RESOLUTION RE: GRANT OF CONDITIONAL USE PERMIT NO. 22 TO CONTINENTAL PIPE LINE CO. WHEREAS , the petition of Continental Pipe Line Co. , 1822 Warren Avenue, Cheyenne, Wyoming 82001, for a Conditional Use Permit for a crude oil truck transfer facility on a parcel of land located in the Northwest Quarter of Section 20, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, said tract being more particularly described as follows, to- wit: Beginning at a point on the South line of said NW Quarter of Sectio 20 from whence the West quarter corner of said Section 20 bears North 89°55'51" West, 45.00 feet; thence North 00°10'00" Fast, 390.35 feet along the East right-of-way boundary of U.S. Highway 85; thence South 89°55'51" East, 333.70 feet to a point on the West right-of-way boundary of the Union Pacific Rail- road; thence South00°08'58" East, 390.35 feet along said West boundary of said Union Pacific Railroad to a point on the South line of said NW quarter of Section 20; thence North 89°55'51" West 335.86 feet to the point of beginning; this described tract containing 3.000 acres; and excepting therefrom all rights-of-way and easements which are of public record, came on for hearing at a public meeting held on February 7 , 1977 , in the Chambers of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, the above described parcel of land is located in an Agricultural Zone as set forth in the Weld County Zoning Resolution, and WHEREAS, the above described parcel of land is below the minimum lot size of 80 acres required in an Agricultural Zone, and WHEREAS, Section 3. 3 (D) (4) (m) of the Weld County Zoning Resolution authorizes a pipe line terminal in the Agricultural District on the grant of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the petitioner was present by a representative of said petitioner, and WHEREAS, the Board of County Commissioners has considered all the testimony and statements of those present, has studied the request of the petitioners , and has studied the recomendation / 7 70 346 ,,. .., PL0752 . i i of the Weld County Planning Commission, and having been fully informed and satisfied that the requested use complies with the Weld County Comprehensive Plan and the provisions of the Weld County Zoning Resolution, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners, Weld County, Colorado, that the application of Continental Pipe Line Co. for a Conditional Use Permit for a pipe line terminal on the above-described parcel of land, be and hereby is, granted subject to the Development Standards contained in the Conditional Use Permit together with the amendments thereto. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 7th day of February, A.D. , 1977 . The proposed facility complies with the Weld County Comprehensive Pla] Said plan states, "Rural industrial development should be encouraged only when the industry. . .requires a physical environment that cannot reasonably be furnished in a municipality. " The proposed facility requires a location close to Continental ' s main pipeline between Denver and Cheyenne as well as a site with easy high• way access. These locational requirements could not be met within an existing municipality. 2. It is the opinion of the Planning Commission that this proposed facil is in compliance with the provisions of Section 3. 3(E) (2) of the Weld County Zoning Resolution which states, "The Planning Commission and t. " This determination is based on the following: A. A petition form in support of this Conditional Use Permit application has been submitted. The petition form has been signed by the majority of the property owners in the surrounding area. None of the remaining property owners in the area have indicated any objections to the proposed facility. B. The Weld County Health Dept . has indicated the proposed facility is in compliance with all applicable Weld County and State Health Standards and Regulations. C. The Ft . Lupton Planning Commission has indicated their approval of the application with the stipulation that acceleration/decelerati, lanes be installed on U.S. Highway 85 to help alleviate possible traffic problems. D. The concerns of the Platteville Ditch Co. have been cooperativel met by Continental Pipe Line Co. so that the proposed facility will be compatible with the operation and maintenance of the irrigation ditch. Changes and Additions to Development Standards Add to Development Standard #1 : The material storage shall be located no closer than 50 feet from the east right-of-way fence on U. S . High- way 85. Access to the material storage area shall be from the internal driveway. Material to be stored shall include the following : a) 2-inch, 3-inch, 4-inch, 6-inch, 8-inch, 10-inch line pipe in the following maximum quantities : a) 2-inch: 300 feet b) 3-inch: 1500 feet c) 4-inch: 1500 feet d) 6-inch: 500 feet e) 8-inch: 300 feet f) 10-inch: 300 feet b) 2-inch through 10-inch steel valves with a maximum number of valves of all sized to be 15. c) 2-inch through 10-inch flanges , elbows, tees, and other steel fittings , with a maximum number of fittings to be 