile away from his property. out of sight because
of a slight rise to the south. but we clearly hear the clanging of the pipes and the beeping of his equipment
backing up, even with our windows closed. There is nothing he would be able to do to buffer the noise. At the
same time, early on we had encountered a substantial increase in truck traffic as a result of his activities.
County Road 53 was already a busy two-lane road because of increased residential building and oil related
traffic. There is currently another home being built nearby School bus stops are numerous in the area.
especially near the property in question.
I respectfully request denial of the USR of Mr Cruz. as the designation of the property should remain
residential in nature. Thank you for your attention to this matter.

My name is Joann Crosier and my husband and I are neighbors of Mr. Cruz. We reside at 25303 CR 53, Kersey, and are
approximately 500 yards from Mr. Cruz's property. I want to be clear about something. I applaud Mr. Cruz for being a
small business owner and for creating employment opportunities for others. My husband is a small business owner as
well. My issue is with the noise and the amount of loud traffic Mr. Cruz's business has brought to our neighborhood.
Over 19 years ago my husband and I purchased our 5.5 acre property with a desire to live in the country, raise animals,
garden and eventually retire on that country parcel. Residential/ag property is what we purchased in a residential/ ag
neighborhood. We've worked hard and have made sacrifices in order to attain this goal and we feel we have every right
to a quiet, peaceful retirement on this property.
At one point in time our quiet neighborhood gave way to constant clanging of pipes being loaded and unloaded onto
and off of trucks. When in full operation, I would hear loud clanging, beeping of backing up equipment, and semitrailer
trucks pulling in and off of our county road. At times trucks have honked horns upon arrival. I wasn't sure if they were
announcing their arrivals or warning other motorist that they were making turns signaling "don't pass this slowing
truck". It sounded like a perpetual construction zone. These were the things I heard all throughout each day.
Recently, the noise and the truck traffic has been noticeably less. I'm not sure if this is due to any warnings Mr. Cruz has
received. But I do want this Board of Commissioners to understand that it is very noticeable. When in full operation,
the noise and the truck traffic is pretty constant. Recently it's been sporadic. This last week, it has been silent.
Please understand my frustration. My husband and I have worked hard to reach this point in our lives. We want a
peaceful retirement on our own property. We don't begrudge Mr. Cruz making a living but his business, when in full
operation, is very disruptive to our neighborhood. We have been a long established neighborhood and we are very
respectful of each other's properties and rights. If Mr. Cruz is granted his USR for his oil field support business in this
residential/ag neighborhood, his wishes will have superseded the desires and intents of many families who have resided
here longer. This will change the complexion of our neighborhood completely, and not in a positive way.
I ask that Mr. Cruz's USR not be granted. There must be a better solution or a better suited location in which to operate
this type of business.
In a world that bombards us with constant noise, I would request that you grant us back our peace and quiet at our own
homes.

Dear Weld County Commissioners,
I am writing in regards to the USR permit request USR18-0032, Juan Cruz. I am Juan's direct neighbor to
the South at 25072 Cr 53, in an attempt to salvage a neighborly friendship, I am writing to express my
disapproval for this permit. I own 5 acres that is zoned residential/Agriculture next to Juan and I raise
goats and other smaller livestock. Since the start of import and export of drill pipe my North pastures
have become less usable because the noise of clanging pipe scares my livestock out of those areas, it has
a negative effect on the weight gain and stress of my animals, in return effects my income.
I also fear the negative effect it has on my property value in the fact it lessons my resale amount. Are
these matters taken in to account when approving or denying these permits? If this is granted are the
permittees going to be required to put up fencing to disguise the unsightly effects of an oil support
business, noise obstructions like tree lines. I would also mention the concerns of fire mitigation seeing
how it is in the middle of dry land grass pastures. Can it be stipulated to have a fire plug installed on the
property. If there is a retention pond what is the plan for mosquito control? The noise and exhaust
fumes when startingl5 to 20 trucks on cold mornings does not help the matters. Are the hours of
operation going to be enforced?
To summarize I feel this will be a negative impact on our community and I hope these concerns are
considered strongly.

