1. The Site Specific Development Plan and Use by Special Review Permit, USRl8-0017, is for Mineral Resource Development Facilities, including
Oil and Cos Support and Service (two (2) gas compressors
mpre associated with gas processing or whim compress gas to enter a pipeline for
n transport to market) and a e (1) 100 —toot inheight Communicotions Tower in the A (Agricultural) Zone District, and subject to the
Development Standards statedhereon.
2. Approval of this plan may create o vested property right pursuant to Section 23-8-10 of the Weld County Code.
3. All signs mall adhere to Chapter 23, Article N, Division 2 end Appendices 23—C, 23-0 and 23—E of the Weld County Code. The operator
shall maintain eignage with curent points of contact, incioding name and phone number.
4. The improvements on the site shall be maintained in accordance with the approved Visual Mitigation Plan.
5. The approved Noise Mitigation Plan shall be maintained.
6. The approved Communications Plon shall be maintained.
7. The approved Lighting Plan shall be maintained in accordance with the Weld County Code.
6. The approved Decommissioning Plan /or the facility shall be maintoined.
9. Co —location of other ontennos by other service providers shall be allowed, pursuant to the opplicant's safety protocols.
10. Upon termination of the use of the communication antenna tower, the equipment shelter, antenna structure. and ony associated equipment
shall be removed and the premiere restored to its original condition according to the Decommissioning Plon.
11. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites Oct Facilities Act, C.R.S. §30-20-100.5) shall be stored and
removed for final d'rspoeal in o manner that protects against surface and groundwater contamination.
12. No permanent disposol of wastes shall be permitted at this site. This is not meant to include those wastes specificallyspecificallyexcluded from the
definition of 0 sold waste in the Solid Wastes Disposal Sites and Facilities Act. C.R.S. §30-20-100.5.
13. Wools moteriale shall be handled, stored. and disposed of in a manner that controls fugitive dust, blowing debris, and other potentiol
nuisance conditions. The facility shall operate in accordance with Chapter 14, Article I, of the Weld County Code.
14. Fugitive dust should attempt to be confined on the property. Uses an the property should comply with the Colorado Air Duality
Commission's Air Duality Regulations.
15. The applicant shall submit on Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit Application ond obtain o permit from the Air
Pollution Control Division of the Colorado Deportment of Public Health and Environment. as 'spendable.
16. Adequote drinking, handwashing and toilet facilities shall be provided for employees and potrons of the focility, at all times. As employees
or contractors areon—site for less than two (2) consecutive hours a cloy. portable toilets and bottled water one ore acceptable. Records of
maintenonond proper disposal for portable toilets shall be retained on o quarterly basis ond available for review by the weld County
Deportment of Public Health and Environment. Portable toilets shall be serviced by o cleaner licensed in Weld County and shall contain hand
17. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored
secure, on an impervious surface, and in accardonce with manufacturer's recommendations.
16. Secondary containment snail be constructed around tanks to provide containment for the largest single tank and sufficient freeboard to
contain precipitation. Secondary inspected
shall be sufficiently impervious to contain ony spilled or released material. Secondary
ontainment devices shall be in tted at regular intervals and maintained in good condition. All secondary containment will comply with the
Colorado Oil and Gas Conservation Commission (COGCC) Rule 604 and/or the provisions of the State Underground ond Above Ground Storage
Tank Regulations.
19. Process wastewater (such os floor drain wastes) shall be captured in o watertight vault and hauled off for proper disposal. Records of
installation. maintenance. and proper disposal shall be retained.
20. The facility shall be constructed and operated to ensure that contominotion of sail and groundwater does not occur.
21. My contaminated soils on the facility sholl be removed, treated or disposed of in accordance with all applicable rules and regulations. Ml
spills will be reported to local, state and federal agencies in accordance with all stole and federal regulations.
22. The facility shall adhere to the maximum permissible noise levels of 55 decibels, 24 hours per day, as measured from the property boundary
of the larger porcel upon which the Subdivision Exemption leasehold is located.
23. The opPlicont shall .obtain a Colorado Discharge Permit System or CDPS permit from the Water Quality Control Division of the Colorado
Department of Public Health and Environment (CDPHE), if applicable.
24. A Spill Prevention, Control and Countermeasure Plan. prepared in accordance with the applicable provisions of 40 CFR. Port 112, sholl be
available on —site or os applicable.
25. The facility shall notify the County of any revocation antl/ar suspension of any State —issued permit.
26. The applicant shall notify the Caunly upon r ceipt of any compliance advisoryor other notice of non— mpliance of a State —issued permit.

30. There shall be no parking or staging of vehicles on public roods. On —site parking shall be utilized.
31. Any work that may o cupy and/or a roach upon any County rights—of—woy or easement shall acquire on approved Right —of —Way Use
Permit prior to commencement.