20. d) Pumps , engines , and electric motors with a maximum of 15 items . Change development Standard #7 : Parking for up to five oil transport trucks lin addition to two at the unloading point) will be provided on the property. Add to Development Standard #10: Said acceleration/deceleration lanes shall be installed by Continental Pipe Line Co . by July 1 , 1977. Add Standard: Upon cessation of operations of the crude oil truck transfer facility all structures shall be removed to 30" below grade and the CUP area shall be reclaimed to afarmable state . Add Development Standard: There shall be no parking of oil transport trucks on County Road 184- either before or after unloading. • CONTINENTAL PIPE LINE CO. Conditional Use Permit Proposed Development Standards 1 . The permitted uses on the hereon described parcel of land are : a. a crude oil truck unloading facility; and b. material storage The uses shall be limited to the facilities and areas shown on the Conditional Use Permit plan. 2 . There shall be only two Automatic Custody Transfer (A.C.T. ) Units at the site. Each A.C.T. Unit shall consist of a strainer, a meter, and an automatic sampler together with necessary valves, piping and related appurtenances. 3. A paved apron complete with catch basins shall be placed in the area of the unloading activity so as to gather and contain any oil which is lost during unloading operatons. 4. The Conditional Use Permit area shall be surrounded by a 3 strand barbed wire fence as shown on the plans. 5. The above ground piping and equipment at the truck unload- ing facility shall be enclosed by a six foot chain link fence topped with three strands of barbed wire. 6. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 7. Parking for up to four oil transport trucks (in addition to two at the unloading point ) will be provided on the property. 8 . Access shall be limited to the two proposed points shown hereon. The traffic pattern at the facility shall be one- way only. 9. Noise levels at the property lines shall not exceed the following limits : a. 55 db(A) from 7 A.M. to 7 P.M. , and b. 50 db(A) from 7 P.M. to 7 A.M. . S Continental Pipe Line Co. February 1 , 1977 Page 2 10. Acceleration/deceleration lanes shall be installed by Continental Pipe Line Co. at the intersection of County Road 181 and U. S. Highway 85 in accordance with the requirements of the State Highway Department . 11 . No fences shall be constructed across the Platteville Ditch . Any fence parallel to the ditch will be placed no closer than fifteen feet from the toe of the exist- ing dike. 12. Continental Pipe Line Co. shall provide personnel and appropriate fire fighting equipment to stand-by during the burn-off of weeds along the ditch adjacent to their facilities in order to confine the burned area. 13 . All internal roads shall be graveled. 14. The appearance of the facility shall be maintained in a neat and orderly condtion through periodic painting and maintenance. 15. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the development standards stated above and all applicable Weld County regulations. Lupton SUBJECT : Crude Oil Truck Transfer Terminal APPEARANCE : Richard Hamm, District Manager DISCUSSION: Mr. Hamm explained that this proposal is; unload crude oil trucks . IIe stated that the location was also going to be used for material storage for random length of line pipes, fittings , pipes, etc. He stated that this facility would face County Road 18 . The estimate number of trucks per day will be approximately 20. During peaking of the wells it could be as many as 40 trucks in a given day. Mr. Fortner stated that State..has recommended acceleration/deceleration lanes on State Hwy. 85. Tom IIonn read the comments recommending approval . He also read the development standards that would be proposed. Mr . Glen Paul stated that the decebel reading should be considered when the facility was started. Mr. Hamm stated that since this is a new facility that they would be able to get equipment that would meet the standards . Gary Fortner stated that he would like a little better explanation of material storage that would be out in the area. Mr. Hamm stated that they could file a letter listing the kinds, types , and equipment stored there . It would only be material related to installing their lease connection program. These locational requirements could not be met within an existing municipality. 