We had responded in April 2018 and subsequently addressed the Planning Commission with our concerns in
regard to this USR. Our concerns were around the number of truck trips during our school bus stop times.
Mr. Knapp contacted us on behalf of Mr. Cruz and they have agreed to the following language as a condition
of approval for the USR.
As a means of eliminating any potential unsafe condition between the school buses on this route and Mr.
Cruz's business, we have agreed to add to the USR Conditions of Approval and Development Standards
during the upcoming Weld County Commissioners hearing (l Dam on July 18th, 2018) to restrict trucks
from entering and exiting the property from 7:00am to 7:45 am and also from 3:00 pm to 4:00 pm during
all days that school is in session.
This language and agreement then satisfies the transportation concern that we had conveyed by letter and
by addressing the planning commission.

Attendance included 8 neighbors (4 couples) along with Mr. Cruz, Cameron Knapp of Drexel
BarrelI & Co., and Jose Gonzalez (Mr. Cruz's business partner)
Introductions were followed up by open discussion. The tone was very cordial and the
meeting very productive in the view of Mr. Cruz. Some of the main points of discussion
included:
• Joann Crosier had a concern about the transfer of the USR to a potential buyer of the
property and someone coming in and expanding on the current USR. Also, a concern
was about if this USR is approved, will it open the door to other and more similar
USR's in the area.
MR. CRUZ RESPONDED: HE HAS NO INTENTIOINS AT THIS TIME OF SELLING
THE PROPERTY BUT WOULD LOOK INTO THE MATTER TO SEE IS MAKING
THE USR NON -TRANSFERABLE IS EVEN ALLOWED.
MR. KNAPP RESPONDED TO THE SECOND PART OF THE QUESTION, STATING
THAT OTHER USRS APPLIED FOR IN THE AREA WOULD CERTAINLY HAVE TO
GO THROUGH THEIR OWN APPROVAL PROCESS AND THAT IT WOULD BE UP
TO THE COMMISSIONERS TO CONSIDER IF OTHER USRS WOULD HELP TO
PROVE THE CASE OF POSSIBLE SIMILAR "LAND USE" WHEN CONSIDERING
COMPATABILITY.
• Curtis McKay stated that he did not intend to appear "aggressive" in nature at the
County Commissioners Hearing, but rather just wants the neighborhood to be
successful for everyone. Pipe noise was his big concern, but with those operations
being taken out of the USR, he had no major objections as long as the traffic/bus
stop schedule was not affected.
MR. CRUZ RESPONDED: WE HAVE WORKED WITH THE SCHOOL DISTRICT TO
RESTRICT TRUCK ACCESS TO THE SITE DURING THE PRESCRIBED SCHOOL
TIMES AS SET BY THE DISTRICT. MR. KNAPP ALSO INCLUDED THAT THE
SITE ENTRANCE WILL BE IMPROVED/WIDENED/PAVED TO HELP
FACILITATE TRUCK TURNING MANUEVERS INTO AND OUT OF THE SITE.
• Joann Crosier asked if the larger "float trucks" would be utilizing the site.
MR. CRUZ RESPONDED: WE WILL TRY TO KEEP THOSE TRUCKS OFF OF HIS
PROPERTY; HOWEVER, IT IS POSSIBLE THAT A CERTAIN SITUTATION
COULD WARRANT THE NEED TO PARK ON HIS SITE IF THE PIPE STORAGE

NEEDED.
• Patricia Gibson brought up the issue of safety in regards to trucks turning into the
site and high speed traffic on CR 53. Would a truck turning warning sign be possible
to post?
MR. KNAPP RESPONDED: WE UNDERSTAND THE ISSUE OF CR 53 BEING A
VERY HIGH TRAFFIC ROAD. THE OBVIOUS AND BEST WAY TO KEEP SLOWER
MOVING/TURNING TRUCKS OFF OF THE HIGHER SPEED LANES WOULD BE
TO ADD TURN AND ACCELERATION LANES. HOWEVER, THE PROPOSED
TRAFFIC DOES NOT WARRANT THIS AND THE USE OF THOSE LANES WOULD
REQUIRE A LONGER DISTANCE THAN WHAT IS AVAILABLE ALONG THE
FRONTAGE OF THE PROPERTY. WE SEE THE HIGH VOLUME WITH CR 53 AS
AN ISSUE THAT THE COUNTY WILL NEED TO ADDRESS IN THE NEAR FUTURE
THAT IS A PROBLEM WITH OR WITHOUT MR. CRUZ'S USR PROPOSAL. THE
BEST SOLUTION THAT WE CAN OFFER AT THIS TIME IS THE SITE ENTRANCE
IMRPOVEMENTS TO HELP TRUCKS NAVIGATE INTO THE SITE WITHOUT
HAVING TO COME TO A COMPLETE STOP AND ALSO SWINGING OUT INTO
THE OTHER LANE.
• Shane Ridings asked if a second entrance would help with access.

