WELD COUNTY COUNCIL 1977
August 2, 1977

The Weld County Council met in regular session in full
conformity with the Weld County Home Rule Charter at
9th Avenue and 9th Street, Greeley, Colorado, August 2,
1977 at the hour of nine o'clock.
ROLL CALL: The following members were present:
Bob E. White, Vice President
John T. Martin, Councilman
Floyd Oliver, Councilman
Robert Martin, Councilman

Also present: Ed Dunbar, County Commissioner; Gordon Lacy,
Chairman of the Charter Revision Committee; six members of
the press; and secretary, Bev Thomas.
MINUTES: John Martin made a motion the July 19, 1977 minutes be
adopted. Floyd Oliver seconded the motion and it passed
unanimously.
CORRESPONDENCE: Acting Chairman Bob White stated that a Resolution
written by the County Commissioners regarding Road and Bridge
policy and the cost-estimate letter from Stone, Gray and Company
would be considered under Old Business. Bob read a letter from
Dr, Yoder regarding the Rolanda Feed Company matter and the
actions taken by the Health Department. He also read a letter
the Council had written regarding Rolanda Feed Company and a
letter to Mr. Baty. Accountant reports and financial statements
were distributed from Anderson, Hunter, Thomte, and Kuntz.
OLD BUSINESS:
LOUSTALET RESOLUTION:" Bob Martin made a motion that two changes be
made in the proposed Loustalet Resolution. The changes were as
follows:
1) In the title change "alleged" to "possible".
2) Change paragraph one to read:
The Weld County Treasurer, Francis M. Loustalet,
inherited stock in the First National Bank of
Greeley, Colorado which was later purchased by
the First National Bank Corporation.
John Martin seconded the motion and it carried.
BATY HEARING: Floyd Oliver gave a report on the July 27, 1977 Baty
Hearing conducted by the County Commissioners. Floyd Oliver,
Bob Martin, and John Martin, who had all attended the meeting,

agreed the Commissioners had heard everything Mr. Baty had
to say and that he had been given just and proper consideration.
Bob Martin thought the case was a moral issue and that the
County had taken alot and given the Baty's little in return.
All members agreed that no action should be taken by the
Council on the matter at this time. The Council felt that
the entire episode points out the necessity of the County
having specific written agreements to avoid this type of
situation in the future. Bob White and John Martin said that
they thought the County now operates under procedures that
eliminate this kind of-problem arising again.
ROAD AND BRIDGE INVESTIGATION: Bob White read to the Council the
July 13, 1977 Resolution of the County Commissioners regarding
Road and Bridge policy.
The testimony collected by the County Commissioners from Road
and Bridge personnel was discussed. Council members felt that
their earlier-stated concerns regarding the Division were
confirmed in that testimony.
The Greeley Tribune article of July 25, 1977 regarding the
discrepancy in the IGA fund was also discussed followed by a
five-minute recess.
Bob White read the letter from Stone, Gray and Company giving
a cost-estimate for an audit of the Road and Bridge Division.
There was discussion about what exact aspects of the Division's
operations would be included in the investigation that Mr.
Lorie's letter suggested.
Floyd Oliver made a motion the Council table pursuing an audit
of Road and Bridge until the September 6, 1977 meeting. John
Martin seconded the motion and it passed unanimously. The
Council felt it could make a better decision about having an
audit after it had met with Mr. Dority on August 16, 1977. The
secretary was instructed to inform Stone, Gray and Company of
the Council's decision.
MAY 20TH COUNTY AUCTION: Bob White read a note from the Council
secretary which explained the materials she had collected
regarding the auction. He also read the resolution written by
the County Commissioners which gave authority to hold the
auction. He wondered if some items were sold without the County
Commissioners' approval and there was a short discussion
questioning the adequacy of the advertising for the auction.
Bob White instructed Bob Martin, the Council's finance person, to
look over the auction matter and give a report at the next meeting.
NEW BUSINESS:
REQUEST FOR BUDGET PREPARATION: Bob White read excerpts from the

budget preparation instructions to the Council. Floyd Oliver
made a motion that Nancy Clark and the secretary fill out the
necessary Budget Preparation forms, based on the 1976 Budget,
for approval at the August 16, 1977 meeting. John Martin
seconded the motion and it passed unanimously.
MISCELLANEOUS: Mr. Gordon Lacy, Chairman of the Charter Revision
Committee, was present and invited the Council to meet with
his canmittee on August 17, 1977 at 7 P.M. in the County
Commissioners' Chambers on the third floor of the Centennial
Building.
There being no further business, the meeting was adjourned.