2. It is the opinion of the Planning Commission staff that this proposed facility is in compliance with the provisions of Section 3.3(E)(2) of the Weld County Zoning Resolution which states, "The Planning Commission and the Board of County Commissioners shall consider the following in making their determination in approving or denying a special use permit: Compatibility with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses, need for the proposed use, its effect upon the immediate area, its effect on future development of the area and the health, safety, and welfare of the inhabitants of the area and the County." This determination is based on the following: A. A petition form in support of this Conditional Use Permit application has been submitted. The petition form has been signed by the majority of the property owners in the surrounding area. None of the remaining property owners in the area have indicated any objections to the proposed facility. B. The Weld County Health Dept. has indicated the proposed facility is in compliance with all applicable Weld County and State Health Standards and Regulations. Very truly yours, PDL-mlc Attachment CONTINENTAL PIPE LINE COMPANY CONDITIONAL USE PERMIT PROPOSED DEVELOPMENT CRITERIA (ADDENDUM) Material storage point shall be situated on land to the west of the truck unloading points and no closer than fifty (50) feet from the east right-of-way fence on U S Highway 85. Dimensions shall be 170 feet deep from County Road 181 right-of-way and fifty (50) feet wide. Access and egress shall be from proposed internal truck driveway. Material to be stored shall include the following: 1) 2-inch, 3-inch, 4-inch, 6-inch, 8-inch, 10-inch line pipe in the following maximum quantities: a) 2-inch: 300 feet b) 3-inch: 1500 feet c) 4-inch: 1500 feet d) 6-inch: 500 feet e) 8-inch: 300 feet f) 10-inch: 300 feet 2) 2-inch through 10-inch steel valves with a maximum number of valves of all sizes to be 15. 3) 2-inch through 10-inch flanges, elbows, tees, and other steel fittings, with a maximum number of fittings to be 20. 4) Pumps, engines, and electric motors with a maximum of 15 items. CONTINENTAL PIPE LINE COMPANY CONDITIONAL USE PERMIT Description of Proposed Operation The Conditional Use property, belonging to Ralph 0 and Lillian G Elliott, will be leased by Continental Pipe Line Company on an annual renewal basis for a period not to exceed ten years under the provisions of the attached Option For Surface Lease, or for such period and under such provisions as may be negotiated with the owners in the future. The proposed truck unloading facility will be maintained and super- vised by our present staff of employees based at our Ft. Lupton Pump Station which is near the proposed facility. There will be no personnel physically assigned to the facility as the operations are to be completely automated requiring only spot checks and periodic maintenance. Thus, no water supply or sewage disposal system will be installed. The facility will be designed and constructed such that two crude oil transports can unload their cargo simultaneously while up to four additional transports may wait on the property. Truck traffic volume will not exceed fifty trucks in any twenty-four (24) hour period, with the average number of trucks being approximately twenty per day. Truck traffic will be highest during daylight hours with approximately one- fifth of the activity occuring between the hours of 6 PM and 6 AM daily. Individual transport operators will make the necessary connections to the facility in order to unload their cargo through the two proposed Automatic Custody Transfer (A.C.T.) Units at the site. Each A.C.T. Unit will consist of a strainer, a peter, and an automatic sampler together with necessary valves, piping and related appurtenances. The crude oil thus transferred will be delivered via underground pipeline to an existing pipeline in the vicinity for further delivery to Continental Pipe Line Company's Ft. Lupton Pump Station and eventual pipeline delivery to refineries in Denver, Colorado. The proposed facility will serve to reduce traffic congestion at Spindle Station (a similar existing facility approximately six miles to the East) as well as decrease heavy truck traffic operating on State and County roads between Spindle Oil Field in Weld County and refineries in Denver, Colorado. The facility will be designed to eliminate the hazard of ground water pollution through the use of a paved apron in the vicinity of the un- loading activity complete with catch basins which will gather and contain any oil which is inadvertently lost during unloading operations. The above-ground facilities at the site will be enclosed by a six foot high chain link fence topped with three strands of barbed wire. 12-16-76 • • CONTINENTAL PIPE LINE COMPANY CONDITIONAL USE PERMIT Proposed Development Criteria Permitted uses of the land shall include the construction and operation of a truck unloading facility together with a material storage point. Site preparation shall include construction of a gravel driveway into the facility together with a paved apron at the unloading point with catch basins to collect any oil lost during unloading operations. There will be two Automatic Custody Transfer (A.C.T.) Units at the site. The entire facility shall be surrounded by a three strand barbed wire fence except on the frontage with the county road at which point the fence shall be tied in with the existing county road right-of-way fence. Above ground piping and equipment at the truck unloading facility shall be enclosed by a six foot chain link fence topped with three strands of barbed wire. The appearance of the proposed facility shall be maintained in a neat and orderly condition through periodic painting, maintenance, and weed