RE: APPROVE RECOMMENDATION TO APPOINT COMMISSIONER SEAN CONWAY TO
TOWN OF FIRESTONE URBAN RENEWAL AUTHORITY BOARD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Town of Firestone Urban Renewal Authority (FURA) has been established
to provide urban renewal within portions of the Town of Firestone, pursuant to C.R.S. §§31-25-101,
et seq., and
WHEREAS, C.R.S. §31-25-104(2.5) allows for the appointment to the FURA Board of one
county commissioner "of the county in which the territorial boundaries of the urban renewal authority
are located," and
WHEREAS, FURA's territorial boundaries include areas within Boulder and Weld Counties,
and
WHEREAS, the Board of Commissioners of Weld County recommends to the Executive
Director of FURA that Weld County Commissioner Sean Conway be appointed to the FURA Board
as a new member.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Commissioner Sean Conway be, and hereby is, recommended for
appointment to the FURA Board.

This is to inform you that on August 8, 2018, the Firestone Urban Renewal Authority ("FURA")
adopted Resolution Nos. 18-05, 18-06 and 18-07 to create three vacant seats on the FURA
Board. Pursuant to C.R.S. § 31-25-104(2.5), one seat was created for the appointment of an
appointee by the Weld County Board of County Commissioners.
As stated in FURA Resolution No. 18-06 (copy enclosed), the seat will remain vacant until such
time as FURA receives written confirmation from Weld County of the person appointed as the
County appointee.
Pursuant to C.R.S. § 31-25-104(2.5), the remaining two vacancies were created by Resolution
Nos. 18-05 and 18-07 for the appointment of a board member of a special district selected by
agreement of the special districts levying a mill levy within the boundaries of the urban renewal
authority area, and the appointment of an elected member of a board of education of a school
district levying a mill levy within the boundaries of the urban renewal authority area.
Please contact Leah Vanarsdall, Town Clerk, at lvanarsdallfirestoneco.gov when the County
has made its appointment.

RESOLUTION NO.18 -06
A RESOLUTION OF THE FIRESTONE URBAN RENEWAL AUTHORITY CREATING
A VACANT SEAT FOR A COUNTY COMMISSIONER APPOINTEE TO SERVE AS A
COMMISSIONER TO THE AUTHORITY
WHEREAS, the Town of Firestone Uiban Renewal Authority (the "Authority") is a duly
constituted urban ienewal authority, established and operating pursuant to the laws of the State
of Colorado, and in particular the piovisions of C R S § 31-25-104, having its territorial
boundaries conterminous with the Town of Firestone, and
WHEREAS, H B 15-1348 affected changes to the Urban Renewal Law, including the
piovisions establishing membership of the boards of urban renewal authorities; and
'WHEREAS, C R S. 31-25-104(2 5) provides, in part "[I]n order to represent the
collective interests of the county and all taxing bodies levying a mill levy within the boundaries
of the urban renewal authonty area other than the municipality, one additional commissionei on
the authority must be appointed by the boaid of county commissioners of the county in which the
territorial boundaries of the urban ienewal authority area aie located, one additional
comnussroner must also be a board member of a special district selected by agreement of the
special districts levying a mill levy within the boundaries of the urban renewal authority area,
and one additional commissioner must also be an elected member of a boaid of education of a
school district levying a mill levy within the boundaries of the urban renewal authority area If
the number of members of the governing body causes the authority to have an even number of
commissioners, the mayoi shall appoint an additional commissionei to restore an odd number of
commissioners to the authority As applicable, the appointment of the county, special district,
and school district representatives on the authonty pursuant to this subsection (2 5) must be
made in accordance with the procedures specified in subsection (2) of this section"; and
WHEREAS, pursuant to such provision, the Authority desires to create a seat for the
appointment of one appointee of the Board of County Commissioners of Weld County to serve
as a commissionei of the Authority (the "County Appointee"), which seat shall remain vacant
until such time as the Authority receives written confirmation from Weld County of the person
appointed as the County Appointee,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COMMISSIONERS OF THE FIRESTONE URBAN RENEWAL AUTHORITY:
Section 1. The foregoing recitals aie incorporated herein by this reference
Section 2. Pursuant to C R.S 31-25-104(2.5), the Authority hereby creates the
County Appointee seat to this Authority, effective as of the date of this Resolution

Section 3. Staff of the Authority is hereby dnected to provide notice of creation of
the County Appointee seat to the Board of County Commissioners of Weld County, foi its
appointment of a qualifying person to serve as the County Appointee
Section 4. A copy of this Resolution on file with the Town Cleik shall serve as a
certificate of such appointment pursuant to C R S 31-25-104(2)(b)
Section 5. Tins Resolution shall be effective

that appointee. We wanted to do a resolution to formalize it but did not know if it has a term date, or if it is a standing
position. Could you let me know so we can get that into the resolution? Once we have it finalized, I will send you a copy
for your records, along with a letter from the board chairman.
