The subject site and consists of three (3) parcels. Current Use: • There is one, single-family home on parcel 095702400023. • Parcel 095702400019 is a vacant lot. • Parcel 095702400026 is currently being used for outdoor storage of trucks and fracking byproduct tanks. Cleaning of the fracking tanks is also occurring onsite. There are approximately 20 trucks on site with as many as 50 frac tanks on the property. The property is currently in violation with Weld County zoning for the above described operations without possession of required permits. Code Compliance case ZCV17-OO295. Proposed Use: • Parcel 095702400023 would remain a single-family residence. • Parcel 095702400019 would remain undeveloped. • The owners of parcel 095702400026 (Kinetic Properties) approached Weld County Planning & Zoning in October and November of 2017 to discuss development plans for their property. The first proposal entailed an expansion the current operations to include the storage of up to 100 frac tanks, storage of 40 truck/trailers, cleaning of tanks and trailers, a stock pile area for storage of non -contaminated hydrovac soils (mud), and a transfer mix area for hydrovac loads in which solidified material is stored and then hauled to a landfill. Traffic generating from the expanded fracking storage use was said to vary on a daily basis from zero trips generated to 28 round trips. Peak traffic was anticipated to occur between 7-8 am and 5-6 pm. Vehicles would be accessing the site from Hwy 257 Spur. Proposed operations would occur 24/7/365 with trucks entering the site in the middle of the night and/or weekends. • The second proposed use of the site was boat and RV storage. The owner intends to develop the site in three phases beginning with the southern portion of the property, Phase I would contain 68-60 foot stalls, 8-50 foot stalls, and 8-35 foot stalls for a total of 84 boat and RV stalls. Phase II would add 93-60 foot stalls, 6-50 foot stalls, and 6-35 foot stalls for a total of 105 stalls in Phase II. Phase III would add 46-60 foot stalls, 6-50 foot stalls, and 6-35 foot stalls for a total of 58 stalls. Upon complete build -out the site would contain 247 boat & RV spaces. Proposed operations would be 24/7/365 allowing patrons to access or store their boats/RVs on demand via an electronic key code. Streets/Access • Highway 257 Spur is located south of the subject site. Missile Silo Road is on the western boundary of the subject site. Portions of Highway 257 Spur and Missile Silo Road adjacent to the subject site are under the jurisdiction of the City of Greeley. As such, the City of Greeley has the authority to approve or deny access permits as they deem appropriate. • The subject site(s) gain access from one access point off of Hwy 257 Spur. There are two access easements on Lot B, RE -0957-2-4 for the benefit of Lot A and B RE -232 (reception nos. 1702830 & 3655696). Utilities • There is a six (6) inch water line north of Hwy 257 Spur that enters the southern portion of parcels 095702400023 and 095702400026. • There is an eight (8) inch sewer line approximately 0.20 miles south of the enclave in Promontory Circle. • There is an 18 -inch storm sewer line approximately 0.30 miles south of the enclave in Promontory Circle. Within the enclave, there is one (1) single-family residence; the other two (2) parcels of land are currently vacant. There are no land use proposals for the undeveloped property located at 10609 Hwy 257 Spur (Parcel no. 095702400019). There are no land use proposals for the property containing a single-family residence located at 10601 Hwy 257 Spur (Parcel no. 095702400023); it will continue to serve as a single-family residence. There is an active development proposal for the property located at 10625 Hwy 257 Spur (Parcel no. 095702400026). The owner, Kinetic Properties LLC., would like to develop the property for Boat & RV Storage. The proposed use would require Use by Special Review approval from Weld County if a land use application were submitted before the annexation is complete. The City is recommending the establishment C -H (Commercial High Intensity) zoning for the enclave area. The proposed Boat & RV Storage use would therefore require approval of a Use by Special Review by the City of Greeley's Planning Commission if a land use application were submitted after the annexation were finalized. The property is entirely within the City of Greeley's Long -Range Expected Growth Area (LREGA) and complies with City of Greeley Comprehensive Plan policies. As an enclave, the property is enclosed entirely by the municipal boundaries of the City of Greeley, which gives the annexation 100% contiguity with the City boundaries. The area of annexation has been an enclave of the City of Greeley since 1985. As such, it meets the Colorado Revised Statute 31- 12-106 three-year standard regarding enclave annexations. The annexation will not further extend the municipal boundary of the City of Greeley in any direction. 257 Spur Enclave Annexation Page 2 of 3 The annexation of this site into the City would be consistent with present growth patterns and Comprehensive Plan policies. There is evidence that this site shares a common interest with the City's future. The annexation of the subject site would allow the City to better manage service delivery to the area, coordinate emerging development, and to provide predictability for the eventual urban development of these lands. The requirements of State statutes and City of Greeley guidelines for annexation appear to have been met by this requested annexation.