control. Parking for up to four oil transports (in addition to two at the un- loading point) will be provided on the property. The traffic pattern at the facility shall be one-way only in order to maximize parking areas. In attendanrP were: Messrs Elton Miller and John Kunanan; President and Secretary respectively, of the Platteville Irrigation and Milling Company. Representing Continental Pipe Line Company was Mr R David Lee, District Engineer for the Rocky Mountain District of that company. Mr Lee provided copies of the Description of Proposed Operation and Proposed Development Criteria (attached) which Continental Pipe Line Company has submitted with its application for a Conditional Use Permit. Drawings and sketches of the proposed facility and its location were also provided for review by the Irrigation Company representatives. Following extensive discussion of the Irrigation Company's operations and Continental Pipe Line Company's proposed operations and facilities, several points were established as desirable operational or developmental criteria to ensure compatibility between the two companies. The major concern of the Irrigation Company representatives centered upon continued free access to their ditch for maintenance and other purposes. In line with this, it was agreed that Continental Pipe Line Company will construct no fences across the existing ditch and that any fence parallel to the ditch will be placed no closer than fifteen (15) feet from the toe of the existing dike. Of concern to both the Irrigation Company and Continental Pipe Line Company is continued safety in the annual burn-off of weeds along the ditch where it is near existing or proposed Pipe Tine facilities. In the interest of safety during such activity by the Irrigation Company, the following was agreed to: 1) Continental will continue its program of weed control at existing facilities and will establish weed control within fence lines at proposed facilities adjacent to the Platteville Ditch. 2) It will continue to be the responsibility of the Irrigation Company to implement their weed burn-off activity when and as they sec fit; with the added responsibility of providing advance notification to Continental Pipe Line Company personnel. 1\,w to File Page Two 3) Continental will provide personnel and appropriate fire fighting equipment to stand-by during the burn-off of weeds along the ditch adjacent to their facilities in order to confine the burned area. This is a deep well drained soil on a terrace of the Platte River. The surface layer is a clay loam which is underlain by sand and gravel at a depth of 20 to 40 inches. Water permeability of the surface soil is moderately slow and the erosion hazard is low. Generally, all trees and shrubs adapted to this area will grow satisfactorily on this soil. Recommended trees are Rocky Mt. Juniper, Ponderosa Pine, Cottonless Cottonwood, Russian Olive, and Hackberry. The surface soil has a moderate to high shrink-swell characteristics. The subsoil has a high permeability which could cause contamination of the ground water supply from leach fields or other surface water. The subsoil makes satisfactory road fill. The Division would request that accel/decel lanes be added to the existing roadway of US 85. The proposal is for an average of 20 trucks per day. This would warrant the need for accel/decel lanes. The developer should be responsible for construction of these. Enclosed is a copy of portions of the Division's right-of-way plans and construction plans for US 85 in this area. At the present time, there is a paved, ten-foot wide outside shoulder and four-foot wide paved inside shoulder. The Division would require that an accel lane be constructed at the median opening on the southbound lane, and that a decel lane be constructed along the southeast quadrant of the intersection. Require- ments are described below. Authority on this requirement is per Title 42, Article 4, Part 115, "Regulation of Driveways" , of the Colorado Revised Statutes 1973. Recent telephone conversations from you and Mr. David Lee, District Engineer for Continental Pipeline Company, informed the Division of relocating the proposed site from County Road 20 to County Road 181/2. Please be advised the Division will require the following at either location. An acceleration lane shall be paved, 12-foot wide travel lane with a four- foot paved shoulder, extending 950 feet south of the opening to include a 250- foot length of taper at County Road 20, and at County Road 182, the Division will require an acceleration lane 600 feet south of the opening to include a 100-foot length of taper. A deceleration lane shall be a paved, 12-foot wide travel lane with a four- foot paved shoulder, extending south 450 feet including a 250-foot length of taper at either location. • Weld County US 85-Co. KEN MCWILLIAMS January 28, 1977 Page Two Travel lanes shall have a minimum of three inches of hot bituminous pavement (HBP) and the shoulder shall have a minimum of two inches of HBP. Travel lanes and shoulders shall have a minimum of four inches of aggregate base