HomeMy WebLinkAbout20180680.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 5, 2018 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, March 5, 2018, at the hour of 9:00 a.m. Eti ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Cozad moved to approve the minutes of the Board of County Commissioners meeting of February 28, 2018, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. FLI CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on February 28, 2018, as follows: 1) USR17-0071 — Dayton Street, LLC, do Richard Bauer, Midwest Auto Body, 2) USR17-0055 — Cherry Knolls, A General Partnership, do Bob Frachetti and Dan LaCoe, and 3) USR17-0065 — Richard and Heidi Robertson, do Cureton Front Range. Commissioner Cozad seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: Commissioner Freeman moved to remove Planning item 2) Consider Directing Payment of Collateral to Weld County Board of Commissioners Regarding Use by Special Review Permit, USR-1767 — Konig Ag Company. Commissioner Cozad seconded the motion, and it carried unanimously. CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. NEW BUSINESS: Minutes, March 5, 2018 Page 1 2018-0680 BC0016 1) CONSIDER CONTRACT ID #1586 AMERICORPS EDUCATION AWARD SERVICE LOCATION AGREEMENT AND AUTHORIZE DIRECTOR OF THE DEPARTMENT OF HUMAN SERVICES TO SIGN - COLORADO YOUTH CORPS ASSOCIATION: Judy Griego, Director of the Department of Human Services, presented the annual agreement for Youth Conservation Corps Association. She stated they will enroll 42 members between the ages of 17 and 24. Commissioner Cozad moved to approve said agreement and authorize the Director of the Department of Human Services to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. Commissioner Cozad expressed her appreciation for the program because it is important for youth to be involved in projects around the County. 2) CONSIDER CONTRACT ID #1610 MEMORANDUM OF UNDERSTANDING FOR MEDICAL ASSISTANCE SITE AND AUTHORIZE CHAIR TO SIGN - ACCESS MANAGEMENT SERVICES, LLC: Ms. Griego reviewed the terms of the Memorandum of Understanding which is non -financial; however, she stated there are costs associated with the Work Number. She stated the MOU will designate a Medical Assistance Site, certified by the Colorado Department of Health Care Policy and Finance to accept and process the Colorado Medical Assistance Application for Public Assistance. Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. 3) CONSIDER VICTIMS OF CRIME ACT (VOCA) GRANT APPLICATION FOR BILINGUAL ADVOCATE UNIT AND AUTHORIZE ELECTRONIC SUBMITTAL: Jennifer Oftelie, Sheriff's Office, presented the details of the 2019 and 2020 grant application. She stated the grant funds last year allowed the Sheriff's Office to add a full-time employee for the Bilingual Advocate Unit. Commissioner Cozad clarified this will increase the amount of services offered to victims of crime in Weld County. Commissioner Cozad moved to approve said application and authorize electronic submittal. The motion was seconded by Commissioner Freeman, and it carried unanimously. 4) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR SOUTHWEST SERVICE CENTER BOOKING INTAKE REMODEL AND AUTHORIZE CHAIR TO SIGN - MARKLEY DESIGNS, LLC: Sterling Geesaman, Department of Buildings and Grounds, stated there were three (3) informal bids received and staff recommends awarding to the low bidder, Markley Designs, LLC, for the total amount of $6,000.00. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. 5) CONSIDER ACCEPTANCE OF CERTIFICATE OF WETLAND CREDIT PURCHASE FROM MIDDLE SOUTH PLATTE RIVER WETLAND MITIGATION BANK: Clay Kimmi, Department of Public Works, presented the certificate to purchase 0.1825 acres of wetlands that the County had to replace as part of the County Road 53 Bridge Replacement project. Commissioner Cozad moved to accept said certificate of wetland credit purchase. The motion was seconded by Commissioner Freeman, and it carried unanimously. 6) CONSIDER CREATION OF AD -HOC WELD COUNTY HOME RULE CHARTER AMENDMENT STUDY COMMITTEE AND APPOINT MEMBERS THERETO: Bruce Barker, County Attorney, presented the resolution to create the Ad -Hoc Weld County Home Rule Charter Amendment Study Committee members and stated that all amendments recommended by the committee will need to comply with the requirements and limitations set forth in the constitution and in the State statute regarding Home Rule Charters. It will be required that minutes be taken and reported to the County Commissioners upon approval. He also stated the committee will present their recommendations on July 23, 2018 at the Minutes, March 5, 2018 Page 2 2018-0680 BC0016 Commissioners 9:00 a.m. meeting. Lastly, he read the names of the appointed members and the districts they will be representing. Chair Moreno expressed his appreciation to the individuals who applied for this committee. He stated it was important to get people involved from all over the County to have diversity in the Ad -Hoc Weld County Home Rule Charter committee. Commissioner Cozad thanked the applicants for applying and stated there were 34 applicants, who expressed a desire to have input toward County Government. Commissioner Freeman thanked everyone who applied, stating there were many quality applicants and it was difficult to narrow it down to nine (9) appointees. He stated it was important to make sure there was equal representation throughout the County and looks forward to the members bringing new ideas on how to make the Charter and the County better. Chair Moreno explained the Commissioners want to remove themselves from the process of attending the meetings but will wait until July 23, 2018, to discuss the recommendations from the committee. Commissioner Cozad moved to approve said creation of the Ad -Hoc Weld County Home Rule Charter Amendment Study Committee. The motion was seconded by Commissioner Freeman, and it carried unanimously. PLANNING: 1) CONSIDER PARTIAL VACATION OF CORRECTED MINOR AMENDED USE BY SPECIAL REVIEW PERMIT, MUSR15-0016, (FORMERLY USR-1268 AND AMUSR-1268) - ESTATE OF EDWARD J. FRITZLER AND EILEEN FRITZLER, C/O CHERYL MITCHELL: Michelle Martin, Department of Planning Services, stated the owners are requesting a four (4) lot vacation. She explained the applicant wants to remove Lots A, B, and C of Recorded Exemption, RECX17-0190 from the Use by Special Review area, and in conjunction with this proposal, the applicant was conditionally approved for a four (4) -lot recorded exemption to create a lot for a family member and two (2) additional lots. Ms. Martin stated the USR will remain on the large lot, Lot D, which she pointed out on the slide of the preliminary map. Fred Otis, representative of the property owner, explained this is to simply remove some of the property from the Fritzler's Corn Maze that will be deeded away. Commissioner Cozad clarified the process is taking two (2) small lots out of three (3) lots away from the Special Use permit and moved to approve said partial vacation. The motion was seconded by Commissioner Freeman, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
