RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO
SIGN - COLORADO STATE UNIVERSITY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Extension Office, and Colorado State University,
commencing upon full execution of signatures, with further terms and conditions being as stated
in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Extension Office, and Colorado State University, be and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of December, A.D., 2018.

MEMORANDUM OF UNDERSTANDING
COLORADO STATE UNIVERSITY
and
WELD COUNTY, COLORADO
This Memorandum of Understanding ("MOU") entered into this _8th day of _November
20//3 by and between Colorado State University Extension (hereinafter referred to as "Extension") and Weld County,
Colorado, by and through the Board of County Commissioners of Weld County (hereinafter referred to as "County").
WHEREAS, County desires to participate in the educational programs as authorized by the Smith -Lever Act, as
amended, and other acts supporting Extension programs,
WHEREAS, Extension is authorized by State and Federal law to conduct Extension educational programs in the
State of Colorado, and,
WHEREAS, Extension programs are developed in response to local needs, Extension plans of work and program
prioritization are determined jointly by the County Extension Advisory Committee, County Commissioners, and CSU
Extension faculty and staff,
WHEREAS, the Parties recognize that Extension has discretion concerning funding for and the provision of
Extension education programs, which may include youth development, consumer sciences, family development, health
education, community and economic development, agriculture, horticulture, natural resources, and "subjects authorized by
the Smith -Lever Act as amended and other Acts supporting cooperative extension work", and
WHEREAS, Extension and County desire to enter into this MOU to set out the nature of the program and the
relationship of the Parties:
NOW, THEREFORE, the Parties hereby agree to expend their best efforts to conduct and support an Extension
program in the County under the following terms and conditions:
Section 1. County agrees:
(a) To furnish suitable office space, and pay the costs of utilities, travel, office expenses, supplies, and equipment
needed to conduct Extension programs in the County, as determined by the Board of County Commissioners
through its budget process.
(b) To provide 85% funding, including salary and fringe benefits, for one full-time professional staff position in
the area of 4-H Youth Development/Livestock, which is referenced below in Section 2(c). Funds for this
position will be allocated to Extension. Extension will hire and administer this position in accordance with
CSU Extension policies and procedures.
(c) To provide 50% funding, including salary and fringe benefits, for one full-time professional staff position in
the area of Horticulture and Agriculture, which is referenced below in 2(d). Funds for this position will be
allocated to Extension. Extension will hire and administer this position in accordance with CSU Extension
policies and procedures.

(d) To provide 50% funding, including salary and fringe benefits, for one full-time professional staff position in
the area of Family and Consumer Sciences, which is referenced below in 2(e). Funds for this position will be
allocated to Extension. Extension will hire and administer this position in accordance with CSU Extension
policies and procedures.
(e) To provide 100% funding, including salary and fringe benefits, for one half-time Weld County Colorado
Master Gardener Coordinator staff position.
(f) To provide necessary and adequate clerical, and secretarial personnel, as determined by the Board of County
Commissioners through its budget process.
(g) The County may, at its sole discretion, employ additional professional, paraprofessional and support
personnel in the County Extension Office at its own expense.
(h) To participate in the selection procedure of professional Extension staff for the County in accordance with
Colorado State University Extension Personnel Policies and Procedures, including designation of subject
matter expertise for CSU funded positions.
(i) To submit to the Director of Colorado Extension a copy of the County budget approving expenditures for
items above. The budget will be certified as true and correct by the responsible County officer and will be
submitted prior to the beginning of each calendar year.
(j) To annually review this MOU at the beginning of each calendar year and affirm or appoint members of the
County Extension Advisory Committee, as needed. The County Extension Advisory Committee membership
will be representative of Weld County.
(k) To appoint a County Commissioner who will serve as a liaison to Extension, participate on the Advisory
Committee, and provide regular updates to the Board of County Commissioners concerning Extension
programming and operations.
Section 2. Extension agrees:
(a) To provide leadership and administration for the Colorado State University Extension programs and staff.
(b) To provide the total salary of two professional staff, the County Extension Director/Agent — Livestock and the
4-H Youth Development Agent, including employer fringe benefit costs.
(c) To provide funding equivalent to 15% of total salary and benefits for the 4-H Youth Development /Livestock
full time professional position funded by the County in accordance with Section 1(b).
(d) To provide funding equivalent to 50% of total salary and benefits for the Horticulture and Agriculture full-
time professional position funded by the County in accordance with Section 1(c).
(e) provide funding equivalent to 50% of total salary and benefits for the Family and Consumer Sciences full-
time professional position funded by the County in accordance with Section 1(d).
(f) With the approval of the County, recruit, appoint and supervise professional staff to serve in Weld County.

(g) To provide qualified state and regional who are available to train and assist County staff in the conduct of
County Extension educational programs.
(h) Extension may, at its sole discretion, employ additional professional personnel in the County Extension
Office at its own expense.
(i) Extension agrees to participate in the selection process of professional Weld County Extension staff in
accordance with Weld County personnel policies and procedures. Extension also agrees to identify and
support mentors for new hires, provide orientation and connect them to appropriate work teams and specialist
support.
Section 3. Extension and County mutually agree:
(a) To place and support five (5) professional staff personnel who will implement the Extension program set forth
in this MOU in the County.
(b) The personnel costs of these five (5) professional staff personnel will be provided by the Parties as described
in Section 1 and 2 above.
(c) Endowed positions will be viewed by Extension and the County as enhancements to the overall staffing of
Weld County Extension. Endowed positions will not be used as substitute positions to those defined in
section 3 (a) and (b) of this MOU.
(d) To notify the other party in writing at least sixty (60) days prior to any expected major change in funding or
program that would affect the professional personnel or support of the program.
(e) Colorado State University Extension, as a publicly funded educational organization, operates in compliance
with the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, and the Rehabilitation Act
of 1973, and as such, all programs, activities and employment opportunities are available without regard to
race, color, national origin, sex, religion, age or disability.
(f)
Nothing herein shall abrogate, affect or waive any notice requirements, defenses, immunities, and limitations
to liability that Extension, County, or their officers and employees, may have under the Colorado
Governmental Immunity Act, C.R.S., Section 24-10-101, et seq ("CGIA"), and to any other defenses,
immunities, and limitations to liability available to the same under the law. Nothing in this MOU shall be
deemed or applied as an express or implied waiver by Extension or county of its governmental and sovereign
immunities, as an express or implied acceptance by Extension or County of liabilities arising as a result of
actions which lie in tort or could lie in tort in excess of the liabilities allowable under the CGIA, as a pledge
of the full faith and credit of the State of Colorado, or as the assumption by any of the parties of a debt,
contract or liability of each other in violation of Article XI, Section 1 of the Constitution of Colorado.
(g) This MOU embodies the entire MOU of the parties with respect to the subject matter hereof. There
are no promises, terms, conditions, or obligations other than those contained herein; and this MOU
shall supersede all previous communications, representations, or agreements, either verbal or
written, between the parties hereto. No modification to this MOU shall be valid unless agreed to in
writing by the parties hereto.

Section 4. This MOU shall remain in full force and effect from year to year until terminated by either party by
written notice given sixty (60) days prior to the anticipated time of termination.