course. Median drainage will be a problem at either location. The Division requests that the developer examine two alternatives. One is to extend the median drains south of either median opening or plug the median drain and install 18" CMP through the median opening. The Division will assume responsibility for drainage south of the acceleration lane. A rough estimate of construction costs for accel/decel lanes would be $6,500 for County Road 182 and $7,500 for County Road 20. The above estimates include the following: 3 inches of Hot Bituminous Paving, 4 inches of Aggregate Base Course, Embankment, extending the median drain or plugging and installing new median side drain, and seeding new slopes. The Division will inform Mr. Lee of the above by copy of this letter. Attached to Mr. Lee's copy will be copies of the Division's "As Constructed" plan sheets for these areas. They include, but are not limited to requests for zonings, rezon- ings, subdivision plats, planned unit developments, gravel extraction permits, and the formation or al- teration of a special district. Such proposals re- quire careful review to insure that steps are taken to minimize the detrimental effects the land use change may have on a nearby highway. These effects include a decrease in traffic serviceability due to increased traffic friction, highway flooding due to the recontour of the land, and safety hazards due to heavy vehicle and pedestrian cross traffic. Items required in the review of any land develop- ment proposal are described in the sections which follow, under the headings of "Approaches," "Right- of-Way," "Drainage," "Environmental," and "Other Considerations." -2- Approaches Generally, access from a State Highway must be minimized . Access from a State Highway to a subdivision shall be provided by the main sub- division roads only. The access to individual lots within the subdivision must be provided from the main subdivision roads or other subdivision streets. Where zoning is to be of a type that will create a high intensity of vehicular use, serious consideration shall be given to the development of a frontage or service road system. The buffer strip between the highway and service road provides an ideal space for roadway signing, utilities, lighting and other uses. Where zoning is being upgraded to a more intensive use and a frontage road becomes necessary, a frontage road shall be constructed at the cost of the developer. When an approach is determined to be necessary, several items should be addressed. They are: 1. Approaches must be located at a point which has adequate sight distance. Sight distance standards are given in the attached appendix. 2. If another approach exists on the opposite side of the highway, the new approach should be located directly opposite or separated a sufficient distance for proper traffic control. 3. Projected traffic volumes shall be checked to determine if inter- section channelization is warranted. Warrants for channelization are given in the attached appendix. Necessary channelization -3- is to be constructed at the developer's expense. Design of channelization will be in accordance with Division of Highways Standards. 4. Approach road must be of adequate design to carry the projected traffic. Right-of-Way Consideration must be given to the preservation of at least the minimum right-of-way that will be needed for improvement of the highway to the classification shown on the long range regional transportation plan. Any additional right-of-way needed to meet this requirement shall be protected by reservation, setback or dedication (preferably the latter) as local zoning laws and regulations permit. Where the comprehensive plan for the area indicates that sidewalks, bicycle paths, noise berms, etc., will be built adjacent to the highway, additional right-of-way widths must be reserved to accomodate these facilities. Any right-of-way needed for intersection channelization or a drainage modification resulting from a land development proposal must be furnished by the developer. Also, all developers shall insure that adequate space is available for placing and maintaining utilities. This cannot always be done on the highway right-of-way. In addition, a comparison should be made between the right-of-way shown on the Division of Highways' plans and the developer's plans to insure that they agree. Finally, access control will be preserved. -4- Drainage Due consideration must be given to run-off attributable to the development proposal. In general, the developer must not recontour the land so that water will drain onto the highway right-of-way where it has not historically done so. Where a drainage system has been developed and an increased run-off or rate of run-off is attributable to the development proposal, the developer must provide necessary on-site drainage retention ponds to hold the increased run-off attributable to the development proposal. If this is not possible, the developer must bear the cost of new or enlarged drainage structures on the highway right-of-way. Also, drainage from sewage lines, sewage ponds, or other