Evidence of Adequate Water Supply
DCF previously hired the Central Weld County Water District to install a new water main and water tap to
provide drinking water and process water to the existing DCP O'Connor Gas Plant (May 9, 2012)
Water Main Extension and Tap Agreements dated May 9, 2012, attached.
No additional water is needed as part of the O'Connor 2 plant expansion project.

TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this ,i day of . _ ,

WHEREAS, District has been organized as a legal body and is known as the Central Weld County
Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring to join said District, or
and,
WHEREAS, Customers are desirous of acquiring one water tap of 2 inches in. diameter from the said
District
NOW, TISREFORBS in consideration of the premises and The teams of this agreement, it is mutually
agreed as follows:
1. Customer agrees to pay the tap fee of 1(,240.0

2. The description of the premises for which this tap is being purchased is as follows:
The S 1/a of the S 1/2 of the SE 'A of Section 31, .Township 5 North, Range 64 W of the 6t P.M.,
Weld County, Colorado. Said parcel formerly being Lot A and a portion of Lot B, Recorded
Exemption No. 0963-3 1-3 RE -493 6, according to the map thereof recorded February 5,. 201:0 at
Reception Number 36743 SS and being amended therefrom by the execution and recordation of
Amended Recorded Exemption No. D963 -3t-3 AMRE 4936, County of Weld, State of
Colorado.
3. This agreement when approved by the Board. of Directors, shall become a legal and binding
contract upon all parties hereto.
4. Customer further agrees to execute any and all easements needed. by District at no expense to
District, across Customer's property for the purpose of installing the District's service line and meter pit
constructed by District. District shalt be responsible for restoring surface area back to reasonable condition
at District cost.
5. It is further mutually agreed that this agreement shall extend to and be binding upon the heirs,
executors, administrators and assigns of the parties hereto,
6. Customer farther agrees to the following special provisions:

WHEREAS, DISTRICT has been organized as a legal body and is known as the Central Weld County
Water District, and
"'HER AS, OWNERS are taxpaying electors within said DISTRICT, or have petitioned to join said
DISTRICT, and
WHEREAS OWNER owns the following described real property within the service area of the DISTRICT:
(Said property is hereinafter referred to as the Subject Property.)

Weld County, Colorado. Said parcel formerly being Lot A and a portion of Lot B, Recorded
Exemption. No. 0963-31-3 REe4936, according to the map thereof recorded February 5, 2010 at
Reception Number 3674388 and being amended therefrom by the execution and recordation of
Amended Recorded Exemption No. X0963.431-3 Al\ E-4936, County of Weld, State of Colorado.
WHEREAS, DISTRICT water facilities are not presently located to service adequately the Subject
Property, and,
WHEREAS OWNER wishes to have the DISTRICT construct water mains to service the Subject Property,
and,
WHEREAS DISTRICT wishes to construct said water mains on the terms and conditions hereinafter set
forth and.,
WHEREAS, OWNERS are requesting water service by separate tap fee agreements and will acquire one
water tap(s) with meter size of 2 inches from the said DISTRICT, and,
WHEREAS DISTRICT reserves the right and has the authority to consider each extension contract and
rebate provision individually, and administer as determined appropriate based on varying conditions.
NOW) THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually
agreed as follows:
1. Prior to any expenditure or construction by DISTRICT, OWNER agrees to pay, in advance, the
amount of ,$ 463 240.00 based on the estimated costs for all material, labor, installation, fees and
other costs directly applicable to extension and meter set(s), less any credits allowed by DISTRICT.

2. DISTRICT agrees to provide credits to OWNER in the total amount of $ _ 48,000.00
for tap(s) purchased,
OWNER maybe entitled to a rebate From DISTRICT based on new services being ridded to the
exte°r s on paid for by OWNER. pinata shall only pay a rebate on extension, DI STRICT
shall not pay rebates in excess of the total amount of 5 240,00, . Said rebates,
when approved by DISTRICT, will be in the amounts of the actual CIF included in the tap fees for
services attached to this extension, Rebates will not be paid to OWNER by DISTRICT after 10
years from date of this contract.
4. OWNER agrees to execute any and all easements needed by DISTRICT at no expense to
DISTRICT, across OVThIP]S property for the purpose of installing any pipelines constructed
by DISTRICT. DISTRICT shall be responsible for restoring surface area back to reasonable
condition at DISTRICT cost,
5, OWNER agrees to abide by rates established and the rules and regulations of the DISTRICT.
6. This Agreement shall be governed by and construed in accordance with the laws of the Slate of
Colorado.
7 This Agreement constitutes the entire agreement between the parties with respect to the extension
of the water mains herein described, and supersedes all prior arrangements or -understandings with
respect thereto,
8. This Agreement may only be modified, in writing, by the Board of Directors of the DISTRICT.
9, This Agreement shall be binding upon, and shall inure to the benefit of, the parties hereto, and
their successors, heirs, and assigns.

Evidence of Adequate Sewage Disposal
DUP previously hired a licensed engineering firm (pre -qualified by Weld County) to design the existing
septic system and leach field for the O'Connor Gas Plant. The contractor built a new approved septic system
(see attached Septic Permit #S P-1200195 dated April 12, 2013). The septic system was installed by a
licensed plumber in compliance with the engineered plans and septic permit requirements. Weld County
Department of Environmental Health inspected and approved the septic system that was installed at the
O'Connor plant,
• Since the original septic system was oversized for additional capacity, installing the natural gas
processing equipment as part of the O'Connor 2 Gas Plant Expansion Project will not impact the
integrity of the existing septic system and leach field.
