RESOLUTION
RE : GRANT OF CHANGE OF ZONE FROM "A" (AGRICULTURAL) TO "C"
(COMMERICIAL) FOR CLARENCE EVERS.
WHEREAS, a public hearing was held on September 20, 1976,
in the chambers of the Board of County Commissioners , Weld County,
Colorado, for the purpose of hearing the petition of Clarence
Evers, 1203 Princeton Court, Longmont, Colorado, requesting a
change of zone from "A" (Agricultural) to "C" (Commercial) for
a tract of land located in the Southeast Quarter of Section 3 ,
Township 2 North, Range 68 West of the 6th P .M. , Weld County,
Colorado, being more particularly described as follows :
Beginning at the Southeast corner of said
Section 3 , thence South 89°31' West a
distance of 499 . 0 feet to a point, thence
North 41°48 ' East a distance of 41 . 25 feet
to a point; thence S , 89°34 ' 30" West along
the present North right of way line of
Colorado Highway #119 a distance of 108 . 0
feet to true point of beginning; thence
North 01°31 'E. a distance of 632 . 5 feet
to a point; thence S 89°31 ' West a dis-
tance of 345 feet to a point , thence
S 01°31 ' E a distance of 632. 5 feet to a
point on the North right of way of Colorado
Highway #119; thence Easterly along said
right of way 345 feet to a point of
beginning. Containing 5 acres, more or
less not zoned commercial by Resolution
of the Weld County Board of County
Commissioners on November 23 , 1966 .
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of
the petitioner for a change of zone upon the aforementioned
tract of land, and
WHEREAS, Sections 8 . 2 and 8 . 3 of the Weld County Zoning
Resolution authorized the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the
request of the petitioner and the recommendations of the Weld
County Planning Commission, and having been fully informed and
satisfied that the request for rezoning complies with the

Weld County Comprehensive Plan and the conditions set out in
Sections 8 . 2 and 8 . 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that the petition of
Clarence Evers for a change of zone from "A" (Agricultural)
to "C" (Commercial) on the above described tract of land be,
and hereby is, granted subject to the following conditions:
The land owner shall submit a final site plan and construction
schedule to be reviewed by the Weld County Planning Commission
and approved by the Board of County Commissioners prior to
development on the subject property. No time limitation is
placed upon this change of zone.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 27th day of September, A.D. , 1976.

I hereby certify that pursuant to a notice dated August 16, 1976
duly published August 20, 1976 and September 10, 1976 in the Greeley
Booster, a hearing was held on the request of Clarence Evers for a
Change of Zone at the time and place so specified. After discussion,
Commissioner Jacobucci made a motion to grant the Change of Zone on a
permanent basis. Commissioner Carlson seconded the motion and it car-
ried unanimously.

and Vivian P . Evers) land located. in. SE 1/4 Sec . 3 , T2N , R 8W of the
6th P .-W per case number Z -267 : 75 : 17 .
Pursuant to Section VIII , 8 . 4 CONDITIONAL PI*ILB of the Weld
County Zoning hanual , we hereby respectfully request a six month
extension period for t1 e purpose of "submitting a. final site plan
and commencing construction on the subject property" .
P+e further request that due to the unusual circumstances re-
gardin2 the aforementioned zoning change , that permanent C Zoning
be granted for the subject property.
The reasons submitted. at that time were :
1 . The original commercial zoning of the coatlgous property to
the East and a portion of this parcel. did not conform to the prop -
erty line; at the time of rezoning . (Part of the parcel was zoned
C and Part A.
2 . The proposed change of zoning is c npatable with surrounding
zoning which is all commercial .
3 . The ()reposed. change of zone would not effect the conlcercja1
value of say -ravel deposits because of the small acreage involved

The property was listed on the market for lease or sale at that
time and still is . There can be no plans for building until such time
that it is sold or leased .
I1ue to the requirements of Section VIII , 8 . 4 requiring an exten-
sion and with no provision for additional extensions and the validity
of the reasons for the change from A to C zoning , we sincerely hope
that. you will grant permanent C zoning rather than an extension .
of course recognize that the property is and would continue
to he subject to any building pJans as regards State Ni. hway right
of way reservations and specifications for noise/air pollution abate-
ment, drainage , etc . ; adherance to 100 year flood plain regulations
and the usual building and zoning codes .