waste water will not be permitted to drain onto the highway right-of-way. Finally, alterations of the drainage pattern adjacent to the highway right-of-way in areas of swelling soils or high fills which result in increased absorption of surface water shall not be made. Environmental It is important to take into consideration what impact the traffic on the highway will have on noise and air pollution levels at the site of the proposed development. Developers shall bear the responsibility for providing those abatement measures that may be required to meet the minimum environmental standards. If the highway was built or reconstructed since 1970, it is possible that an air quality or noise impact analysis has been completed. • • -5- If so, this analysis should be useful to the developers to determine what • steps they can take to reduce the impact on air quality and noise. As a general rule for meeting noise standards, residential improvements should generally be setback a minimum of 150 feet to 200 feet from the nearest travel lane and business improvements should be set back a minimum of 100 feet to 150 feet from the nearest travel lane, unless some other type of noise abatement measures (walls, earth berms, noise insulated walls and windows, etc .) are constructed . A more specific determination can be made only after the parameters for the highway involved arc evaluated . As might be expected, the degree of air pollution decreases as the distance from the source increases. Although this item .onsists of so many variables, such as meterology, emission values, etc., there are presently no definite parameters to go by. In development proposals such as hospitals, private residences, etc. , where air pollution is a sensitive issue, the best course of action is to keep them as far away as possible from air pollution sources and out of valleys where pollutants tend to collect. Other Considerations In certain cases other items should be considered. In a city it may be appropriate adjacent to some highways to have the developer provide curb and gutter, and sidewalks, In some rural areas developers should bear the cost of cattle guards at approaches where the rear and sides of a development are not fenced to prevent cattle from coming onto the highway right-of-way. -6- In cases where a development straddles a highway, provision should be made for the movement of pedestrian traffic across the highway. Traffic signals or pedestrian overpasses should be provided at the developer' s expense. Developers are encouraged to establish plant material on the highway right-of-way for the purpose of screening their development from the highway or to accent other plantings within their development. However, in order to assure continuity of landscape features along the state highways, the Division' s landscape architects will review any proposal of this nature. Developers shall not locate heavy structures such as large buildings, ground support storage tanks, or stockpiles of borrow or aggregate adjacent to the tops of large cuts in semi-stable materials. Surcharge loads such as these could cause failure of the cuts. These failures could occur in rock as well as soil if the rock were highly fractured or jointed, or if the material contained bedding planes which dipped toward the road. During excavation or leveling operations, material shall not be removed on the downhill side of a highway located on sloping semi-stable ground. This situation may result in the removal of enough support to permit a slope failure involving the roadway. Provisions for insuring payment for the cost of channelization, signalization, or drainage improvements will be a deposit of funds in escrow account, performance bonds or other arrangments acceptable to the Division. All developers are to be aware that permits are necessary for driveways and that they must be obtained from the Division's Maintenance Superintendent in their area. -7- The Division' s District Engineers will review all proposals, to insure that they are consistent with regional and local plans. They will also meet with regional and local planners and with developers to review the traffic safety aspects of major proposals. Finally, developers should keep the Division notified of any changes in their plans or of any problems encountered during construction of the develop- ment. These notifications should be given to the Division' s District Engineer in their area. -8- APPENDIX1 Sight Distance The minimum stopping sight distance shall be provided on each separate leg or turning lane of an intersection consistent with its respective design speed. An exception is the sight distance to an exit nose which shall be at least 600 feet and preferably 1,000 feet. In addition, the maximum obtainable intervisibility between vehicles approaching the intersection should be provided. The minimum intervisibility shall be as shown on Figure 406-1. Channelization Speed change lanes shall be provided as indicated on Table I. A separate turning lane is warranted when an individual turning movement is 25 vehicles or more per design hour.
