WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 17th day of May, 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Fred Lamutt, which land is more particularly described as follows: Lot 5, Vantage Acres, 2nd Filing, a subdivision located in the SW4 of Section 17, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement s.o that said a licant may make application to the Board of County Commissioners pp for a recorded exemption, as set forth in Section 9-4 .A. . (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissoners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4.A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be and hereby is, grant to Fred Lamutt for the above described parcel of land. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 17th day of May, A.D. , 1978. The subject property is described as Lot 5, Vantage Acres , 2nd Filing, a subdivision located in the SW4 Section 17, T1N, R65W of the 6th P.M. , Weld County, Colorado. This property is located 22 miles southwest of Hudson. The property in question contains approximately 19 acres more or less of Class VI soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4A. (6) so that he may make application to apply for a recorded exemption. Section 9-4A. (6) states : "That the original tract or parcel of land to be divided under this section meets the minimum lot size requirements established by the Weld County Zoning Resolution; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the Comprehensive Plan area of an existing incor- porated town of Weld County. (Revised 4-17-74 ) . " If this lot size variance is granted, Mr. Lamutt will pro- ceed with his application for a recorded exemption to divide the property into two parcels. One parcel is pro- posed to contain approximately 8 acres, which has an existing set of improvements on it . The second parcel of approximately 10 acres will be used as a residential site. Board of County Commissioners LSV-64 : 78 : 6 Page 2 Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the following reasons : 1 . The request complies with the intent clause of the recorded exemption procedure in that non- productive agricultural land (Agricultural Zone Subdivision) is proposed to be divided for residential uses which would be compatible with the surrounding agricultural uses in the area. 2. The resulting parcels in question are part of an existing platted subdivision which has low utility for agricultural use due to the amount of the acreage and the intent for residential development within the subdivision. 3. We have owned and lived on this property since 1969 and we now desire to sell part of the property. To do this, we need a variance to split the property into an eight acre parcel and one almost eleven acres, as shown on the enclosed drawing. In support of this request we offer the following: 1. This lot, as all the lots in this half section, wes with- drawn from agriculture more than 10 years, when it was subdivi- ded and zoned Residential-Agriculture. While this category of zoning has been eliminated, the use of the property has not changed from its principal residential use. Nineteen acres is too small a parcel to ever again be e:`fecti ely used for commercial agriculture. Dividing the property will not signi- ficantly change its use. 2. There are platted subdivisions with lots of 10 acres or smaller in most of the surrounding sections. Probably half of tl e land in sections 17, 18, 19, and 20 is platted, with the remainder being in commercial farm. Dividing this pro- perty is not contrary to the principal land uses in theen- eral area. . Nineteen acres, while too small for agriculture, is too arge to be used effectively as a country residence. Divi— ding the property would satisfy a need, which is evidenced by the fact that there is a buyer prepared to take one of the resulting parcels, but not tie whole lot. 4. Po l.h resulting parcels will have frontage on the existing county road, as shown on the drawing. The existing lane will be part of the back lot. The owner of the front lot will have a permanent access easement on the lane. This will result in adequate access to both parcels without any addition to the county road system. 5. Water can be supplied to both parcels frog: an exist:a r-,g domestic well on the property. The well pumps 15 gpm from the Beebe Draw Aquafer and is -“ore than adequate for two residences. All necessary access easements will be recorded with the Recorded Exemption. 6. The eight acre parcel has an existing house of approximtely 2500 square feet. It is anticipated that a house of similar size and value will be built on the other parcel. Fairly string— ent covenants control the type of buildings and protect the other properties in the area.