32. The property owner sholl comply with all requirements provided in the executed Improvements Agreement.
33. The historical flow patterns and runoff amounts on the site will be maintained.
34. Weld County is not reepaneible for the maintenance of on —site drainage related features.
35. Sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties. Sources of light should
not co interfere with the use on the adjacent properties in ccordance with the map. Neither the direct, n reflected, light
from any light so may create a traffic hazard to operators of motor vehicles on public or private streets. No colored lights may be
used which may be confused with. or construed as. traffic control devices.
36. This is an unmanned facility.
37. No outside storoge is allowed.
38. Building Permits is ued on the proposed lot will be required to adhere to the fee structure of the County —wide Road Impact Fee. County
Facility Fee and Drainage Impact Fee Progroms.
39. The facility will operate 24 hours per cloy. 365 days per year.
40. The proowner or operator shall be responsible for complying with the Design and Operation Standards of Chapter 23 of the Weld
County perty Code.
41. Building permits may be required, per Section 29-3-10 of the Weld County Code. Currently, the following have been adopted by Weld County:
2012 International Codet, 2006 International Energy Code. and 2017 National Electrical Code. A Building Permit Application must be completed
and two (2) complete sets of engineered plans bearing theOct stomp of a Colorado registered architect or engineer must be submitted for
review. A Deoteohnical Engineering Report performed by a Colorado registered engineer shall be required or an Open Hole Inspection.
42. Necessary personnel from the Weld County Departments of Planning Services, Public Works, and Public Health and Environment shall Se
granted accessoccess onto the property at any reasonable time order to ensure the activities carded out on the property comply with the
Conditions of Approval and Development Standards stated herein and all applicoble Weld County regulations.
43. The Use by Special Review area rrs shall be limited to the ploshown hereon ond governed by the foregoing standards and all applicable Weld
County regulotions. Substantial changes from the plans or Development Standards, as shown arstated, shall require the approval of a
amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development
Stondards ore permitted. Any other changes shall be filed in the office of the Department of Planning Services.
44. The property o operator shall be responsible for complying with all of the foregoing Development Standard.. Nancompllonce with any

he foregoing Development Standards may be mason for revocation of the Permit by the Board of County Commissioners.
45. RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County hos someof the most abundant mineral resources, including, but not limited
to, sand and gravel, oil, natural gas. and coal. Under Title 34 of the Colorado Revised Statutes,minerals oy r vital resources because (a)
the state's commercial n rcial eral deposits a n essential to the slate's economy, (h) the populous counties of thestate lace ocritical shortage
of such deposits; ond (c)such deposits should be extracted according to a rotion0l pion, calculated to avoid waste of such deposits end
cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral
resource locations are widespread throughout the County and persons moving into these areas must recognize the v impacts oc a iated
with this development. Oftentimes. mineral r sites am fixed to their geograpnicol and geaphysicol locations. Moreover, these resources
ore protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource.
46. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agriculturol counties in the United States, typically
ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld
County moy be open and spocious, but they are Intensively used for agriculture. Persons moving into o rural a must
recognize and accept there are drowbocks, including conflicts with long—stonding agricultural practices and a lowerlevelof
se
rvices than in town. Along with the drawbacks come yea the incentives which attract urban dwellers to relocate to rural a s.
open views spaciousness, wildlife. lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever.
Agricuturol users of the loud should not be expected to change their long—established agricultural practices to accommodate the
intrusions of urban users into a rural area. Well —run agricultural activities will generate off —site impacts, including noise from
tractors and equipment; slow —moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roods:
odor from animal confinement, silage and m smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the
use of aerial spraying.
It is common practice for agricultural producers to utilize on accumulation of agricultural machinery and supplies to assist in
their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between
oral and urban areas of the County. Section 35-3.5-102, C.R.S., provides that on ogriculturol operation shall not be found to
be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that ore
commonly or reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural cornmunity. It is unrealistic to a e that ditches and
reservoirs may simply be. moved "out of the way of residential development. When moving to the County. property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have on adjudicated
right to the voter.
Weld County c o land area of approximately four thousand (4,000) square miles in size (twice the size of the State of
Delaware) withmore
le than three thousands n hundred (3,700) miles of state and County roads outside of municipalities. The
sheer magnitude of the area to be served stretches available resources. Law enforcement is based o responses to comploints
more than on patrols of the County, and the distances which must be traveled may delay all emergency responses. including low
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must levee their jobs ond families to
respond to emergencies. County gravel roads. no matter how often they ore bladed, will not provide the same kind of surface
expected from o paved road. Snow removal meon priorities m n that roods from subdivisions to arterials moy not be cleared for
several days after a major snowstorm. Services in rurala many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self—sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field
equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs.
puncture vines, territoriol fans dogs ond livestock, and open burning present real threats. Controlling children's activities is
importont, not only for their safety, but oleo for the protection of the farmer's livelihood.
