WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 8th day of August, 1979, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Sutter, Inc. , which land is more particularly described as follows: Part of the Northwest Quarter, Section 15, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado. WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that said applicants may make application to the Board of County Commis- sioners for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado feels that the applicants have shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements be, and hereby is , granted to the Sutter, Inc. for the abovedescribed parcel of land. COLORADO August 8, 1979 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE: Lot Size Variance #97 Dear Commissioners : The attached letter and related materials are in reference to a request for a lot size variance from Sutter, Inc. The parcel of land under consideration is described as Pt . NW4 Section 15, TON, R65W of the 6th P.M. , Weld County, Colorado . This property is located 1/2 mile north and 2 miles east of Lucerne. The property contains approximately 68 acres of Class II irrigated soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4 A(6) so that Sutter, Inc. may make application for a recorded exemption. If this lot size variance is granted, Sutter, Inc. will proceed with an application for a recorded exemption to divide the property into two parcels of approximately 2 acres and 66 acres. Sutter, Inc. wishes to sell the smaller improvements parcel due to problems with maintenance of a rental unit. The applicants will continue to farm the remaining 66 acre parcel. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The proposed split conforms with Section 9-2 of the Weld County Subdivision Regulations (intent clause of the recorded exemption procedure) , Section 3 .3 A of the Weld County Zoning Resolution ( intent clause of the Agricultural Zone District) , and the Weld County Comprehensive Plan. The use will be compatible with surrounding agricultural uses. The request will allow agri- cultural and related uses to he the predominant land use. There will be no reduction in the amount of land currently being used for agricultural production. Board of County Commissioners Page 2 August 8, 1979 2. This request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. The Department of Planning Services Staff would like to make the appli- cant aware of Weld County setback requirements. The Agricultural Zone District requires a side and rear yard setback of 3 feet , and a front- yard setback of 50 feet . The real estate owned includes parcels in 3 locations, and we also lease approximately 200 acres of irrigated farm land which adjoins our cattle feedlot . Income from these agricultural enterprises (especially the cattle feeding) , has not kept pace with inflated expenses for the past few years . It is only natural to look for ways to improve the cash flow in our business. We will be able to do this by selling a set of improvements which is located on one of our farms that will not be of any use to us after July, when my son leaves to continue his college education . Our plan is to transfer the funds received from selling the facilities into our feeding operation, thereby reducing our debt load at the bank and stopping some interest expense . Here' s the situation: On the feedlot acreage (40 acres) and the total leased and owned irrigated farm land near the feedlot (270 acres) there are 9 houses. Eight of these are large enough for a complete family and one is a two room seasonal labor house . Our work force is made up of two employees other than family members and one of these lives off the properties . Three family members live at the locations, so this leaves five houses which need to be rented or otherwise cared for and our means of livelihood is farming and feeding, not looking after rental properties. It is only good business judgment to turn unused property into a tangible asset . The improvements we intend to sell are the set farthest away from the feedlot . It is necessary for hired hands and workers to be close in case of emergencies and it is wise to conserve energy from travel back and forth . Taking these facts into consideration, the set of improvements on the small farm have turned into a liability to our complete operation, so it appears sensible to convert its value into cash, which will really come in handy with the cost price squeeze in agriculture . Our family owned operation hopes to be able to take advantage of business opportunities like this and continue for a long time . To be successful in agriculture today, we farmers must become more efficient and, in most cases, we must utilize more acreage, using our present equipment to produce more . This makes a small unit like this very much in demand from neighbors who want the land to increase their production, without the improvements . So if it were ever sold away from our present operation, it is extremely doubtful that any placement of other improvements would be necessary in the future . -2- We would appreciate consideration of making a lot size variance in this situation . COLORADO PHONE 353-3118 July 12, 1979 Weld County Dept. of Planning Services; I have been requested, by Mrs. Jennifer Sutter, to give my opinion on the availability of domestic water on a tract of land, approximately 1.8 acres, located in the NW * of section 15 T 6 N R65W-6P.M. The subject property is serviced by a six inch hard-water well, sixty feet deep with a static water level of fifteen feet. At present, there is a h.p. jet pump in the well pumping 12 g.p.m. which is quite adequate for domestic use. The balance of the farm is served by an irrigation well and pump for the irrigation of farm crops.
