You are correct that this lease, in paragraph 3, state that a shut-in payment shall be made in the sum of $100 per well. The payments issued are in accordance with that provision and the wells are referenced by their API numbers on the check. The reason the checks are issued in the above referenced amounts to Weld County is because Weld County does not own the full mineral interest in this lease. A portion of the interest belongs to Miller Family Farm LLC. Please refer to the Quit Claim Deed recorded under recordation number 3716140 dated 9/2/2010. I am sending back the referenced check # 50023922 as we believe it contains the required notations and is issued in the correct amount. As far as check # 50023 876 is concerned, please read further. In regards to the Robert Sakata GU 1 well, listed as API 0512307918, upon further review of COGIS records we have determined that the well is not spaced over the referenced lease and therefore should not be included with your payment. Our records are now updated to reflect this. I have voided check # 50023876 and included a copy of the re- issued check # 7745001644 in this correspondence in the amount of $274.10 for the remaining five wells.
