WELD COUNTY COUNCIL DEC ? 1977

_The Weld County Council met in regular session in full
conformity with the Weld County Home Rule Charter at
9th Avenue and 9th Street, Greeley, Colorado, November
15, 1977 at the hour of 9 A.M.
ROLL CALL: The following members were present:
Bob E. White, Vice President
John T. Martin, Councilman
Floyd Oliver, Councilman
Robert Martin, Councilman
Also present: Observer for the League of Women Voters, Bev
Brown; Commissioner Ed Dunbar; Attorney Robert Ray; four
members of the press; and the secretary, Beverly Thomas.
MINUTES: Floyd Oliver made a motion that the minutes of the
November 1, 1977 meeting be adopted. The motion was
seconded by Bob Martin and passed unanimously.
CORRESPONDENCE: Bob White read a memo from Sheriff Bower and a
letter from the Agriculture Council of Weld County.
REPORTS:
ENGINEERING: Floyd Oliver reported that 35th Avenue is again
open for use.
EDITORIAL REGARDING SHERIFF DEPARTMENT: Bob White read Sheriff
Bower's response to an editorial printed in The Eaton Herald.
The editorial was also read aloud by Bob Martin. Floyd Oliver
made a motion that the Council send a letter to the editor of
The Eaton Herald requesting that if he has more information
regarding the incidents described in the editorial that he
send it to the Sheriff and the County Council. John Martin
seconded the motion and it passed unanimously.
SEVERED MINERAL RIGHTS: Bob White read a letter from the Agriculture
Council of Weld County that included a resolution backing the
resolution of the Weld County Livestock Association regarding
severed mineral rights.
Floyd Oliver felt that the area of severed mineral rights was
a subject upon which the Council should act. Bob White
suggested that perhaps the Colorado Counties, Inc. would be
a source of information regarding other counties that may
own severed mineral rights. Floyd Oliver made a motion that
the secretary draft a letter to Colorado Counties, Inc. and
ask them to send any information they have on County owned

mineral rights. The letter should also ask if any counties
have taken steps to dispose of their mineral rights. Bob
Martin seconded the motion and it passed unanimously.
FINAL BUDGET MEETINGS: Bob White announced that Mr. Dority is
going to present the County Commissioners with the adjusted
budget at their November 21, 1977 worksession at 3 P.M.
Also, the last public hearing on the Budget and Revenue
Sharing will be held November 23, 1977 at 7:30 P.M. in the
Centennial Building.
A discussion of the 1978 Budget ensued. Concerns were ex-
pressed that though the budget was staying within the 5%
increase-guideline huge increases in spending are projected.
John Martin said that he did not believe in government holding
huge reserves, but to see the County's reserves used up to
avoid more than a 5% increase concerned him. Bob White was
concerned that this might lead to financial problems for the
County in the future. Mr. White stated that Mr. Dority had
told him that the ending balance of the reserves was to be
somewhat higher than the initial budget summary indicated.
There was discussion regarding the interpretation of the
Home Rule Charter's provision for the Council to approve a
5% increase in the County budget. It was stated that for the
1977 Budget the Council was asked to approve each mill levy
individually if it were over a 5% increase whereas for the
1978 Budget the Council had been told their approval was
necessary only if the total budget exceeded a 5% increase.
Robert Ray was asked to interpret the Home Rule Charter's
Article XIV, Section 14-7 (1) regarding the allowed budget
increase of 5%. Mr. Ray said that he would have to study
the matter. He would telephone Mrs. Clark if a special
meeting of the Council was necessary on this topic. If a
special meeting was not necessary he would be prepared to
present his findings at the December 6, 1977 regular Council
meeting.
NEW BUSINESS:
COUNCIL'S MOVE TO CENTENNIAL BUILDING: Bob White announced that
the Council 's office would be moved to the third floor of
the Centennial Building at 10 A.M. on November 16, 1977.
Floyd Oliver made a report to the Council of his meeting
with Hensel Phelps personnel to accept the new offices on
behalf of the Council.
LIST OF COUNCIL 'S CONCERNS: Bob White read the list of the Council's
concerns that the secretary had prepared from the Council's
meeting minutes. John Martin mentioned that it appeared that
the Council 's plan to review election procedures before the next
election had been left off the list.

Floyd Oliver made a motion thal the Council 's list of concerns
be considered at the next Council meeting. John Martin seconded
► the motion and it passed unanimously.
