HomeMy WebLinkAbout20180331.tiffRESOLUTION RE: ACTION OF THE BOARD OF CONCERNING ZONING PERMIT, ZPAS17-0002, FOR ACCESSORY STORAGE FOR A SEMI -TRAILER TO BE USED FOR THE STORAGE OF PERSONAL ITEMS - CAMILLE TORREZ AND SALVADOR PANIAGUA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on 29th day of January, 2018, considered the request of Camille Torrez and Salvador Paniagua, 15593 County Road 25.5, Platteville, Colorado 80651, for a Zoning Permit, ZPAS17-0002, for Accessory Storage for a semi -trailer to be used for the storage of personal items, and WHEREAS, said accessory structure is for the storage of personal items in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Part of Lot 2, Block 3, Olinger Subdivision of Garden Tracts located in the W1/2 NW1/4 of Section 18, Township 3 North, Range 66 West of the 6th P. M., Weld County, Colorado, and WHEREAS, the Board of County Commissioners, having heard the testimony of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and having been fully informed, finds that said request shall be denied for the following reasons: WHEREAS, Camille Torrez and Salvador Paniagua, property owners, were present at said hearing and presented testimony, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 28, 2018, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Such disrepair would include, but not be limited to, semi-trailer(s) for accessory storage partially or totally damaged by fire, earthquake, wind or other natural causes, or is in a state of general dilapidation, deterioration or decay resulting from a lack of maintenance, vandalism, or infestation with vermin or rodents. Any such semi-trailer(s) shall be restored to, and maintained in, the original condition upon being placed on the site or shall be removed from the site. 5. The semi-trailer(s) used for accessory storage will be removed from the property upon cessation of such use. 6. The semi-trailer(s) used for accessory storage will not in any manner be used to display a sign(s). 7. This permit will not be transferable by the applicant and/or owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. 8. Approval of this application for a zoning permit application shall not be considered to release the applicant from complying with any private covenants in place. 9. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 10. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall be constructed within a 200 foot radius of any tank battery or within a 150 foot radius of any wellhead or within a twenty- five -foot radius of any plugged or abandoned oil and gas well. Any construction within a two - hundred -foot radius of any tank battery or one -hundred -fifty -foot radius of any wellhead shall require a variance from the terms of this Chapter in accordance with Subsection 23-6-10.C of this Code. 11. The property is in violation of Chapter 23 of the Weld County Code (Violation ZCV17-00187). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance of the property. 12. Any future structures or uses on site must obtain the appropriate zoning and building permits. 13. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County Code. 14. Having a semi -trailer, which we were under the impression it was for a small business on the property. This could potentially cause more unnecessary eye sore of equipment and taffic in the area for all days of the week. We built our home with the understanding Anadarko was already an established business. We would rather have a quite county atmosphere environment that we have been use to for over two years. We moved out of the city to get away from noise and congestion of other individuals property.
