HomeMy WebLinkAbout20183552.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 7, 2018 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 7, 2018, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad - EXCUSED Commissioner Mike Freeman Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Senior Accountant, Chris D'Ovidio MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of November 5, 2018, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. E AMENDMENTS TO AGENDA: Commissioner Kirkmeyer moved to add the following to New Business: 6) Consider Declaring Certain Equipment as Surplus Property, Approve Sale of Same at Auction with Roller and Associates, and Delegate Authority to Controller to sign any necessary documents. The motion was seconded by Commissioner Conway, and it carried unanimously. PROCLAMATIONS: El 1) VETERANS DAY - NOVEMBER 11, 2018: Chair Moreno read the proclamation for the record and commented that there is a celebration at Bittersweet Park to honor and recognize Weld County Veterans. Each of the Commissioners, in turn, expressed their appreciation and gratitude toward Veterans. PUBLIC INPUT: Bill Gillard, resident of Greeley, thanked the Commissioners for the proclamation recognizing Veterans' service. Commissioner Conway thanked Mr. Gillard for his service. Commissioner Kirkmeyer requested a point of privilege and stated she had the opportunity to present, on behalf of the Board, the Energy and Mineral Impact Grant for County Road 29. She stated the Town of LaSalle did an excellent job presenting the CR 39 exension project, as well as the Town of Berthoud which presented the CR 7 project. She expressed her extreme disappointment when she t 1 Minutes, November 7, 2018 2018-3552 Page 1 BC0016 learned Commissioner Conway intervened and spoke with the Executive Director of DOLA in an effort to undermine the grant award for CR 29. She stated his actions were detrimental and embarrassing to the County, and she requested the other members of the Board join her in writing a letter to the Executive Director and Project Committee apologizing and ask them to consider supporting the grant. She thanked the Mayors of the Towns of Ault, Pierce, and Nunn for their letters of support, and she submitted copies as Exhibit A. a Commissioner Conway stated he made his opposition known when the Resolution was passed for the DOLA grant, and asserted he has been transparent with the Board about applying for $7.8 million dollars toward the improvement of CR 29 and his position that it not in the best interest of the County. Chair Moreno stated there was a four to one vote, and although he respects that Commissioner Conway is entitled to his vote, he too is disappointed in Commissioner Conway's actions and because of this, he will be in support of writing the letter. He also expressed his appreciation to Commissioner Kirkmeyer for traveling and representing the majority vote of the Board. Commissioner Freeman agreed with the Chair's comments and stated the CR 29 project has been in the Capital Improvement Plan since 2015, based on multiple public meetings and five (5) communities (Ault, Pierce, Nunn, Eaton and Severance) that signed the Intergovenmental Agreement and Access Control Plan along the corridor, therefore, he is in support of writing the letter in an effort to improvement the infranstructure throughout Weld County. Commissioner Kirkmeyer further commented in July, 2018, Commissioner Conway committed to locating an alternative project, which has not been offered. She stated she will work with Elizabeth Relford, Department of Public Works, and Don Warden, Director of Finance and Administration, to write the letter and send it today. BIDS: 1) APPROVE BID #B1800141, RFP - CR 39 BETWEEN CRS 50.5 AND 52 - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Department of Purchasing, presented the seven (7) bids received and stated staff recommends awarding to the low bidder, Farnsworth Group, Inc., for the total amount of $316,240.50. Commissioner Freeman moved to approve said low bid. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. 2) APPROVE BID #61800148, OPENTEXT APPLICATIONXTENDER MAINTENANCE 2019 — DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, reviewed the four (4) bids received and stated staff recommends awarding to the low bidder, who meets all specifications, Revolution Data Systems, for the total amount of$33,691.62. Commissioner Conway moved to approve said low bid. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. NEW BUSINESS: '- 1) CONSIDER APPLICATION FOR VETERANS SERVICE TO CAREER PROGRAM GRANT AND AUTHORIZE CHAIR TO SIGN: Tami Grant, Department of Human Services, presented the terms of the application for additional funds in the amount of $190,000.00, which would serve 50 eligible participants at $3,800.00 per individual. Commissioner Conway moved to approve said application and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. 2) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES FOR ACCOUNT NUMBER R0743501 — KLEE YAMAUCHI: Brenda Dones, Assessor's Office, reviewed the petition for abatement of a vacant lot in the Town of Firestone. She stated the property owner believed the Assessor's Office overvalued his property compared to other vacant lots in the area, and because they are unbuildable, the Minutes, November 7, 2018 2018-3552 Page 2 BC0016 properties have been valued lower. She recommended denial of the petition for abatement of taxes and to sustain the Assessor's value of $52,000.00, for tax year 2017. The property owner was not present. Commissioner Kirkmeyer moved to deny said petition. The motion, which was seconded by Commissioner Freeman, carried unanimously. El 3) CONSIDER DECLARING CERTAIN REAL ESTATE AS SURPLUS PROPERTY, APPROVE A CONTRACT TO BUY AND SELL REAL ESTATE AND QUIT CLAIM DEED FOR NUNN PROPERTY AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS — TOWN OF NUNN: Bruce Barker, County Attorney, stated this a triangular shaped property the County obtained through a Treasurer's Deed in 1991, known as the Nunn Strip, and the Town of Nunn has paid $10.00 for the property. Commissioner Kirkmeyer moved to declare said real estate as surplus property, approve a contract to buy and sell real estate and quit claim deed, and authorize the Chair to sign all necessary documents. The motion, which was seconded by Commissioner Conway, carried unanimously. 4) CONSIDER CONTRACT ID #2259 AMENDMENT #1 TO INTERGOVERNMENTAL AGREEMENT FOR A CNG FUELING STATION AND AUTHORIZE CHAIR TO SIGN: Elizabeth Relford, Department of Public Works, reviewed the terms of the amendment for additional funding in the amount of $380,624.00, for the upgrade of Weld County's compressed natural gas (CNG) fueling station. She stated the total construction cost for the station will be $2,159,857.00, and the construction is scheduled to be completed before the end of the year. Commissioner Freeman moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 5) CONSIDER TEMPORARY CLOSURE OF CR 21 BETWEEN CR 84 AND STATE HIGHWAY 14: Amy Mutchie, Department of Public Works, presented the details of the closure beginning November 7, 2018, through November 26, 2018, as requested by North Weld County Water District for the installation of a new 6"Water main. Commissioner Conway moved to approve said temporary closure. Seconded by Commissioner Freeman, the motion carried unanimously. 6) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Chris D'Ovidio, Senior Accountant, presented the list of equipment to be declared surplus for sale at auction. Commissioner Freeman moved to declare said equipment as surplus, approve the sale of auction and authorize the Controller to sign any necessary documents. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. PLANNING: El 1) CONSIDER CONTRACT ID #2249 IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT, USR17-0043 - SIMON CONTRACTORS, INC.: Evan Pinkham, Department of Public Works, requested acceptance of off-site collateral in the form of a performance bond in the amount of $273,882.00 for improvements made to CR 80.5 and also approve the Improvements Agreement. In response to Commissioner Kirkmeyer, Mr. Pinkham stated the new Improvements Aagreement is consistent with the Use by Special Review Permit. Commissioner Kirkmeyer moved to accept the collateral, and approve the Improvements Agreement and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. We were approached four year ago by the county to form a Coalition and discuss transportation needs in our area, specifically along WCR 29. In 2017, in partnership with the county, we signed an IGA for this roadway that includes access management, protecting the functional integrity of this arterial corridor, and enhanced safety improvements. It is necessary to pave this road that is fast becoming an important haul route for the energy industry and in times of emergency disasters, an alternative to US 85 . Additionally, paving this section of roadway is integral to allowing Nunn to begin the process of diversifying our economy and developing a master land use and comprehensive plan. We are great appreciative of the county for thinking regionally and working with all the communities in the area to develop a regional vision for transportation. The upgrade and paving of WCR 29 is essential to our community, as the increased activity focused on the energy industry in our area is impacting local roads connecting our community to the surrounding areas . Pierce does not currently have standards in place for access and was happy to approve the WCR 29 Access Control Plan in 2017 to ensure that criteria was adopted in advance of new development in our area. It is necessary to pave WCR 29 which now borders Pierce ' s town limits and will significantly help our rural community, as this corridor is quickly becoming an important haul route for the energy industry. Many small communities such as ours struggle to make significant infrastructure improvements, so by Weld County taking the lead on improving regional corridors on our behalf, the community stands to benefit from both an access and economic standpoint. In closing, the Town of Pierce would ask that you accept this letter as a request for full funding of this project.
