HomeMy WebLinkAbout780740.tiff RESOLUTION RE: ADOPTION OF MINERAL LEASING BIDDING PROCEDURES FOR OIL, GAS, COAL, URANIUM AND OTHER MINERALS. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado deans it advisable and in the best interest of Weld County to adopt mineral leasing bidding procedures for oil, gas, coal, uranium and other minerals, and WHEREAS, after careful consideration the Board of County Com- missioners desires to implement the following procedure for the leasing of all minerals, to-wit: 1. The Board of County Commissioners will determine in ad- vance all tracts to be offered for leasing for the purpose of developing any type of minerals, including oil and gas, uranium, coal and any other minerals which are owned by the County either as severed minerals or minerals underlying the County-owned surface real estate. The Board of County Com- missioners may delegate the selection of these tracts to a qualified person employed by Weld County. The Board of County Commissioners will determine whether tracts will be leased on an individual basis or in groups, whichever would be in the best interest of Weld County. Until ownership of mineral in- terests owned by Weld County is determined by title search, Weld County will continue to lease mineral lands only upon re- quest of prospective lessees. 2. A notice shall be published in a newspaper of general circulation in the State at least thirty (30) days prior to the date selected for bid opening, which notice shall describe the available tracts by legal description and request bids to be submitted on a date prior to the opening of the bids. In addition, the Board of County Commissioners shall maintain a mailing list of prospective bidders compiled from County /1 f �// 780740 records of previous lessees and any other available sources, including the list of lessees compiled by the State Board of Land Commissioners which is maintained in Denver in connec- tion with the State of Colorado Mineral Leasing Program. The Board, in its discretion, may advertise certain tracts in local newspapers and in newspapers in other states, when, in the Board' s discretion, such advertising will promote ad- ditional bidding activity. 3. All bids are to be submitted as sealed. Bids will be accepted subject to the Weld County lease forms and the pro- visions incorporated in the Weld County lease forms. The County will provide lease forms for each type of mineral to be leased, and will accept no other lease forms. Overriding royalty will generally be limited to two percent (2%) but, in the discretion of the Commissioners , additional overriding royalties may be permitted on a case-by-case basis. 4 . The sealed bidssubmitted will be opened at a regular public meeting of the Board of County Commissioners after the required thirty day notice. The thirty day notice shall give the date of the opening of the sealed bid. The high bid will re- ceive the lease unless exceptional circumstances indicate to the Board that it is in the best interest of the County to accept an alternate bid. In the case of a dispute concern- ing which of two or more bids shall be more advantageous to the County, the Commissioners ' decision shall be final. The Commissioners may reject any and all bids. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of February , A.D. , 1978 .
