RE: APPROVAL OF RECORDED EXEMPTION NO. 318 - HERBERT W. AND
JANET I. SCHNEIDER AND DONALD I . ROTHARMEL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter are vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 24th day of April, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 318 , being the property of
Herbert W. and Janet I Schneider and Donald I . Rotharmel, described
as the NWa of Section 33, Township 7 North, Range 66 West of the
6th P.M. , Weld County, Colorado, being more particularly described
as follows :
The North west Quarter (NWa) of Section Thirty-three (33) ,
Township Seven (7) North, Range Sixty-Six (66) West, of
the 6th P.M. , Weld County, Colorado
does not come with the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Herbert W. and Janet I. Schneider and
Donald I. Rotharmel, be and hereby is, exempt from the definition

Dear Commissioners :
The attached application, plat and related items are in reference
to a request by Mr. & Mrs. Herbert Schneider and Donald Rotharmel
for a recorded exemption. The parcel of land is described as the
NW'* Section 33, T7N, R66W of the 6th P.M. , Weld County, Colorado.
This property is located z mile north and 3 miles east of Severance.
The subject property contains 160 acres of Class II , III and IV
irrigated soils . The request is to split the property into parcels
of 4 . 52 acres and 155.48 acres.
Mr. Schneider desires to sell the 155. 48 acre parcel for economic
reasons . He would like to continue residing on the 4. 52 acre par-
cel . Each parcel has an existing set of improvements located on
it .
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1 . The proposed split conforms with the intent clause of the
Recorded Exemption Procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricul-
tural Zone District (Section 3 . 3 A. of the Weld County Zoning
Resolution) , and the Weld County Comprehensive Plan in that
each resolving parcel does have an existing set of improve-
ments. The use will be compatible with the surrounding agri-
cultural uses . Agriculture will continue to be the predominant
land use.
2 . The request complies with the provisions of Section 9-4(A) of
the Weld County Subdivision Regulations .

Dear Members of the Weld County Board of Commissioners :
In 197 , my family and I moved from Hawaii to Colorado and Iot
A (on the Plat) has been our permanent residence since that
time . We are now being forced to sell the farm for economic
reasons , and it is our sincere desire to retain Lot A as our
residence henceforth. This farm has another complete set of
improvements which will be sold with the farm (Lot B) .
I graduated from Colorado State University with a B. S. degree
in Agriculture , and have spent the past nine years in the
Agricultural profession. I wish to remain involved in Agri-
culture on a small scale , and approximately 1 . 2 acres of the
x+. 52 acres in Lot A is suitable for this purpose . The exis-
ting field will not be compromised due to the existing lay of
the terrain. The major portion of this land must be back-
irrigated with run-off water from the adjacent farm. It has
been very impractical to flood irrigate the small remaining
portion due to the slope and short length of run, however, this
may be easily sprinkled with water from the domestic well .
In summary, there will be no requirement for the construction
of another residence since Lot B already has its own set of
good improvements . The 1 . 2 acres of agricultural land will
not hinder current farming operations due to the lay of the
land. Also, there will be no demand placed upon the farm
(Lot B) for irrigation water.

Dear Mr. & Mrs. Schneider :
Your application and related materials for the above described
request are complete and in order . I have scheduled a meeting
with the Board of County Commissioners for April 24 , 1978 , at
approximately 9 : 30 a.m. This meeting will take place in the
County Commissioners ' Hearing Room, First Floor , Weld County
Centennial Center, 915 - 10th Street , Greeley , Colorado. It
is recommended that you and/or a representative be there to
answer any questions the Board might have with respect to your
application .
It is the policy of Weld County to refer an application of this
nature to any town lying within three miles of the property in
question . Therefore , I have forwarded a copy of the materials
submitted to the Town of Severance for their review and comment .
According to our records , the Town of Severance will review and
comment on your application on April 12 , 1978 . Please contact
Mr. Lowell Hummels at 686-9908 for further details on the Town
of Severance Planning Commission meeting.
