To Whom It May Concern,
As co -owners of Brady Rentals, With Steve Gorham, Darwin and Robyn Brady grant
permission and understand fully that in the matter of the rezoning and subdivision on E 18th st
for Brady Rentals. Steve Gorham speaks for us and has the ability to sign any and all
documentation in our behest as it pertains to the rezoning and subdividing of 626 E 18th St.
CHANGE OF ZONE/REZONING QUESTIONNAIRE:
1 How is the proposed rezoning consistent with the policies of the Weld County Code, Chapter 22? If the proposed
rezoning is not consistent with the Comprehensive Plan, explain how the proposed rezoning will correct what the
applicant perceives as faulty zoning, or how the proposed rezoning will fit with what the applicant perceives as the
changing conditions in the area.
How will the uses allowed by the proposed rezoning be compatible with the surrounding land uses? Include a
description of existing land uses for all properties adjacent to the subject property.
3 Will the property use a septic system or public sewer facilities?
Who will provide adequate water, including fire protection, to the property?
5. Does the property have soils with moderate or severe limitations for construction? If yes, the applicant shall submit
information which demonstrates that the limitations can be overcome.
Is the road and/or highway facility providing access to the property(ies) adequate to meet the requirements of the
proposed zone district? If not, the applicant shall supply information demonstrating the willingness and financial
capability to upgrade the road and highway facilities.
7 Is the change of zone area located in a Flood Hazard Overlay District?
8 Is the change of zone area located in a Geologic Hazard Overlay District?

change of Zone Questionnaire
The proposed is not only consistent with the policies of Weld County Code its been requested
by the planning commission for us to move forward with the construction of our commercial
building on this commercial site.
The proposed rezoning will be consistent with the neighborhoods mix of Residential and
Commercial zoning. There are commercial properties across the street and and to the north.
Residential properties are just to the south and scattered in to the east and west.
The proposed properties will both be tied in to Greeley Water and Sewer. A will serve letter has
been obtained from the Water and Sewer Dept.
The properties soil content is consistent with that of most Weld County Ag lands. It has always
been horse property or Ag property for as long as we can tell. There is no indication of
expansive soils. There will be no additional construction the property zoned R1,
The structure will remain the same and it is our goal to have access remain the same as it has
been as Balsam has very little traffic on this block
The change of zone is not in a Flood Hazard Overlay District

I reviewed the 1975 Sand and Gravel Map and it is hard to tell but it may be in a T-3 Stream Terrace Deposits — Sand or a
F-4 Floodplain - Aggregate that were not evaluated because of inadequate exposure. The property is 5 acres in size and
has a house on it. The surrounding area is built out with homes including a high density single family subdivision to the
south in Greeley so regardless of resource the size and location would make it extremely difficult to mine.

Diana,
I think we need to first determine if this parcel has any commercially viable resources per the
resource map. I think I provided that map to you in the past, but let me know if you don't have it and
can send it over. If the area is located in a viable area with commercial resources let me know. If it's
not, I don't have an issue with waiving this requirement.
Sec. 23-2-50. - Application requirements for change of Zone.
If, according to maps and other information available to the COUNTY, the Department of Planning
Services determines that there appears to be a sand, gravel or other mineral resource on or under
the subject property, the applicant shall provide a mineral resource statement prepared by a certified

geologist or other qualified expert, including but not limited to a Colorado Geological Survey. The
statement shall indicate the estimated quantity of resources and the economic feasibility of recovery,
now and in the future, of the resources so that the Planning Commission and Board of County
Commissioners can determine whether a COMMERCIAL MINERAL DEPOSIT is contained on or
under the subject properties.