ROAD, HAS BEEN REQUIRED TO BE REMOVED.
• Joann Crosier stated that pipe clanking can be heard from their house. The term
"overflow parking" is a concern. Wondering if future use on the site will be more or
less than what is current or proposed.
MR. CRUZ RESPONDED: AS FAR AS FUTURE BUSINESS GOALS ARE
CONCERNED, HE SEES THAT HIS PROPERTY ALONE WOULD DEFINITELY NOT
SUPPORT ALL OF THE OPERATIONS THAT HIS BUSINESS NEEDS. ANOTHER
SITE IS NEEDED, AND THE SITE IN DOWNTOWN KERSEY THAT IS
CURRENTLY BEING USED MAY NOT BE AVAILABLE FOR MUCH LONGER.
THEREFORE, WE ARE LOOKING AT THE RENTING OR PURCHASING OF
ANOTHER COMMERCIAL PROPERTY FOR THE BUSINESS TO REPLACE THE
DOWNTOWN KERSEY LOCATION. MR. CRUZ STILL WANTS TO UTILIZE HIS
PROPERTY, ALTHOUGH OPERATIONS MAY NOT EVER ACHIEVE THE
SIZE/EXTENT AS WHAT IS BEING PRESENTED IN THE USR. HE JUST WANTS
TO ENSURE THAT THE USE IS APPROVED IF HE EVER WOULD NEED THE
PROPERTY FOR THE FULL BUILD OUT CONDITION.

• Joann Crosier asked if Mr. Cruz can ensure that his trucks won't be coming into the
site during school hours?
MR. CRUZ RESPONDED: IT WILL BE PART OF THE USR, BUT ALSO, HIS
DRIVERS ARE ALSO LOCAL MEMBERS OF THE COMMUNITY THAT HAVE KIDS
GOING TO SCHOOL IN KERSEY. THEY ARE NOT PAID BY THE TRIP, WHICH
RESULTS IN OTHER DRIVERS AGGRESSIVE STYLE OF DRIVING. HIS
DRIVERS WILLKNOW THE ROUTES AND SCHOOL TIMES AND IT ISN'T A
PROBLEM FOR THEM TO WAIT WITH THEIR TRUCKS AT THE DOWNTOWN
SITE TEMPORARILY UNTIL THOSE SCHOOL TIMES ARE CLEAR.
• Kellie Ridings asked if all 25 of his employees would park at his property?
MR. CRUZ RESPONDED: NO, HIS EMPLOYEES WOULD ALL PARK AT THE
DOWNTOWN LOCATION. THE ONLY ONSITE EMPLOYEE PARKING WOULD BE
FOR THE 1-2 OFFICE STAFF.
• Kellie Ridings asked if tank batteries would be cut on this site?
MR. CRUZ RESPONDED: NO, THAT IS NOT PART OF HIS OPERATIONS. ANY
TANK BATTERIES BROUGHT ONTO HIS PROPERTY ARE FIRST 'NORM'
TESTED FOR RADIOACTIVITY AND THEN WASHED/STEAMED/CLEANED. NO
RADIOACTIVE OR HAZARDOUS MATERIAL WILL BE STORED OR BROUGHT
ONTO HIS PROPERTY.
• Joann Crosier asked if language in the USR can specifically mention the prohibition of
radioactive or hazardous chemicals/material being brought or stored on the site? She
did not see that in the resolution before.
MR. KNAPP RESPONDED: I WILL CHECK THE LANGUAGE TO SEE IF THAT
WAS ALREADY IN THE USR BUT IF NOT, SINCE THIS IS NOT AT ALL PART OF
MR. CRUZS' OPERATIONS, WE HAVE NO PROBLEM ADDING IT INTO THE USR
APPROVAL LANGUAGE.
The neighbors asked if they could get a copy of the USR Resolution prior to the
meeting. Mr. Knapp responded that he would check with the planner to provide that
if everyone left their email addresses.

Here is some language I pre -wrote for USR18-0032 in case we need it for development standards.
This Use by Special Review permit is non-transferrable.
The hours of operation are 6:00 a.m. — 7:00 p.m., Monday — Friday, and 6:00 a.m. - 6:00p.m., Saturday, excluding school
bus route hours.
No radioactive or hazardous material shall be brought on to the site.
No oilfield pipe shall be stored onsite.
