RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 61 - MILDRED FRANK AND
HAROLD AND JACQUELINE GOLDSMITH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Mildred Frank and Harold and
Jacqueline Goldsmith for an exemption from the definition of
"subdivision" and "sub-divided land" in Section 30-28-101 (10) ,
CRS 1973, as amended, and Section 2-1 of the Weld County Sub-
division Regulations, and
WHEREAS, the Board of County Commissioners finds that Mildred
Frank and Harold and Jacqueline Goldsmith are the owners of a
parcel of land in Part of the VISA of Section 27, Township 6
North, Range 65 West, Weld County, Colorado. The exemption is
for the purpose of changing the existing boundaries of the Gold-
smith parcel on the east and west sides, thus enlarging the parcel
from 1. 42 acres to 1. 67 acres. No new parcels are being created.
The legal description for the abovementioned tract of land is set
forth in Exhibit "A" being attached hereto and incorporated herein
by reference, and
WHEREAS, the Board of County Commissioners has considered the
recommendations of the Department of Planning Services on this
matter and has reviewed information submitted by the applicants.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the aforementioned
tract of land owned by the applicants, be, and hereby is, declared
to be exempt from the definition of "subdivision" and "sub-divided
land" as set forth in Section 30-20-101 (10) , CRS 1973, as amended,
and in Section 2-1 of the Weld County Subdivision Regulations, and
further finds that said tract shall be considered a single lot.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of

The owners of the following described property have requested an
exemption from Section 2-1 of the Weld County Subdivision Regu-
lations adopted August 30, 1972 , which defines the term subdivi-
sion:

The Planning Department has reviewed this request and recommends
that the request be approved for the following reasons :

PROPERTY Mildred B. Frank, owner of property described in Exhibit I,
OWNERS: and
Harold A. Goldsmith and Jacqueline Goldsmith, owners of
property described in Exhibit III.
The undersigned hereby respectfully request a subdivision
exemption of proposed conveyance of a tract of land specifically
described on survey of such revised parcel made by Gerald B. McRae,
Registered Land Surveyor and Professional Engineer on the 10th day of
November 1977, under Project 77063 of McRae & Short, Inc. , said plat
is included in the list of documents submitted herewith, namely:
1. Total Tract Description as conveyed by Executrix' s
Deed, dated January 27, 1960, and recorded on January 28, 1960, in
Book 1549, Page 577, under Reception No. 1321730, Weld County Records,
which conveyed the following described property to-wit :
The E'/z of the SW'/q of Section 27, Township 6
North, Range 65 West of the 6th P.M. , Weld
County, Colorado, EXCEPT those parcels set
forth under items 2, 3 and 4 hereinafter im-
mediately set forth, and
identified for purposes of this exemption request as Exhibit I,
presently owned by Mildred B. Frank, formerly Mildred B. Goldsmith;
2. First Exception to total description which conveyed a
parcel of 2.03 acres, more or less, to the Union Pacific Railroad
Company, by Warranty Deed, dated March 3, 1909, and recorded on
April 26, 1909, in Book 300, Page 467, under Reception No. 140764,
Weld County Records, identified for purposes of this exemption
request as Exhibit II;
3. 2nd Exception to total description, which conveyed a
parcel of land containing 1.42 acres, more or less, to Harold A.
Goldsmith and Lee Roy Goldsmith by Warranty Deed, dated December
19, 1958, and recorded on December 20, 1958, in Book 1520, Page
441, under Reception No. 1293721, Weld County Records, and
identified for purposes of this exemption as Exhibit III, and said
parcel is presently owned by Harold A. Goldsmith and Jacqueline
Goldsmith, two of the undersigned;
4. Third Exception to total description, which conveyed
one square acre of land to be used for school purposes, to School
District No. 6, dated and recorded on September 18, 1882, in Book
14, Page 453, under Reception No. 9006, Weld County Records, and

identified for purposes of this exemption request as Exhibit IV;
5. Plat of McRae & Short, Inc. , of property described in
Exhibit III and the proposed revision of said parcel, identified
herein as Exhibit V;
6. Plat of Survey of proposed revision of property described
in Exhibit III, with legal description of revised plat included
thereon, identified as Exhibit VI.
The undersigned would respectfully state that the proposed revision
of the original parcel listed under item 3 hereof is for purposes of
straightening the boundaries between said tract and the land owned
by Mildred B. Frank; further, that such revision will not create
any additional parcels. The present parcel owned by Harold A.
Goldsmith and Jacqueline Goldsmith, and which contains two houses,
the former Goldsmith Dairy milk plant and other outbuildings, will
include 1.67 acres, rather than the present 1.42 acres. Such new
revision will include all of the present improvements.
The undersigned would also point out that the new revised tract
will eliminate two present easements, in addition to eliminating
the present irregular tract boundaries. Such revision will be
accomplished by having Mildred B. Frank execute a Quit Claim Deed
to the said Harold A. and Jacqueline Goldsmith conveying the
property described in Exhibit VI. In return Harold A. and Jacqueline
Goldsmith will convey to Mildred B. Frank by Quit Claim Deed all of
the E of the SIAN of said Section 27, excepting that parcel described
in Exhibit VI. /

R. Pope, her attorney, and this matter coming on to be heard upon the
Report of Sale of all the right, title and interest of said Estate ;• .-
in and to the real estate of Goldsmith Dairy Farm, a co-part rrship
which was in existence prior to the death of P. H. Goldsmith, deceased,
and consisted of P. H. Goldsmith and Oliver H. Goldsmith, made under
} and by virtue of and pursuant to the terms of General Articles of
Co-Partnership of said Goldsmith Dairy Farm, and the provisions of r
the Last Will and Testament of P. H. Goldsmith, Deceased, and Order
of this Court heretofore entered herein;
And it appearing to the satisfaction of the Court that in making
said sale the said Marie Kathryn Goldsmith, as Executrix and Sole

by the said Marie Kathryn Goldsmith as such Executrix and Sole Legatee

Irrigating Company, and 8 shares of the capital stock of the Pleasant

recorded in Book 300 at Page 467, Weld County Records, and 1.42
acres conveyed by deed to Harold A. Goldsmith and Lee Roy Goldsmith,
recorded in Book 1520 at Page 441, and one square acre conveyed by
deed recorded in Book 14, Page 453, Weld County Records; for the
sum of $ /5410. m , said sum being equal to the appraised value of
said described real estate, said sum is not disproportionate to the
value of said real estate, BE AND THE SAME IS HEREBY APPROVED AND
CONFIRMED.
IT IS FURTHER ORDERED that the said Marie Kathryn Goldsmith,
as Executrix of said Estate, asks, execute, acknowledge and deliver
unto the said Oliver H. Goldsmith a good and sufficient deed of
conveyance, conveying to the purchaser all the right,title and ante-
. rest and estate in and to the said premises and property so sold
which the said P. H. Coldsmith, deceased, had therein at the time of
his decease, and with the saws effect as if made by the said decedent
